CONTRACT FOR REHABILITATION INSPECTION SERVICES
proposed Action
staff recommends approval of the following motion:
Authorize Mayor and city Manager to execute Contract for
Rehabilitation Inspection Services between the City of
Hopkins and Firmus Opitz. Independent Contractor.
With approval of this motion, the contract will be executed
and remain in effect until the termination by either party,
Overview
As part of the rehabilitation loan/grant program, an
inspection of the property to be improved must be performed.
The inspection must identify all code violations, incipient
code violations and weatherization deficiencies.
This list must then be used to prepare the "Scope of Workll
which details each improvement; the materials to be used and
. the manner in which the work is to be accomplished. The
Scope of Work is then used to obtain bids and eventually to
become part of the rehabilitation contract between the
homeowner and the contractor.
The inspection must be done by someone very familiar with
the current building codes as well as the Rehabilitation
Loan/Grant Program Guidelines. The City Attorney has
advised against using City Inspectors to complete the
inspection/scope of Work preparation as the knowledge of the
deficiencies may force the homeowner to undertake
improvements regardless of whether or not they receive a
loan or grant to do so. Therefore, the City must contract
with an outside inspector for the rehabilitation program
inspections.

Analvsis of Issues
o What is the cost of the contracted services?
The cost of the rehabilitation inspection services will be
$200 per inspection and preparation of a "scope of Work".
If reviewal of the bids is determined to be necessary, this
will be done for an additional $50.
o What were the other estimates for the service?
The last time estimates were obtained, they were as follows:
Metro HRA - $300
Dick Warwick - $300
Don Hedquist - $275
Firmus Opitz - $200
Kevin Mealhouse - $90
Mr. Mealhouse performed the inspections for a short time,
. however, he soon indicated that he could not continue to do
so. Staff then began to use Mr. Opitz and has been
satisfied with his work. Therefore, staff is recommending
that a contractual arrangement be entered into with Mr.
opitz.
Alternatives
o Authorize City Manager to execute contract with Mr.
Opitz.
o Elect to contract with another inspector or obtain
additional estimates.

CONTRACT FOR PROFESSIONAL SERVICES
IT IS HEREBY AGREED THAT, Firmus Opitz is to furnish services as herein stated for the
CITY OF HOPKINS, MINNESOTA. It is further agreed that said services are to be
rendered as an independent contractor and not as an employee of the City of Hopkins.
Accordingly, the above named contractor shall not be entitled to or receive any benefits,
such as vacation or sick leave pay, pension and insurance contributions, or holiday or
overtime pay. This agreement shall take effect upon its execution by both parties and
shall remain in effect until
