Proposed Action.
staff recommends the following motion: Move that Council adopt
Resolution 92-99. Resolution Approvinq Plans and
Specifications. Street and Utility Reconstruction - Westbrooke
Way. Proiect 92-08. and Authorizinq the Advertisinq for Bids.
Overview.
Council at its July 21 meeting reviewed and accepted the
feasibility report concerning the reconstruction of Westbrooke
Way from 11th Avenue to Old Settlers Trail. A public hearing was
ordered for August 18 at which time council considered a
preliminary street and storm sewer design and proposals for
street lighting, sidewalk, trail and landscaping. Comments were
taken from residents and the Meadow Creek condominium Association
before Council went on to order final plans to be drawn up.
Those final plans and specifications are before Council for final
approva 1.

Analysis.
. Design and construction
proposed street improvements on Westbrooke Way consist of
removing the existing roadway from 11th Avenue to 9th Avenue
and removing the private roadway near Nine Mile Creek to its
terminus. Proposed improvements will correct drainage
problems with catch basins that outlet to Nine Mile Creek.
Three feet of the existing roadbed will be subcut the entire
length of the project to remove upper portions of peat and
muck soils. The subcut area will be backfilled with
compacted granular borrow material over a geotextile fabric
to provide stability and prevent contamination of the
granular material with the remaining peat soils.

From 11th Avenue to 9th Avenue the roadway will be 36 feet
wide with no parking on either side. council is alerted that
residents may petition for lifting of the parking
restrictions. The roadway from 9th Avenue to a proposed
divided street will be 30 feet in width with no parking. The
remaining roadway to its intersection with Smetana will be of
parkway design: a 15-foot southbound lane with no parking
and a 24-foot northbound lane with approximately 30 parallel
parking stalls. A 30 foot tree-lined grass median will
divide the driving lanes.
Amenities included in this plan are installation of a
concrete sidewalk on the north side of Westbrooke Way between
11th Avenue and 9th Avenue, an 8-foot bituminous path between
the roadway and the creek from 9th Avenue to Smetana Road,
intensive tree and shrub landscaping in the parkway section
of the roadway, and new street lighting. NSP has designed a
system of traditional style lighting (carriage lantern) with
poles at 160-foot intervals along the entire project.
The area south of Old Settlers Trail will be cleared of
existing trees to accommodate a surcharge period. Granular
material will be heaped upon the area to compress the
underlying peat and muck before the road is constructed,
thereby minimizing settlement after the road is constructed.
It is proposed to begin surcharging in January 1993 and
complete the process during July 1994. Originally this
surcharge period was estimated at six months. Subsequent
soil tests indicate the need for an 1S-month surcharge to
maximize compression of peat and settlement.

Because of the long surcharge period south of Old Settlers
Trail, because of numerous Westbrooke and Meadow Creek
parking lot access points on to Westbrooke Way, and because
the roadway will be closed at times, construction will need
to be phased. Phasing of construction will be needed to
provide ingress/egress for all residents from their parking

lots or garages to existing City streets. In some cases
temporary driveways will be provided between the parking
lots.
· Alternate bid items
Westbrooke North Association has sought the city's assistance
in placing needed improvements at their complex on the
Westbrooke Way bid proposal. There is a potential for cost
savings by including bituminous parking lot improvements on
this bid proposal as an alternate bid item. Acceptance of
the bid would be at the Association's discretion and the city
would bill the Association were the bid to be accepted.
Another alternate bid item would include improvements to a
city parking lot at the northeast corner of 9th Avenue and
Westbrooke Way.

. Costs/Assessments
See the attached sheet for preliminary estimates/assessment
roll. This sheet also illustrates cost participation by
various parties. Because of the unique surcharge
requirements the contract will need to be split into two
schedules. The one schedule will address surcharge costs and
Council will be asked to award that portion of the contract
at its December 8 meeting. The other schedule will address
all other project costs and staff recommends that portion of
the contract be awarded in March after normal assessment and
appeal process procedures have run their course.

RCM Associates has met with Meadow Creek Association members
to discuss these final plans. Meetings with Westbrooke West
and Westbrooke Park are scheduled for next week.
Neighborhood issues apparently have been addressed. Staff
recommends accepting the plans for improvements estimated to
cost $791,000 as proposed in the feasibility study.

RESOLUTION NO: 92-99
RESOLUTION APPROVING PLANS AND SPECIFICATIONS
STREET AND UTILITY RECONSTRUCTION - WESTBROOKE WAY, PROJECT 92-08
AND AUTHORIZE THE ADVERTISING FOR BIDS
WHEREAS, pursuant to a resolution passed by the council on August
18, 1992, plans and specifications for reconstruction of
streets and storm sewer, Westbrooke Way, have been prepared
by RCM Associates, Inc., and they have presented such plans
and specifications to the Council for approval,
NOW THEREFORE BE IT RESOLVED, by the city Council of Hopkins,
Minnesota:
1. Such plans and specifications, a copy of which are attached
hereto and made a part hereof, are hereby approved and
ordered place on file in the office of the city Clerk.
2. The city Clerk shall prepare and cause to be inserted in the
official paper and in the Construction Bulletin an
advertisement for bids upon the making of such improvement
under such approved plans and specifications. The
advertisement shall be published twice, at least twenty-one
days before date set for bid opening, shall specify the work
to be done, shall state that bids will be received by the
clerk until 10:00 a.m., on the 2nd day of December, 1992, at
the city Hall and that no bids shall be considered unless
sealed and filed with the clerk and accompanied by a
certified check or bid bond, payable to the city of Hopkins,
Minnesota for 5% of the amount of such bid.
3. The clerk and engineering superintendent are hereby
authorized and instructed to receive, open, and read aloud
bids received at the time and place herein noted, and to
tabulate the bids received. The Council will consider the
bids, and the award of a contract, at the regular city
Council meetings of December 8, 1992 and March 16, 1993.
