CR 98-108 Comprehenisive Plan Amendment- Hennepin County SiteJuly 1, 1998 Proposed Action. Staff recommends the following motion: Move to approve Resolution 98 -42, approving a Comprehensive Plan amendment for the Hennepin County Public Works site. At the March Zoning and Planning meeting, Mr. Schumacher moved and Ms. Boen seconded a motion to approve Resolution RZ98 -2, recommending approval of a Comprehensive Plan amendment for the Hennepin County Public Works site with the additional condition that the amendment is not submitted to the Metropolitan Council until the development agreement is signed. The motion was approved unanimously. Overview. The Hennepin County Public Works site is currently designated Business Park and Medium Density Residential in the Comprehensive Plan. The southwest part of the site is designated Medium Density Residential, and the majority of the site is designated Industrial. In order for the SuperValu project to proceed, the Comprehensive Plan needs to be amended. The proposed designation is Industrial. Because amending the Comprehensive Plan requires Metropolitan Council approval, which takes several months, the process is being initiated at this time. The site is zoned I -2, General Industrial. How has the Comprehensive Plan designated the subject site? The Comprehensive Plan has designated the site a Business Park and Medium Density Residential. With the proposed change to Industrial, the Comprehensive Plan and zoning will be the same. What was the discussion at the Zoning and Planning meeting? Ms. Anderson reviewed the reasons for the amendment to the Comprehensive Plan. Mr. Schumacher was concerned that if SuperValu did not proceed with the development, the site would be changed to industrial. The Commission added a condition that the amendment would not be submitted to the Metropolitan Council until the development agreement is signed. No one spoke at the public hearing regarding this item. Alternatives. 1. Approve the Comprehensive Plan amendment. By approving the Comprehensive Plan amendment, the Hennepin County site will be designated as Industrial in the Comprehensive Plan. 2. Deny the Comprehensive Plan amendment. By denying the Comprehensive Plan amendment, the Hennepin County site will remain as Business Park and Medium Density Residential in the Comprehensive Plan. If the City Council considers this alternative, findings will have to be identified that support this alternative. 3. Continue for further information. If the City Council indicates that further information is needed, the item should be continued. ATTEST: CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO: 98 -42 RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A COMPREHENSIVE PLAN AMENDMENT FOR THE HENNEPIN COUNTY SIZ'E WHEREAS, the City of Hopkins is initiating a Comprehensive Plan amendment ZN98 -1; WHEREAS, the procedural history of the application is as follows: 1. That the City of Hopkins is initiating a Comprehensive Plan amendment for the Hennepin County Public Works site; Terry Obermaier, City Clerk 2. That the Hopkins Zoning and Planning Commission, pursuant to mailed and published notice, held a public hearing on the application and reviewed such application on March 31, 1998: all persons present were given an opportunity to be heard; 3. That the written comments and analysis of City staff were considered; and Adopted this 7th day of July, 1998. A legal description of the subject property is as follows: Block 25 to 29 including and Blocks 43 and 47 including adjacent vacated street and alley except roads and State Highway, West Minneapolis. That part of NE 1/4 of NE 1/4 lying south of west Minneapolis and west of State Highway 169 except street. NOW, THEREFORE, BE IT RESOLVED that the application for Comprehensive Plan Amendment ZN98 -1 is hereby approved based on the following Findings of Fact: 1. That the amendment to the Comprehensive Plan will make the zoning and the land use plan consistent. BE IT FURTHER RESOLVED that application for Comprehensive Plan Amendment ZN98 -1 is hereby approved based on the following conditions: 1. That the Metropolitan Council approves the proposed amendment. 2. That the amendment is not submitted to the Metropolitan Council until the development agreement is signed. Charles D.
