GARAGE RELOCATION AGREEMENT
135 19TH AVENUE SOUTH

Proposed Action.
Staff recommends adoption of the following motion: "Move to approve
the attached unsigned proposed agreement for garage relocation at 135
- 19th Avenue South: the Jim & Lavonne Stanley property as the City's
final offer of cooperation."
Overview.
City staff has been working with property owners Jim and Lavonne
Stanley at 135 - 19th Avenue South on a proposed relocation of their
existing garage. The current garage and driveway exit out onto County
Road 3. With the proposed reconstruction of County Road 3 in 1998
city staff has negotiated out a plan to move the existing garage in
order for the garage to exit on to the new Cul -de -Sac that will be
constructed a the end of 19th Avenue South. The proposed letter of
agreement spells out the extent of the work that will be provided with
city staff coordinating the project. Staff feels the proposed
agreement to be fair and reasonable. The cost is to be shared by the
City and Hennepin County.

Primary Issues to Consider
o Detailed Background
Due to the proposed reconstruction of County Road 3 in 1998 or 1999
which includes installation of cul -de -sacs at the ends of 18th and
19th Avenues South efforts were made by city staff to limit private
property access onto County Road 3 and shift it on to the new cul -de-
sac.
The Jim and Lavonne Stanley property at 135 19th Avenue south is one
of the properties that will be affected by the County Road 3
reconstruction. Reconstruction of County Road 3 will shorten the
present driveway to this property and the construction of a sidewalk
across the driveway will limit his ability to park a car in front of
the existing garage. Staff considered several alternatives:
o Tearing down the existing garage and building a new garage facing
west.
Extending the existing garage to the south 16 feet and relocating
the garage doors to the west.
Turning the existing garage to face west.
All of these alternatives would include a new asphalt driveway
accessing 19th Avenue South. After looking at each alternative the
plan to turn the garage was the most cost effective. The other
alternatives came in almost twice the cost of moving the existing
garage and turn to the west.
After many meetings and phone calls to Mr. Stanley, the attached
agreement was drawn up. After several revisions to the agreement at
Mr. Stanley's request, we came up with this final draft. At this time
Mr. Stanley has not signed the agreement. His reasons are outlined
below. It is in staffs opinion to be a fair and reasonable agreement.
Property Owner Concerns
At this time Mr. Stanley's concern is that if the garage is moved and
the stucco is damaged the agreement has set a $2,000 limit on its
repair. Mr. Stanley also has concerns on our ability to move the
garage without damage. City staff received an estimate from Lunak
House Movers of Chaska. Mr. Lunak said that the garage could be moved
with no damage to the stucco as long as the stucco was installed
properly when it was built. As for moving the garage without damage
he stated it would be no problem. Other concerns are concerns that
anyone would have when there property is being worked on by a
contractor. Mr. Stanley was assured that City staff will oversee the
project until it is finished to his satisfaction.

o City - County Cost
The costs for the relocation of the garage at 135 19th Avenue South
will be split between the city and Hennepin County. All indications
at this time point to a 50/50 cost sharing. Please note, however,
that the county may appeal some of the costs with this proposed
project
o Alternatives
The alternatives to the moving of Mr. Stanley's garage are ones
outlined earlier:
1) Tearing down the existing garage and build a new garage facing
west. Estimated Cost $15,500
2) Extend the existing garage 16 feet to the south, move garage
doors to the west wall. Estimated Cost $18,000
3) Turning the existing garage to face west. Maximum Cost $9,000
4) Leave existing driveway where it is. The city only became
involved in an effort to help a resident that is being affected
by the County Road 3 project. If Mr. Stanley wishes the city
could withdraw all offers and then Mr. Stanley would need to
settle with the County for any assumed damages.

LETTER OF AGREEMENT
This Letter of Agreement between the above mentioned parties is for clarifying areas of
responsibility for the relocation of a garage at 135 - 19th Avenue South, Hopkins, MN.
The City of Hopkins will act as a general contractor and construction manager to assure
the project is completed within the scope of the guidelines listed below.
The project is the relocation of an approximate 20' x 24' wood frame garage located at
135 - 19th Avenue South, Hopkins, MN. The purpose of the relocation is to move the
existing driveway from its present exit onto Excelsior Blvd. to a new cul -de -sac that is
being constructed at the end of 19th Avenue South. The time frame for this project will
be in conjunction with the proposed reconstruction of Excelsior Blvd. by Hennepin
County. This agreement will be void if the County does not proceed with the proposed
reconstruction. At the present time this garage relocation will occur during the 1998
construction season.
The City agrees to coordinate the relocation of the existing garage approximately 10' to
15' south of its existing location and turn it 90° to the west. The new location will be
established by the owner and shall meet existing setback requirements.
The City will cover all costs spelled out in this agreement with the relocation of the
garage, and will provide a $2,000.00 maximum contingency amount to repair any spot
damage to the exterior stucco surface of the garage if needed. All other warranties will be
covered by the subcontractor that the City will provide for the concrete, electrical, and
moving of the garage.
The specifications that will be provided to the subcontractors will cover the following:
a) Removal of existing concrete slab under footprint of new location for relocated
garage. Installation of a new 4" concrete slab with 3' apron on west end. Elevation as
per owner.
b) Raise garage and turn 90° and set and secure to new slab. Square and plumb.
c) Remove and reinstall electrical service.
d) Remove and reinstall existing carport to north side of relocated garage.
e) Provide temporary storage on site for personal property from garage during
construction.
f) Provide new asphalt driveway to 19th- Avenue South. Driveway to be tapered from
18' width at garage apron to 15' width at street.
In no case will the City of Hopkins obligation for moving the garage exceed $9,000.00.
This amount covers a contractors guaranteed price for items a) - e) above and the
$2,000.00 contingency amount mentioned above.

The City and County also agree to monies for general compensation for the following:
