Staff recommends the following motion: Move to adopt Resolution 05-107, approving a side yard setback at 121 Ashley Road. At the Zoning and Planning meeting, Ms. Halverson moved and Ms. Hatcher seconded to adopt Resolution RZ05-34, recommending approval of a side yard setback at 121 Ashley Road. The motion was approved unanimously. Overview. The applicant, Kurt Krumenauer, is proposing to remove the roof over the garage and construct a new roof with dormers on the home at 121 Ashley Road. The new roof will not be higher than the existing roof and the garage will remain. The purpose of the new roof and dormers is to provide living space over the garage. The property is zoned R -l-C and requires a 12- foot side yard setback for a two-story home. The existing home has a 10'7" side yard setback. The applicant needs a variance because any expansion is considered an expansion of a non-conforming building. Primary Issues to Consider. . What does the ordinance require? . The side yard setback in the R -l-C zoning district for a two-story home is 12 feet. . What are the specifics ofthe applicant's request? The garage's existing setback is 10 feet 7 inches. The applicant is requesting a variance of one foot, fiye inches. . What special circumstances or hardship does the property have? The Zoning Ordinance states the following: a variance is a modification or variation from the provisions of this code granted by the board and applied to a specific parcel of property because of undue hardship due to circumstances peculiar and unique to such parcel. The Zoning Ordinance also states the following: that the Commission must find that the literal enforcement of the provision of the Zoning Ordinance would cause an undue hardship because of circumstances unique to the individual property under consideration and that the granting of a variance to the extent necessary to compensate for said hardship is in keeping with the intent of this code. In this case, the applicant has a hardship that is unique to the property. The new roof will be the same height as the existing roof. The only change will be the addition of dormers. The existing setback will not change. . What was the discussion at the Zoning and Planning meeting? Ms. Anderson reviewed the proposed variance. Ms. Anderson stated that the garage will remain with the same setback. Scott Mayer representing the applicant appeared before the Commission. Mr. Mayer stated that the area over the garage will be used for a master suite. No one appeared at the meeting regarding this issue. Alternatives. 1. Approve of the variance. By approving the variance, the applicant will be able to construct the dormers as proposed. 2. Deny the variance. By denying the variance, the applicant will not be able to construct the dormers as proposed. If the City Council considers this alternative, findings offact will have to be stated that support this recommendation. 3. Continue for further information. If the City Council indicates that further information is needed, the item should be continued. CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO: 05-107 RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A VARIANCE FOR A SIDE YARD SETBACK WHEREAS, an application for Variance VN05-7 has been made by Kurt Krumenauer; and WHEREAS, the procedural history of the application is as follows: 1. That an application for Variance VN05- 7 was made by Kurt Krumenauer on September 23,2005; 2. That the Hopkins Zoning and Planning Commission, pursuant to mailed notice, held a meeting on the application and reviewed such application on October 25, 2005: all persons present were given an opportunity to be heard; 3. That the written comments and analysis of the City staff were considered; and 4. Legal description of the parcel is as follows: Lots 6 and 7 and the north Y2 of Lot 8, Block 2, F.A. Savages Interlachen Park. NOW, THEREFORE, BE IT RESOLVED that application for Variance VN05-7 for a reduction in the side yard setback from 12 feet to 10 feet 7 inches is hereby approved based on the following Findings of Fact: 1.
