Proposed Action.
staff recommends the following motion: Move to
Resolution 92-85 approving ordinance 92-716. vacatinq

Mr. Johnson moved and Mr. Winship seconded a motion to approve
Resolution RZ92-24 recommending approval of Ordinance 92-716
vacating the east/west alley south of 44 Fifth Avenue South. The
motion carried unanimously.
overview.
In conjunction with the development of the 24 unit handicapped
housing project the alley running east/west, south of 44 Fifth
Avenue South will have to be vacated.
. This alley provides access to Fifth Avenue South to the residents
on Fifth and sixth Avenue and the apartment building on Second
Street. with the removal of the homes along Fifth Avenue, the
only homes impacted will be the homes along sixth Avenue and the
apartment building.
staff reviewed the vacation of the alley with the conditional use
permit proposal. Two neighbors appeared at the meeting and
approved of the alley vacation because it was felt the alley was
dangerous with respect to its relationship with Fifth Avenue.
The staff did receive a letter from a neighbor that objected to
the alley vacation. The Commission did ask if the project could
proceed if the alley was not vacated. Mr. Bjerkesett stated the
project could not proceed without the vacation of this alley.

Primary Issues to Consider.
o What is the impact of vacating this alley?
The portion that will be vacated is east of the alley running
north/south. When the east/west alley is vacated, the residents
on 6th Avenue and the apartment building on 2nd street will not
have direct access to 5th Avenue from the remaining alley. The
northlsouth alley between 5th. and 6th Avenue will remain open
along with the east/west alley to 6th Avenue Which will provide
access to 6th Avenue.
The alley access to 5th Avenue in this area has been a concern to
staff. It does not have good visibility and is located fairly
close to the County Road 3/Sth Avenue intersection.
At the concept review, several neighbors did appear, and had no
objection to the alley being vacated.

The subject alley intersects the site in a way that without the
vacation of the alley the development could probably not proceed.

indicates that further information is needed the item should

RESOLUTION NO: 92-85
RESOLUTION MAKING FINDINGS OF FACT AND
APPROVING AN APPLICATION FOR A VACATION
HANDICAP HOUSING - VACATION OF ALLEY
WHEREAS, an application for a vacation entitled VAC 92-2 made by City
of Hopkins is approved.
.
WHEREAS, the procedural history of the application is as follows:
1. That an application for a vacation VAC 92-2 was filed
with the City of Hopkins on August 31, 1992.
2. That the Hopkins Planning commission reviewed such
application on September 29, 1992.
3. That the Hopkins Planning Commission, pursuant to
mailed and published notice, held a public hearing on
September 29, 1992: all persons present at the hearing
were given an opportunity to be heard.
4. That the written comments and analysis of the city
Staff and the Planning Commission were considered.
NOW THEREFORE BE IT RESOLVED, that application for VAC 92-2 is hereby
approved based on the following Findings of Fact:
1. That the subject alley is not needed for a public purpose.
BE IT FURTHER RESOLVED, that application for VAC 92-2 is hereby
approved based on the following Conditions:
1. That the conditional use permit is granted to construct the
24 unit handicap housing building.
