CR 97-192 2nd Reading Ammendments To Police Civil Service CommissionOctober 17, 1997 SECOND READING OF AMENDMENTS TO POLICE CIVIL SERVICE COMMISSION ORDINANCE Proposed Action Staff recommends that the Council approve the following motion: Move that the Hopkins City Council approve ordinance 97 -807 for second reading and order published. Adoption of this motion will continue the process of amending Hopkins City Code, Sections 320.01 through 320.43, by bringing the language of the Hopkins Code into conformance with state statutes. Overview During discussions of the Police Civil Service Commission, it was learned that the current Hopkins City Code prohibited public employees from serving on the Police Civil Service Commission. The City Council, after discussion, ordered the City Attorney's office to prepare an ordinance for consideration, which would remove the restriction; thereby bringing the Hopkins ordinance into conformance with state law. Primary Issues to Consider What would be the affect of amending these sections of the City Code? By amending the Code to come into conformance with state law, public employees would become eligible for appointment to the Hopkins Police Civil Service Commission. Mielke City Manager Council Report 97 -192 HENNEPIN COUNTY, MINNESOTA ORDINANCE NO. 97 -807 AN ORDINANCE AMENDING THE POLICE CIVIL SERVICE COMMISSION ORDINANCE WHEREAS, Hopkins City Code Section 320 et seq. creates and establishes a Hopkins Police Civil Service Commission; and WHEREAS, Hopkins City Code Section 320.01 adopts by reference Minnesota Statutes Sections 419.01 through 419.18; and WHEREAS, Minnesota Statutes Sections 419.01 through 419.18 have been amended since originally adopted; and WHEREAS, the corresponding sections of Hopkins City Code Section 320 et seq., have not been amended to reflect the changes to the Minnesota statute; and WHEREAS, it is the intent of the Hopkins City Council that Hopkins City Code Section 320 be consistent with Minnesota Statute Section 419.01 et seq. NOW THEREFORE, based on these findings, the City Council of the City of Hopkins, Minnesota does hereby ordain: Section 1: That the Hopkins City Code No. 320.01 through 320.43 be, and the same is hereby amended by amending the following sections: Subd. 1: 320.01. Establishment. There is created and continued, a Police Civil Service Commission, with the powers and duties provided in Minnesota Statutes, Sections 419.01 4e- through 419.181, as such sections read on August, 1997, and as such sections may be amended. Section 2: All provisions of Hopkins City Code, Section 320.03 through 320.43 are deleted in their entirety. Section 3: The effective date of this ordinance shall be twenty days after publication.
