Accept Feasibility Report
Order Public Hearing
Prooosed Action.
Staff recommends the following motion: "Move that Council

Overview.
The City Council at its regular June 2, 1992 meeting heard a
proposal from the Westbrooke Condominium Association for an
expedited feasibility study for the reconstruction,
construction and extension of Westbrooke Way from 9th Ave.
South to Smetana Road. The Association proposed an
agreement with the City whereby ,it would participate in 70%
of the study cost. The proposal came in lieu of the normal
petition process. Council agreed to this proposal and
. ordered that a feasibility report concerning street
improvements be prepared. '
In the interim,a pUblic information meeting will have been
held with the Association board to discuss all improvement
issues and costs. Staff, upon considering poor, drainage
characteristics of Westbrooke Way between 11th and 9th
Avenues, has requested this segment of the roadway to be
considered in the report. Council is at a point where it
should consider accepting the feasibility report and
ordering a public hearing.

Analvsis.
0 What are the current conditions of the roadway?
Westbrooke Way from 11th to 9th Avenue is approximately
20 years old and is a dedicated city street with
concrete curb,and gutter. Although the existing
pavement is in fair condition, the roadway and curb
have settled due to poor subgrade soils and this has
caused several low points for ponding of water on the
roadway itself. There is no storm sewer along this
segment of roadway and due to flat grades drainage is,
simply put, very poor.
Westbrooke Way from 9th Avenue to Old Settler's Trail
(a private drive) is a 24-foot private roadway. The
street 'is in poor condition, characterized by many
potholes and patches, settlement areas due. to poor
subgrade soils, and flat street grades without the
benefit of curb and gutter causing s~orm water to pond
within the roadway. The private drive terminates at
Old Settlers's Trail.
Street lighting on J:>oth the public and private segments
of Westbrooke Way is inadequate. There are no street
. lights between 11th and 9th Avenue and only four lights
on the private drive.
0 Should the Council accept the feasibility report?,
Representatives from RCM Associates will be present at
council proceedings to make an oral presentation of
their findings. Staff finds the report to be complete
and recommends its acceptance.
0 Should the Council order a public hearing?
council ordered the report to be drawn up without the
benefit of a petition. Staff directed the inclusion of
roadway improvements b~tween 11th and 9th Avenues in
the report also without request by the residents.
Therefore, for Council to continue any further action
on a Westbrooke Way improvement project will require a
super majority vote. council would most certainly feel
more comfortable with proceeding on this project if it
had some idea of resident sentiments. Staff recommends
that council order a public hearing for August 18, 1992
and that staff include a response mailer for the
residents upon their receipt of the mailed hearing
notice. In this manner staff can advise Council the
true sentiments of the 526 individual Westbrooke condo
owners.

Resolution No. 92-61
WHEREAS, the city Council authorized and directed the
preparation of a report with reference to the
improvement of Westbrooke Way by way of its
reconstruction and construction/extension, and
WHEREAS, the engineering firm of RCM Associates has prepared
the aforesaid report for the improvement herein
described,
NOW, THEREFORE, BE IT RESOLVED by the city Council of
Hopkins, Minnesota:
1- The Council will consider the aforesaid
improvement in accordance with the report and the
assessment of abutting and non-abutting property
for all or a portion of the cost of the
improvement from 11th Avenue to Smetana Road
pursuant to Minnesota Statutes Chapter 429 at an
estimated total. cost of the improvement of
. $703,000.
2. A public .hearing will be held in the Council
Chambers of the city Hall at 1010 1st Street South
on Tuesday, the 18th day of August, 1992 at 7: 30 .
P.M. to consider said improvement. The city clerk
shall give mailed and published notice of said
hearing and improvement as required by law.
