CR 97-122 Amend Legislative Policy 2-GJ June 24, 1997 Proposed Action Staff recommends that the Council approve the following motion: Move that the Hopkins City Council approve Resolution #97 -69, amending Legislative Policy #2 -G. Adoption of this motion will designate who shall assume the duties of City Manager when he or she is unable to perform those duties. Overview Section 6.01 of the Hopkins City Charter states that during the absence or disability of the City Manager, the duties of the office shall be performed by some properly qualified person designated by the City Council. The Hopkins City Council adopted a Legislative Policy in 1990 designating the persons who would act as City Manager. Since that time personnel changes have occurred which require the existing policy to be amended. Primary. Issues to Consider Who should be designated as Acting City Manager? In most case the Assistant City Manager would be the Acting City Manager. In those circumstances where both the City Manager and Acting City Manager are not available the recommendation is to designate the Finance Director and Public Works Director as alternates. Genellie sistant City Manager AMEND LEGISLATIVE POLICY #2 -G POLICY DESIGNATING DUTIES OF CITY MANAGER DURING ABSENCE OR DISABILITY S Y 0 Council Report 97 -122 A RESOLUTION DESIGNATING WHO SHALL ASSUME THE DUTIES OF CITY MANAGER DURING THE ABSENCE OR DISABILITY OF THE CITY MANAGER WHEREAS, Section 6.01 of the Hopkins City Charter states that during the absence or disability of the City Manager, the duties of the office shall be performed by some properly qualified person designated by the City Council; and WHEREAS, the circumstances of an emergency may require action before the City Council can meet and confer; and WHEREAS, the Hopkins City Council adopted a Legislative Policy in 1990 designating the persons who would act as City Manager in his or her absence; and WHEREAS, the existing policy needs to be amended to reflect changes in City personnel NOW THEREFORE BE IT RESOLVED, that the City Council of the City of Hopkins hereby amends the attached Legislative Policy #2 -G designating the individuals serving in the following positions to act as City Manager during the absence or disability of the City Manager: Adopted by the City Council of the City of Hopkins this 1st day of July, 1997. Redepenning, Mayor POLICY 2 -G POLICY DESIGNATING DUTIES OF CITY MANAGER DURING ABSENCE OR DISABILITY 1. PURPOSE 1.01 The purpose of this policy is to establish guideline for the delegation of authority during either the absence or disability of the City Manager. 2. DELEGATION OF AUTHORITY 2.01 Section 6.01, Chapter 6 Hopkins City Charter states that during the absence or disability of the City Manager the duties of the office shall be performed by some properly qualified person designated by the Council. 2.02 The following persons are hereby designated, under Chapter 6, Section 6.01 of the Hopkins Charter to perform the duties of the City manager during the absence or disability of the City Manager. The topmost person upon the list, not absent or disabled, shall be responsible for such duties. 1. Assistant City Manager 2. Finance Director 3. Public Works Director 2.03 All actions taken on behalf of the manager shall be promptly reported to the manager on return, or to the City Council at the next meeting, whichever shall occur first.
