CR 97-182 Approve Bid Public Ramp LightingOctober 1, 1997 Proposed Action Overview Primary Issues To Consider Supporting Documents im Hartshorn Economic Development Coordinator APPROVE BID FOR PUBLIC PARKING RAMP LIGHTING IMPROVEMENTS Council Report: 97 -182 Staff recommends approval of the following motion: Move to approve of bid from Manor Electric, Inc. for the public parking ramp lighting improvements. As part of the contingency parking plan, staff sought bids for exterior sign modifications, lighting improvements and concrete repair work. In accordance with city charter section 6.06, Council approval is required for any project that costs over five thousand dollars. Manor Electric, Inc. submitted the lowest bid for lighting improvements which was six thousand, two houndred dollars, therefore, council must approve of Manor Electric's bid before entering into a contract. Norquist Sign Company submitted the only bid for the exterior sign modifications. The bid was for three thousand, five hundred and fifty dollars, however, the bid did not include electrical work. Manor Eectric has sent a proposal to do the electrical work for five hundred and fifty. There were no bids for the concrete repairs. P. S. Vedi, of Vedi Associates and Vern Pankratz, of the Department of Public Works have sent information to contractors who may be interested in providing bids for the concrete work. Staff is hopeful the work can be completed by November 8, 1997, as this is the Center for the Arts grand opening date. Staff is now requesting the Council's approval to accept Manor Electric's bid of six thousand, two hundred dollars for lighting improvements for the ramp. What are the conditions recommended by staff? Has legal counsel reviewed this matter? As outlined in the enclosed Requirements and Summary Of Work's form, there is specific information that needs to be submitted prior to construction including the following: * Standard Certificate of Insurance for Workers Compensation Insurance * Commercial General Liability Insurance * Commercial Automobile Liability Insurance with the City of Hopkins listed as a certificate holder Both Manor Electric and Nordquist would be required to sign the enclosed contract which requires a time of completion, statement of work, contract price and payment schedule. Has legal counsel reviewed this matter? The City Attorney has reviewed this matter and drafted the enclosed contract. Alternatives The Council has the following alternatives regarding this issue: 1. Approve the action as recommended by staff. 2. Deny the approval of Manor Electric's bid for lighting improvements and start a new bidding process. Under this alternative, it is unlikely the project could be completed in time for the Center for the Arts grand opening on November 8, 1997. 3. Continue for additional information. Again, this alternative will delay the lighting improvements project desired completion period. Remove 21 existing 100 watt ceiling (pendant) mounted light fixtures and replace with 150 watt pendant mounted light fixtures ( "Lightwatt LWP- 150S8 -A as manufactured by Hubbell Lighting, Inc. ") Field verify existing wiring and circuit breakers and provide new wiring and circuit breakers if required. Refer to the attached reduced existing drawing E 1 for fixture locations. ADDENDUM A The following provisions are incorporated in and made a part of the attached Agreement ( "Agreement ") between The City of Hopkins, Minnesota ( "Owner ") and ( "Contractor "). 1. The "Contract Documents" referred to and incorporated in this Agreement include any and all of the following documents which may have been prepared in regard to the work covered by this Agreement: the Contract Documents identified in Article 5 of the Agreement, all plans, drawings and specifications prepared by Vedi Associates, Inc. (the "Architect ") or any engineer employed by the Architect or Owner, the proposal submitted by the Contractor for the work covered by this Agreement (provided that the terms and provisions of this Agreement shall control over the provisions of such proposal to the extent of any inconsistencies) and all other plans, drawings, specifications, general and special conditions, and any addenda or amendments thereto relating to or describing the work covered by this Agreement. Contractor acknowledges Owner has made copies of the Contract Documents available to Contractor and that Contractor is responsible for reviewing those documents pertinent to its work. 2. As a condition of payment, Contractor shall submit written request(s) for payment to Owner and Contractor shall be entitled to payment only for completed work, labor and material that has actually been incorporated in the Project and which conforms to the requirements of this Agreement. Requests for payment shall be accompanied by partial or fmal payment bond or mechanic's lien waivers, as applicable, and such other evidence of payment as Owner shall reasonably request documenting Contractor's payment for all labor, material, skill and equipment included in the work covered by Contractor's written requests for payment. Owner will notify Contractor of any objections to a written request for payment within thirty (30) days of delivery of the written request for payment and Owner shall be entitled to withhold from payments due hereunder all amounts claimed by Contractor for incomplete, defective or nonconforming work pending correction thereof by Contractor. 