July 1, 1992 0 P K I ~ I council Report 92-144 CONDITIONAL USE PERMIT - ZION LUTHERAN CHURCH ProDosed Action. staff recommends the following motion: Move to ap~rove Resolution 92-57 approving a Conditional Use Permit for a 4' x 8' siqnwith the condition that the proposed sign have a 25 foot setback. i Mr. Winship moved and Mrs. Reuter seconded, a motion to approve Resolution RZ92-14 recommending approval of a conditional use permit for a sign at Zion Lutheran Church with a setback of 16" 1". Mr. Hutchison and Mr. Racek voted nay. The motion passed 4- 2. overview. ' Zion Lutheran Church is requesting a conditional use permit 'to have a larger sign than allowed by the Zoning Ordinance. section 570.46 allows signs that are larger ,than allowed, by conditional use permit for churches. The maximum sign allowed by conditional use permit is 60 square feet per side. The existing sign is approximately 4'x 4' and mounted on ,a stone base. The proposed sign will be constructed on the existing sign , base and extend west towards 5th Avenue. ~ The applicant has also requested a variance because the conditional use permit requires a 25 foot setback. The proposed sign will have a 16'1" setback. There was little discussion on the conditional use permit because of the discussion during the variance request. Most of the discussion focused on the size of the sign. Mr. Racek again stated he was concerned with the size of the sign. The sign is 8' x 4', which is 32 square feet. The sign will closer to 5th Avenue by 3'9". The sign itself will have the name of the church and below this will be 4 lines of 6 inch changeable copy. The sign will be approximately 5 feet high. 0 What are the requirements for a conditional use permit for a siqn? ' 570.46 Conditional Use Permit R-Districts. Signs may be permitted by Conditional Use Permit for pUblic parks and playgrounds, churches, synagogues, public libraries, pUblic museums, public and parochial schools, municipal buildings, golf course, country clubs, apartment buildings, nursing homes, community center, colleges, universities and private schools, hospitals, and sanitariums, based, on the following design criteria and other conditions the City Council may require: . a) size: The size shall be proportional to the size of the facility, need for signing, frontage on street(s), location, visibility, and development in the area. The maximum size should not exceed 60 square feet per sign surface with a maximum area of 120 square feet per single sign. b) height: No free standing sign shall ,exceed fifteen feet in height. c) lighting: 1) lighting shall be indirect or it shall be backlit 2) neon light, flashing lighting, and lor rotating lighted sign shall be prohibited d) design: signs attached to the building shall be integrated with the building design and architecture in terms of materials, colors lighting and placement; signs not attached to the buildings shall be architecturally treated and coordinated with the principal building by use of compatible materials and design. e) location: no free standing signs shall be located less than 25 feet from any street right-of-way line . CR92-144 Page 3 . f) sign purpose: the principal purpose of the sign permitted under this section shall be to identify the public or institutional use made of the property o Does the applicant meet the conditions? The applicant meets all the conditions except for the 25 foot setback. The applicant has applied for a variance. , o What is the staff recommendation? As stated in the other report, the staff is recommending that the variance is denied. The staff's initial recommendation was to deny the conditional use permit also. However, if the setback were changed to the requirements of a 25 foot setback the staff would recommend approval of the applicants sign. Alternatives. 1. Approve the condi tional use permi t wi th the setback as proposed by the applicant. By approving the conditional use permit, the applicant will be able to construct a sign , closer to the property line than allowed. 4It 2. Approve the conditional use permit with the condition that the sign have a 25 foot setback. By approving the conditional use permit with conditions, the applicant will be able to construct the proposed sign with a 25 foot setback. . 3. Deny the conditional use permit. By denying the conditional use permit the applicant will not be able to construct the proposed sign. 4. Continue for further information. CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO: 92-57 RESOLUTION MAKING FINDINGS OF FACT AND APPROVING AN APPLICATION FOR A CONDITIONAL USE PERMIT WHEREAS, an application for a Conditional Use Permit titled CUP 92-5 made by the Zion Lutheran Church is approved. WHEREAS, the procedural history of.the .application is/ as follows: 1- That ,an application for a CUP 92-5 was filed with the City of Hopkins 'on May 6, 1992. 2. That the Hopkins Planning Commission reviewed such application on June 30, 1992. 3. That the Hopkins Planning Commission, pursuant to published and mailed notice, held a public hearing on June 30, 1992: all persons present at the hearing were given an opportunity to be heard. . 4. That the written comments and analysis of the City Staff and the Planning Commission were considered. 5. A legal description of the property is as follows: Lots 1 to 4 incl and com at NW corner of Lot 17, then South to Southwest corner of Lot 12, then East 133.58 feet, then Northerly to Southeast corner of Lot 15, then Northeasterly to a point in Southwesterly line of road dis 12.5 feet Southeqsterly from Northeast corner of Lot 17, then Northwesterly to beginning. NOW THEREFORE BE IT RESOLVED, that application for CUP 92-5 is hereby approved based on the following Findings of Fact: 1. That the proposed sign meets the requirements for a conditional use permit as ,per Zoning OrdinanGe. BE IT FURTHER RESOLVED, that application for CUP 92-5 is hereby approved based on the following conditions: 1. That brick or compatible stone is added to cover the steel support pole. . , ,f: " .
