Staff recommends the following motion: Move to approve Resolution 92-66 ap~rovinq Ordinance 92-715 to rezone Lots 2 and.3 of the Hopkins Commerce. Center from I-1 to B-3 for first reading. Mr. Day moved and Mrs. Reuter seconded the motion to approve Resolution RZ92-18 recommending approval ofa rezoning from 1-1 to B-3 for Lots 2 and 3 Hopkins Commerce Center. overview. The Hopkins Commerce Center has recently platted the property on the northwest corner of Blake Road and County Road 3.. During the platting process it was determined that a zoning line goes through Lot 3 approximately 100 feet and part of the north section of Lot 2. The two zones are I-1, Industrial and B-3, General Business. .. The staff recommended in conjunction with the platting that Lot 2 and Lot 3 are rezoned to B-3, General Business. The staff is making this recommendation because of the location of these lots and the existing retail uses. The staff reviewed the applicants request with the Commission. Mike Salloway rep~esenting the applicant appeared before the Commission. The building in Lot 3 has the following uses: o a video store o a restaurant o an auto parts store o an antique store All of these uses are permitted in the B-3 zoning district. The area to be rezoned in lot 2 does not have any buildings. o What property will remain'industrial zoning? Lot 1 in which the Goodwill store is located will remain an industrial zoning. At the time Goodwill moved into this location retail was permitted in the industrial district. o How has the comprehensive Plan designated this site? . The Comprehensive Plan has designated this site, as. Commercial. The proposed rezoning is consistent with the Comprehensive Plan. o What are the consequences of not undertaking the rezoning? The area which is zoned 1-1 in Lot 2 has no buildings in this area. The rezoning of Lot 2 will not impact any uses, but will result in Lot 2 being in one zoning district. The consequences of not rezoning Lot 2 will be two different zones in one lot. In the case of Lot 3 where a building is involved is different. If the existing uses move out, only the permitted uses within the 1-1 district w.ill be allowed in the area that is zoned 1-1. The result would be to have industrial uses at one part of this shopping center. Alternatives. 1. Approve the rezoning. By approving the rezoning, the City Council will rezone the subject property from 1-2 to B-3. 2. Deny the rezoning. WHEREAS, the procedural history .of the application is as follows: . 1. That an application for ZN 92~3 was filed with the city of Hopkins on June 23, 1992. . 2. That the Hopkins Planning Commission reviewed such application on July 28, 1992. . 3. That the Hopkins Planning Commission, pursuant to published and mailed notice, held a public hearing on July 28, 1992: all persons present at the hearing were given an opportunity to be heard. . 4. That the written comments and analysis of the City Staff. and the Planning Commission were considered. NOW THEREFORE BE IT RESOLVED, that application for ZN 92-3 is. hereby approved based on the following Findings of Fact: 1. That the Comprehensive Plan has designated Lot 2 and 3 Hopkins Commerce Center as Commercial. 2. That the existing uses on the site are permitted in the B-3 district. CITY OF HOPKINS Hennepin County., Minnesota ORDINANCE NO. 92-715 AN ORDINANCE AMENDING THAT PART OF HOPKINS ZONING ORDINANCE 515-570 PERTAINING TO AND CHANGING THE ZONING BE IT ORDAINED by the City Council of the City of Hopkins as follows: That the present zoning classification of 1-1, Industrial upon the following described premises is hereby repealed and in lieu thereof the said premises are hereby zoned as B-3, General Business: Lots 2 and 3, Block 1 Hopkins Commerce Center Addition. according to the plat thereof on file or of record in the office of the Register of Deeds in and for Hennepin county. That the presently exiting Hopkins Zoning Map adopted as . part of the Hopkins Zoning Ordinance No. 515-570 is hereby amended and changed in accordance with the above provisions.