3. Prior to commencement of the work covered by this Agreement, Contractor shall deliver to Owner a Certificate of Insurance evidencing Contractor is maintaining the following insurance coverages and limits: Workers compensation insurance in such limits as are required by Minnesota law. Employers liability insurance with limits of $2,000,000.00 per occurrence. Comprehensive commercial general liability insurance with limits of $2,000,000.00 per occurrence. Such additional insurance as shall be required by the Contract Documents or the Owner as reasonably necessary to insure the activities of the Contractor under this Subcontract. All policies of insurance shall name Owner as an additional insured and shall be maintained at all times during the performance of Contractor's work under this Subcontract. Failure to provide a Certificate of Insurance or to maintain the required insurance coverages shall constitute a breach of this Subcontract. 4. Contractor shall pay for all materials, skills, labor and equipment used in or in connection with the performance of this Agreement, when and as bills or claims therefore become due, and to save and protect the Project and the Owner from all claims, payment bond claims or mechanics' liens on account thereof, and to furnish satisfactory evidence to the Owner when and if required, that he has complied with the above requirements. 5. Contractor shall proceed with the work in any orderly and reasonable sequence directed by the Owner and abide by the Owner's decision as to the allotment of all storage and working space on the Project. 6. That no extension of time of performance of this Agreement shall be recognized by the Owner without the o t 741YA 1%t /+ 1 0 Contractor shall give notice to the Owner of all claims for extras, for extensions of time and for damage for delays or otherwise, promptly and in accordance with the Contract Documents. 14. Contractor shall guarantee its work against all defects in material or workmanship for a period of one year from the date of acceptance of the work by the Owner, or such longer period is provided elsewhere in the Contract Documents, Contractor shall obtain and assign to Owner all manufacturers' wararnties for materials provided by Contractor. 15. That in case the Contractor shall fail to correct, replace and/or re- execute faulty or defective work done and /or materials furnished under this Agreement, when and if required by the Owner, or shall fail to complete or diligently proceed with this Agreement within the time herein provided for, the Owner upon three days' notice in writing to the Contractor shall have the right to correct, replace and/or re- execute such faulty or defective work, or to take over this Agreement and complete same either through its own employees or through a Owner or Contractor of its choice, and to charge the cost thereof to the Contractor, together with any liquidated damages caused by a delay in the performance of this Agreement. 16. That in case of default on the part of the Contractor under the terms of this Agreement, the material and equipment of the Contractor shall be left on the job for the use of the Owner in completing the work covered by this Agreement. 17. Contractor shall comply with all Federal and State laws, codes, and regulations and all municipal ordinances and regulations effective where the work under this Agreement is to be performed, shall pay all costs and expenses connected with such compliance, shall pay all fees and taxes, including sales and use taxes, and also pay all taxes imposed by any State or Federal law for any employment insurance, pensions, old age retirement funds or any similar purpose and furnish all necessary reports and information to the appropriate federal, state and municipal agencies, with respect to all of the foregoing, and shall hold the Owner harmless from any and all losses or damage occasioned by the failure of the Contractor to comply with the terms of this paragraph. 18. Contractor shall pay all royalties and license fees; defend all suits or claims for infringement of any patent rights involved in the work of the Contractor under this Subcontract; and save the Owner and other Contractors harmless from loss, cost or expense on account of such use or infringement by the Contractor. 19. If any part of the Contractor's work depends for proper execution or results upon the work of any other contractor on the project, the Contractor shall inspect and promptly report to the Owner any apparent discrepancies or defects in such work that renders it unsuitable for such proper execution and results. Failure of the Contractor so to inspect and report shall constitute an acceptance of the work of the Owner, other Contractors or other separate contractors as fit and proper to receive his work. 20. If notification of any claims have been made against the Contractor or the Owner arising out of labor or materials furnished the Project or otherwise on account of any actions or failures to act by the Contractor in the performance of this Agreement, the Owner may, at his discretion, withhold from such amounts otherwise due or to become due hereunder a sum adequate to cover said claims and any costs or expenses arising or to arise in connection therewith pending legal settlement thereof.
