CR 05-159 Concept Review Retail in Industrial Districts CITY OF ~ November 30, 2005 HOPKINS Council Report 05-159 CONCEPT REVIEW - RETAIL IN INDUSTRIAL DISTRICTS Proposed Action. This is a concept review that requires no action. Any comments regarding the development would be helpful to the applicant for further applications. Overview. The applicant would like to apply for a zoning amendment to allow a single use to occupy up to 25 percent of an industrial building. Putting a single use retailer in an industrial district does create some problems. If this is a direction that the Commission would consider pursuing, staff would recommend that the retail use be granted through a conditional use permit. Currently the zoning ordinance allows an industrial building to have 10 percent of their use for retail sales and up to 25 percent with a conditional use permit. If there is an ordinance amendment the applicant would like to put the retail use in the Johnson building located at 810 First Street South. Primary Issues to Consider. . The following are permitted accessory uses in Industrial districts: Retail or service uses with the following provisions: 1. retail or services uses not exceeding 10 percent of the gross floor area of the principal structure. 2. the retail or service activity is located within a structure whose principal use is not retail sales. 3. the retail or service activity is accessory to the principal industrial use. p) retail or service uses exceeding 10 percent but not more than 25 percent. . What is the staff recommending? The staff would recommend that if there is one use permitted in 25 percent of an industrial zoned building that it be with a conditional use permit including and the following conditions: CONDITIONAL USE FOR RETAIL IN INDUSTRIAL ZONING DISTRICT 1. That the industrial zoning property abuts a B-2 or B-3 zoning district 2. That 25 percent of the building can be used for a retail use that is permitted in the B-2 or B-3 zoning district 3. That a parking and traffic study is conducted 4. That there is no drive-through 5. That no other retail use is allowed in the building . What was the discussion at the Zoning and Planning meeting? Ms. Anderson reviewed the proposed ordinance amendment. Ms. Anderson reminded the Commission this was a concept and there would be no action taken tonight. The Commission discussed parking, traffic, and use of retail in the industrial zone. Christopher Dahl, the applicant, appeared before the Commission. Mr. Dahl stated that there are a lot of industrial vacancies and there has been interest in a retail use at 810 First Street South. The Commission discussed how many industrial buildings the proposed conditions would affect. Ms. Anderson stated that if a condition was that the property abuts a B-2 district, this would be the only building that would apply.
