Proposed Action.
Staff recommends adoption of the following motion: Move that Council adopt Resolution 98-49.,
Resolution Accepting Work and Ordering Final Payment - Projects 96 -13 (1st Street North
Reconstruction), 96 -17 (2nd Street North Storm Sewer), and 96 -18 (1997 Mill and Overlay
Project).
Overview.
The contractor has completed work associated with reconstruction of 1st Street North,
installation of storm sewer on 2nd Street North, and mill and overlay operations on various
streets in 1997. The contractor has performed on punch list items to the City's satisfaction.
Primary Issues to Consider.
• Accepting work and final payment
The contractor has met his contract work obligations. The work is done satisfactorily.
Upon final payment the contractor furnishes a 1 -year warranty on project work.
• Final documentation
The contractor has submitted the necessary lien waiver and IC -134 withholding forms.
He is in the process of furnishing a signed Certificate of Final Completion.
• Resolution 98 -49
Adoption of this resolution formally acknowledges completion of work, orders final
payment and initiates a specified warranty period on the contract work.

WHEREAS, pursuant to written contracts signed with the City on May 9, 1997, Midwest
Asphalt Corporation has satisfactorily completed the improvements of street reconstruction,
storm sewer installation, and mill and overlay work, commonly known as City Projects 96 -13,
96 -17, and 96 -18, in accordance with such contracts.
NOW, THEREFORE, be it resolved by the City Council of the City of Hopkins,
Minnesota:
Adopted by the City Council of the City of Hopkins, Minnesota, this 21st day of July, 1998.

RESOLUTION ACCEPTING WORK AND ORDERING FINAL PAYMENT —
Projects 96 -13 (1st St. North Reconstruction), 96 -17 (2nd St. North Storm Sewer), and
96 -18 (1997 Mill and Overlay Project)
1. The work completed under said contract is hereby accepted and approved.
2. Order for final payment on such contract is hereby ordered, taking the contractor's
receipt in full.
3. The specified warranty period on contract work shall commence upon the adoption of
this resolution.
