Jart4 Gessele Engineering Superintendent 0 Public Hearing Adoption of Assessment Roll 1997 Alley Reconstruction Project 97 -02 Proposed Action. Staff recommends adoption of the following motion: Move that Council adopt Resolution 97 -99, Resolution for Adoption of Assessment Roll, Project 97 -02, Alley Reconstruction. Overview. Council at its September 2 meeting considered the proposed final assessment roll for the 1997 alley reconstruction project in the #10 blocks between 17th/21st Avenues North and ordered a public hearing for October 7. The hearing is conducted before any special assessments are levied against the properties listed in the attached exhibits. Notices of the hearing have been published, and both notices and assessment statements have been mailed to all affected property owners. Primary Issues to Consider. • Public hearing process • Appeal process • Project costs and assessment rates worksheet • Specific appeals Council Report 97 -179 Analysis. Public hearing process Council should be aware that it needs to consider the four distinct neighborhood alleys that make up the 1997 project in separate hearing procedures. The hearing process should be opened in each case, appeals heard, process closed, and appeals acted on. Finally the Council should act on Resolution 97 -99 for adoption of the assessment roll. • Appeal process Property owners are given the opportunity to approach Council with their appeals during the public hearing. Standard appeal forms have been available at City Hall and need to be submitted no later than the hearing date. Staff will make recommendations on all appeals and Council will act on each individually. • Project costs and assessment worksheet As discussed originally in the feasibility study for this project, staff determined that the most equitable method to assess this project would be on a lineal footage basis with a maximum of 75 feet for an oversized single family residential property, residential property deemed to be in the blocks north of the project alleys. Commercial property (e.g. rental properties and other Mainstreet properties would be assessed at actual footage. The feasibility further proposed, that to provide equitable treatment to those properties north of the project alleys who were previously assessed for 1970's alley improvements, that these properties receive a credit. The report recommended a credit equal to the footage rate paid in the assessments levied in the early 1970's. Council concurred and ordered the project using this assessment scheme. The attached project costs worksheet reflects that policy. It has been suggested that it is unfair to allow a credit for a past alley assessment, thus asking the Mainstreet properties to subsidize an undue amount. Staff feels the method chosen is the best it could arrive at given that the current Legislative Policy guideline on "T" alley assessments calls for an even grimmer Mainstreet subsidy. Staff chose to avoid the policy guideline with the thinking that it applies to funding for entire alley reconstruction in the block. Only east /west segments needed reconstruction in this project. • Specific appeals To date, one appeal has been received: Address: 35 20th Avenue North Assessed Amount: $528.00 Appeal for cancellation of assessment by reason of lack of adequate notification, no perceived benefit to the property, and that the project was over - priced. Recommendation: Deny appeal for cancellation on basis that staff strictly adhered to all MS Statute 429 requirements for hearing notification and that indeed project costs were discussed before a project was ordered. Also, deny appeal on basis that improved access to property enhances fire and police protection, thus a benefit to the property. Lastly, the appeal should be denied on the basis that the project cost was substantially under what had been estimated. The assessment rate in this case dropped from $10.62 /front foot to $8.80 /front foot. This hearing is scheduled pursuant to Minnesota Statutes Chapter 429. The assessment roll as herein described is on file in the office of the City Clerk. No appeal may be taken as to the amount of any assessment adopted unless a written objection signed by the property owner is filed with the Assessment Clerk prior to the assessment hearing or presented to the presiding officer at the hearing. Even though appeals are due by the hearing date on October 7, 1997; the City Clerk strongly recommends that appeals be submitted to the Assessment Clerk's office by October 1, 1997. Appeal forms will be available at the assessment hearing or at the Assessment Clerk's office at the Hopkins City Hall, 1010 1st Street South, Hopkins, Minnesota. An owner may appeal an assessment to district court pursuant to MSA Section 429.081 by serving notice of the appeal upon the Mayor or City Clerk of the City of Hopkins within thirty (30) days after the adoption of the assessment and by filing such notice with the district court within ten (10) days after service upon the Mayor and City Clerk. Under provisions of Minnesota Statutes Section 435.193 to 435.195 the City may, at its discretion, defer the payment of assessments for any homestead property owned by a person 65 years of age or payments. available should be older for whom it would be a hardship to make the The procedures to apply for such deferment are from the Assessment Clerk. Deferment applications submitted to the Assessment Clerk by October 1, 1997 The following information shall also apply: 1. The property owner shall have the right to prepay the entire assessment. Your assessment may be paid without interest from October 7, 1997 to November 6, 1997, to the Assessment Clerk at City Hall, 1010 1st Street South, Hopkins, Minnesota. You may at any time thereafter and by November 30, 1997 pay to the Assessment Clerk the entire amount of the assessment remaining unpaid, with interest accrued from October 7, 1997 to the date in which such payment is made. Such payment must be made by November 30, 1997 or interest will be charged through December 31 of the succeeding year. 2. Partial prepayment of the assessment in excess of 25 percent of the total assessment has been authorized by ordinance. A partial prepayment can only be made prior to November 30, 1997 with interest accrued to the payment date, except that no interest shall be charged if such partial payment is made by November 6, 1997. 3. In the case where accrued interest applies, the rate of interest to be accrued, if the assessment is not prepaid within the required time period, is proposed to be 8 percent commencing on the date of adoption by the City Council. Assessments shall be payable in annual installments over a period of 10 years. 4. The amount to be specially assessed against your property is shown on the statement of assessment sent to you by mail. This is an important hearing because this is your last opportunity to be heard on the matter of this assessment which affects your property. Such proposed assessments, as may be amended and a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessments against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. The areas and amounts to assess are as follows: TOTAL AMOUNT TO AREA TO BE ASSESSED BE ASSESSED Alley A - Properties in #10 Block $14,970.58 between 17th/18th Ave. N Alley B - Properties in #10 Block $18,826.66 between 18th/19th Ave. N Alley C - Properties in #10 Block $16,296.91 between 19th/20th Ave. N Alley D - Properties in #10 Block $13,583.41 between 20th/21 st Ave. N 2. Such assessments shall be payable in equal annual installments extending over a period of ten years, the first of the installments to be payable on or after the first Monday in January, 1998, and shall bear interest at the rate of 8 percent per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from October 7, 1997 until December 31, 1998. To each subsequent installment when due shall be added interest from one year on all unpaid installments. 3. It is hereby declared to be the intention of the Council to reimburse itself in the future for the portion of the cost of this improvement paid for from municipal funds by levying additional assessments, on notice and hearing as provided for the assessments herein made, upon any properties abutting on the improvement but not made, upon any properties abutting the improvement but not herein assessed for the improvement, when changed conditions relating to such properties make such assessment feasible. 4. To the extent that this improvement benefits nonabutting properties which may be served by the improvement when one or more later extensions or improvements are made, but which are not herein assessed, therefore, it is hereby declared to be the intention of the Council, as authorized by Minnesota Statutes Section 420.051, to reimburse the city by adding any portion of the cost so paid to the assessments levied for any of such later extension or improvements. 5. The clerk shall forthwith transmit a certified duplicate of the assessment to the County Auditor to be extended on the property tax lists of the County, and such assessments shall be collected and paid over in the same manner as other municipal taxes.
