SIGN VARIANCE - 530 - 11 TH AVENUE SOUTH
Proposed Action
Staff recommends the following motion: Move to adopt Resolution 05-115, approving a
sign setback variance to construct a monument sign at 530 - 11 th Avenue South.
At the Zoning and Planning meeting, Ms. Hatcher moved and Ms. Halverson seconded a
motion to adopt Resolution RZ05-37, recommending approval of a five-foot sign
setback variance to construct a monument sign at 530 - 11 t Avenue South. The motion
was approved unanimously.
Overview
King Technology is proposing to construct a monument sign at their building at 530 -
11 th Avenue South. The zoning ordinance requires a 10- foot setback for signs. The
applicant is proposing a three-foot setback. The applicant is proposing to place the sign
on the green space along 11 th Avenue. Public Works has reviewed the applicant's
request and wants a setback of at least five-feet. After the Public Works
recommendation, the applicant has submitted a slightly smaller sign to accommodate the
additional two foot setback.
The proposed sign is a monument sign. The total dimensions of the smaller monument
are 11 feet long by seven feet high. The actual sign will be seven feet by four feet. The
brick on the sides of the sign will match the building. The total size of the sign will be
28 square feet.

Primary Issues to Consider.
· What does the ordinance require?
The ordinance requires a 10-foot setback in the I-I zoning district.
. What are the specifics of the applicant's request?
The applicant is requesting a monument sign with a three-foot setback.
. What is the staff's recommendation?
The Zoning Ordinance states the following: a variance is a modification or variation
from the provisions of this code granted by the board and applied to a specific parcel of
property because of undue hardship due to circumstances peculiar and unique to such
parcel. The Zoning Ordinance also states the following: that the Commission must find
that the literal enforcement of the provision of the Zoning Ordinance would cause an
undue hardship because of circumstances unique to the individual property under
consideration and that the granting of a variance to the extent necessary to compensate
for said hardship is in keeping with the intent of this code.
In this case the applicant does have a hardship. The private property is only a 20-foot
strip along 11 th Avenue and with the 10- foot setback there is only a 10- foot area to place
the sign. The applicant will reduce the sign to accommodate the additional two feet
requested by the Public Works. By reducing the sign any additional amount, the brick
base would be removed.
. What was the discussion at the Zoning and Planning meeting?
Ms. Anderson reviewed the proposed sign and stated that Public Works has
recommended an additional two-foot setback for safety. The Commission discussed the
additional two-foot setback. Jeff Johnson, representing King Technology, Inc., appeared
before the Commission. Mr. Johnson brought a new sign plan that would be constructed
with the five-foot setback. Mr. Johnson asked the Commission to consider the three-foot
setback. The Commission supported the five-foot setback because of safety concerns.
No one appeared at the meeting regarding this item.
Alternatives.
1. Approve the variance. By approving of the variance, the applicant will be able to
construct the proposed sign with a five-foot setback.
2. Deny the variance. By denying the variance, the applicant will have to construct the
sign with a 10-foot setback. If the City Council considers this alternative, findings of
fact will have to be stated that support this recommendation.
3. Continue for further information. If the City Council indicates that further
information is needed, the item should be continued.

RESOLUTION NO: 05-115
RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A VARIANCE FOR A
FRONT YARD SETBACK TO CONSTRUCT A SIGN
WHEREAS, an application for Variance VN05-1 0 has been made by King Technology; and
WHEREAS, the procedural history of the application is as follows:
1. That an application for Variance VN05-1O was made by King Technology on
October 27,2005;
2, That the Hopkins Zoning and Planning Commission, pursuant to mailed notice, held
a meeting on the application and reviewed such application on November 29, 2005:
all persons present were given an opportunity to be heard;
3. That the written comments and analysis of the City staff were considered; and
4, Legal description of the parcel is as follows:
Lots 1,2,3,4,5,6, 7,8,9, and 10, Block 54, West Minneapolis
All the vacated alley dedicated to the public in Block 54 of the plat of West Minneapolis and
that part of vacated 12th Avenue and vacated Railroad Boulevard (dedicated as Railway
Boulevard in said plat) lying between the west and northerly line of said Block 54 and the
following described line:
Commencing at the southwest corner of said Block 54 thence west along the westerly
extension of the south line of said block to the center line of vacated 1 ih Avenue, thence
north along said centerline to the northerly line of Railroad Boulevard, thence northeasterly
along the northerly line of Railroad Boulevard to its intersection with the northerly extension
of the east line of said Block 54, thence south along said extension to the northeast corner of
said block, and said line there terminating.
NOW, THEREFORE, BE IT RESOLVED that application for Variance VN05-10 to reduce
the front yard setback from 10 feet to five is hereby approved based on the following Findings of
Fact:
1. That placing the proposed sign at the 5-foot setback will allow a monument sign on
the area abutting 11 th Avenue,
