Council Report 97428 Proposed Action. Staff recommends the following motion: Move to approve Resolution 97 -70, approving Ordinance 97 -802, making amendments to the sign ordinance for first reading. At the Zoning and Planning meeting, Mr. Blair moved and Mr. Gross seconded a motion to approve Resolution RZ97 -13, recommending approval of amendments to the sign ordinance. The motion was approved unanimously. Overview. At various times the staff assembles sections of the zoning ordinance that need to be updated. These amendments are to correct inconsistencies or problems the staff has identified or just to update the ordinance. The proposed amendments are basically housekeeping -type amendments. The proposed amendments all relate to the sign ordinance. Primary Issues to Consider. o What are the proposed amendments? District/Use Permitted Type of Sign 4a B -2 and B - This will allow perpendicular signs in the B -3 zoning district. Perpendicular signs are allowed in the B -2 zoning district. 570.46 e) location: no free standing signs shall be located less than 2 five from any street right -of -way line. This amendment will allow a five -foot setback for signs requiring a conditional use permit. 570.23 Front Yard 5' Side Yard 5' Rear Yard 5' CR97 -128 Page 2 Name plates or symbols in the shape or form that denotes the nature of the business being conducted within, at right angles to the building wall, are permitted at intervals of not less than 15 feet. Residential Currently residential signs are required to have the same setback as the setback for the building. In some cases this has been a problem, because the sign is even with or behind the building. What was the discussion at the Zoning and Planning meeting? Ms. Anderson reviewed the amendments to the sign ordinance. Ms. Anderson noted that perpendicular signs would now be allowed in the B -3 zoning district. The Commission had reviewed the proposed amendments at the May meeting. Alternatives. CR97 -128 Page 3 1 Approve the amendments to the sign ordinance. By approving the amendments to the sign ordinance, the sign ordinance will be amended. 2. Deny the amendments to the sign ordinance. By recommending denial of the amendments to the sign ordinance, the sign ordinance will remain the same. If the City Council considers this alternative, findings will have to be identified that support this alternative. 3. Continue for further information. If the City Council indicates that further information is needed, the item should be continued. ATTEST: CITY OF HOPI`:INS Hennepin County, Minnesota RESOLUTION NO: 97 -70 RESOLUTION MAKING FINDINGS OF FACT AND APPROVING VARIOUS ZONING AMENDMENTS WHEREAS, an application for an amendment to the Zoning Ordinance, ZN97 -3, has been made by the City of Hopkins; and WHEREAS, the procedural history of the application is as follows: 1. That an application for Ordinance Amendment ZN97 -3 was made by the City of Hopkins on May 23, 1997; 2. That the Hopkins Planning Commission, pursuant to published notice, held a public hearing on the application and reviewed such application on June 24, 1997: all persons present were given an opportunity to be heard; 3. That the written comments and analysis of the City staff were considered. NOW, THEREFORE, BE IT RESOLVED that the zoning amendment, application ZN97 -3, is hereby approved, based on the following Findings of Fact: 1. Front Yard Side Yard Rear Yard Residential 5' 5' 5' CITY OF HOPKINS Hennepin County, Minnesota ORDINANCE NO. 97 -802 AN ORDINANCE AMENDING THE ZONING ORDINANCE THE COUNCIL OF THE CITY OF HOPKINS DOES HEREBY ORDAIN AS FOLLOWS: That the Hopkins City Code No. 515 -570 be, and the same is hereby amended by, amending the following sections: Ilium - District/Use Permitted Type of Sign Qty inated 4a B -2 and B -3 Name plate or symbol in No the shape or form that denotes the nature of the business being conducted within, at right angles to the building wall are permitted at intervals of not less than 15 feet. Maximum Area of Single Sign The area of such signs shall not ex- ceed three square feet and shall ex- tend no more than 24" from the wall or side of the building to which said sign is attached and shall be mounted no lower than ten feet from the sidewalk. 570.46 e) location: no free standing signs shall be located less than 23 five from any street right -of -way line. 570.23 Total Area of All Signs 2 square feet per front foot of build- ing abutting a public right -of -way 50 feet or more in width.
