CONDITIONAL USE PERMIT - AUTO SALES LOT
Proposed Action.
Staff recommends the following motion: Move
Resolution 92-44 approvinq a conditional use
operate an auto sales lot at 1714 Mainstreet.

Mr. Hutchison moved and Mr. Winship seconded the motion to
approve Resolution RZ92-9 recommending approval of a
conditional use permit to operate an auto sales lot at 1714
Mainstreet. The motion carried unanimously.
Overview.
The applicant is proposing to have an
Mainstreet. The site is zoned B-3.

The proposed site for the auto sales lot was the former site
of Union Prescription at 1714 Mainstreet. The applicant is
proposing to use the building as an office and the west side
parking lot for the auto sales lot. The east side of the
parking area will be used for customer and employee parking.
staff reviewed the request for the auto sales lot. Carl
Hanson, the applicant, appeared before the Commission. Mr.
Hanson stated that he wanted to start an auto sales lot.
Mr. Hanson also stated that he has talked to the surrounding
businesses and has received positive comments. There was no
one in the audience that spoke on this item.

o What are the specifics of the site plan?
The site will have the sales lot on the west side of the
site and customer/employee parking on the east side. There
is existing landscaping in the front and sides of the
building. The landscaping will be upgraded in accordance
with the plan submitted by the applicant (see attached).
Access to the site will remain the same.

o What are the conditions for an auto sales lot?
The following are the conditions in the Zoning Ordinance for
an auto sales lot:
1. The sales lot shall not be larger in square footage
than the square footage of the building devoted to the
related business;
2. A 20 foot front yard setback for auto parking;
3. Lighting of the sales lot shall be totally from
indirect lighting;
4. Should the lot abut an R district an acceptable design
of screening fence five feet in height shall be
constructed along the abutting lot line;
5. The auto sales lot shall not include vehicles over a
9,000 lb. rated weight;
The applicant's plan will meet all the conditions required
for a conditional use permit. The applicant will only be
using the west side of the parking area for a sales lot.
The applicant is allowed to have 1200 square feet for the
sales lot, of which the applicant is using 975 square feet.
The east side of the lot will be used for customer parking.
The site is required to have 6 parking spaces for customers
and employees.
o What are the surrounding uses?
The property is surrounded by the following uses:
East - Clark gas station
West - Kentucky Fried Chicken

North - an auto repair facility, a residential home and an
office building
South - Discount Tire
o What are the staff recommendations?
The staff recommends the following:
o Construct a four foot wood opaque fence on the
west side of the property
o Provide more landscaping in the front yard as per
the landscaping plan
o One year review of conditional use permit by the
Planning Commission
o Applicant provide a letter of credit, cash, or
other form of security acceptable to the City to
ensure the completion of the fence and additional
landscaping
o No sale vehicles are to be parked in the area
designated for customer parking
o Only 9 vehicles for sale may be displayed on the
lot at anyone time
Alternatives.
1. Approve the conditional use permit, with the conditions
as recommended by staff. By approving the conditional
use permit with conditions, the applicant will be able
to operate an auto sales lot at 1714 Mainstreet.
2. Approve the conditional use permit, with staff
conditions or other conditions. By approving the
conditional use permit, the applicant will be able to
operate an auto sales lot at 1714 Mainstreet.
3. Deny the conditional use permit. By denying the
conditional use permit, the applicant will not be able
to operate an auto sales lot at 1714 Mainstreet. If
the City Council denys the conditional use permit,
findings of fact will have to be identified which
support the denial of the conditional use permit.
4. Continue the conditional use permit. If the City
Council indicates that further information is needed,
the item should be continued.

RESOLUTION NO: 92-44
RESOLUTION MAKING FINDINGS OF FACT AND APPROVING
AN APPLICATION FOR A CONDITIONAL USE PERMIT
WHEREAS, an application for a Conditional Use Permit titled CUP 92-4
made by Carl Hanson is approved.
WHEREAS, the procedural history of the application is as follows:
1. That 'an application for a CUP 92-3 was filed with the
City of Hopkins on April 28, 1992.
2. That the Hopkins Planning Commission reviewed such
application on May 26, 1992.
3. That the Hopkins Planning Commission, pursuant to
published and mailed notice, held a public hearing on
May 26, 1992: all persons present at the hearing were
given an opportunity to be heard.
4. That the written comments and analysis of the City
Staff and the Planning Commission were considered.
5. That the development will be located on the following
described property:
North 102 feet of Lots 3, 4 and that part of Lot 5
lying West of East 25 feet thereof, Block 2, Boulevard
Manor.
NOW THEREFORE BE IT RESOLVED, that application for CUP 92-4 is hereby
approved based on the following Findings of Fact:
1. That the applicant meets the requirements for an auto sales
lot.
2. That an auto sales lot is allowed with a conditional use
permit.
BE IT FURTHER RESOLVED, that application for CUP 92-4 is hereby
approved based on the following conditions:
1. That the applicant construct a four foot wood opaque fence
on the west side of the property.
2. That the additional landscaping is added as per the
landscaping plan.
3. That the conditional use permit is reviewed by the Planning
Commission one year from the date of approval.
4. That the applicant meets the conditions for a conditional
use permit as outlined in the Zoning Ordinance for an auto
sales lot.

6. That no cars for sale are parked in the customer parking
area.
