SIGNAGE OF HENNEPIN COUNTY LRT
RIGHT OF WAY PROPERTY

This motion will allow staff to undertake necessary steps to restrict
parking to 24 hours, Monday - Friday, on the county LRT property between
7th & 10th avenues, north of Mainstreet.
Overview
The City presently eases the County LRT Right of Way from the Hennepin
County Regional Rai road Authority. This property is located between 7th &
10th avenues, north of Mainstreet. It is currently being utilized as an
unrestricted parkin area. City staff has received complaints on vehicles
being stored on thi right of way for long periods of time. Some of these
vehicles are unlice sed and unregistered, and a few have not been moved for
months. Storage of ehicles is unsightly and makes this area unattractive
for surrounding res'dences and businesses.
In an effort to mor effectively control this situation, staff is
..'~~recommendingerecti g regulatory signage along the right of way. It is
proposed this signa e will read "24 hour parking Monday - Friday". Staff is
recommending 24 hou parking Monday - Friday because this time frame will
allow a vehicle to e parked in this area through the weekend and still
remain in complianc with the parking regulation. This signage will allow
the Police Departme t to ticket and/or tow vehicles from this area which
are in violation.
Because Staff desir s to resolve this issue as soon as possible, the
parking Committee h s not been asked to act on this recommendation. The
next meeting of the parking Committee is to be held on July 15, 1992, and
at that time they w'll be updated as to the action of the City Council on
this issue.

Public Works has estimated the cost of erecting approximately 12 -15 signs
in this area at $300 - $375.
Alternatives
Based on the information above, the city Council has the following
alternatives:
1. Approve Resolution #92-50, which authorizes staff to
undertake necessary steps to sign this area for 24 hour
Monday - Friday.
2. Approve Resolution #92-50 with changes~
3. Deny the recommended motion.
4. Continue this item for further information from staff.

RESOLUTION NO: 92-50
RESOLUTION APPROVING THE SIGNING OF HENNEPIN COUNTY LRT RIGHT OF
WAY BETWEEN 7TH AND 10TH AVENUES NORTH
WHEREAS, the Hopkins City Council may by resolution designate
limited time parking, and
WHEREAS, pursuant thereto, the police department shall cause the
posting and maintenance of appropriate signs at .the
locations so designated, and
WHEREAS, Hennepin county LRT Right of Way property between 7th
and loth Avenues, north of Mainstreet is currently
leased by the city of Hopkins, 'and
WHEREAS, signage of this area for 24 hour Monday - Friday
parking will control the abandonment of vehicles on
this property, and also discourage the current practice
of "storing" vehicles on this property.
'. NOW THEREFORE BE IT RESOLVED, by the city Council of the :city of
Hopkins, that this LRT Right of Way property so
described, shall be signed for 24 'hour Monday - Friday
parking.

Upon the expiration of thirty (30) days after such service of said notice,
this Lease and all rights hereunder shall thereupon terminate and be at an end,
.~ saving and excepting such rights as may have accrued to either party hereunder
prior to such termination. LESSEE shaH, without further notice or demand, deliver
possession of said premises to the LESSOR at the expiration of said thirty (30) days
and shall, before the expiration of said thirty (30) days after said termination of
said Lease, remove all buildings and property placed upon said premises which it
may desire and have the right to remove. If it shall fail to so remove buildings and
property, its right to do so shall, at the option of the LESSOR, cease, and LESSEE'S
title thereto shall be forfeited and the same shall belong to the LESSOR; or, in
such case, if the LESSOR so elects, it may, at any time after the expiration of said
period of thirty (30) days, tear down and/or remove any or all such buildings and
property at the expense of LESSEE without any liability for damages thereof in any
~espect whatsoever and LESSEE shall thereupon promptly reimburse LESSOR for
all expenses incurred by it in so doing.
Upon any such termination of this Lease, rent shall be paid by the
LESSEE to the date of termination fixed by said notice, and if rent has been paid in
advance, LESSOR shall refund to LESSEE the unearned portion thereof for the
period extending beyond such date of. termination. Furthermore, upon termination
of this Lease by either party, LESSOR will not reimburse LESSEE for
improvements it made to said premises.
III.
LESSEE agrees to pay the sum of One ($1.00) Dollar as rent for said
premises. In addition to the sum specified as rent, LESSEE shall perform routine
. maintenance on all other non-leased portions of the former railroad rights-of-way ,1t
in the City of Hopkins and shall also perform the monitoring and enforcement of
the ,use, maintenance, upkeep and appearance of all of the former railroad rights-
,of-way in the City of Hopkins.
IV.
LESSEE shall not permit the existence of any nuisance on said premises.
LESSEE at all times shall keep said premises clean and shall comply with all laws,
ordinances and regulations respecting LESSEE'S business and use and occupation of
said premises. .LESSEF, <'\t its sole cost shall make any and all improvement~.. *
alterations, repairs and additions, including, but not limited to, grading, surfacing
and sigoing on said premises. LESSEE shall keep any sidewalk on said leased
premises, or bordering said leased premises, free and clear of snow, ice and any
obstruction to the free and safe use of said sidewalk or sidewalks at any and all
times. No bill posters or advertising matter of any kind shall be posted on said
premises. LESSEE further agrees to perform routine maintenance to said premises,
including, but not limited to snow removal and weed control.
V.
LESSEE accepts said premises subject to the rights of any person, firm
or corporation, including the LESSOR in and to any existing telephone, telegraph
and/or other wires, poles and facilities of any kind whatsoever, whether or not of
record, and should it at any time become necessary to relocate any of said poles,
wires or facilities by reason of this Lease, LESSEE shall bear and pay the cost of so
.' doing. LESSEE also accepts said premises subject to any want or failure at any
time of LESSOR'S title to said premises or any part thereof and LESSEE shall
assume any damages sustained by LESSEE in connection therewith. LESSEE also
accepts such premises subject to rights of any party, including LESSOR, in and to
