CR 98-111 Preliminary/Final PlatJuly 1, 1998 Proposed Action. Staff recommends the following motion: Move to approve Resolution 98 -45, approving a preliminary /final plat. At the May 26 Zoning and Planning meeting, Mr. Gross moved and Ms. Boen seconded a motion to approve Resolution RZ98 -8, recommending approval of a preliminary /final plat. The motion carried unanimously. Overview. The applicant, Jim Benshoof, is proposing to construct a 5500 square -foot office building on the property owned by the City/BRA along Excelsior Boulevard. The building would be a single story. The applicant is proposing to purchase property from the City/HRA. This is approximately from Eighth Avenue to Ninth Avenue on the south side of Excelsior Boulevard. The applicant will be applying for a conditional use permit to construct the building at the June meeting. The reason for platting the property at this time is that the County requires a 30 -day review period for all property that is platted that abuts a county road. Primary Issues to Consider. • What is the zoning of the property, and how has the Comprehensive Plan designated the subject site? • Do the lots meet the zoning requirements? • What are the specifics of the plat? • Does the proposed plat meet the subdivision requirements? • What was the discussion at the Zoning and Planning meeting? What is the zoning of the property, and how has the Comprehensive Plan designated the subject site? The zoning of the property is B -3, General Business. The Comprehensive Plan has designated the site as commercial. Do the lots meet the zoning requirements? A lot in the B -3 zoning district is required to have a minimum lot size of 3000 square feet. The two new lots have the minimum lot size. An outlot is not required to have the minimum lot size because outlots are unbuildable. • What are the specifics of the plat? The plat will be two lots and one outlot. The water tower site will be Lot 2, the Benshoof property will be Lot 1, and the remaining City property will be an outlot. Does the proposed plat meet the subdivision requirements? The plat as proposed meets the subdivision requirements. What was the discussion at the Zoning and Planning meeting? Ms. Anderson reviewed the proposed plat with the Commission. The applicant, Jim Benshoof, appeared before the Commission. No one appeared at the meeting regarding this issue. Alternatives. 1. Approve of the preliminary /final plat. By approving of the preliminary /final plat, the applicant will be able to plat the building as proposed. 2. Deny the preliminary /final plat. By denying the preliminary /final plat, the CityIHRA property will not be platted and the proposed development will not be able to be constructed. If the City Council considers this alternative, findings will have to be identified that support this alternative. Continue for further information. If the City Council indicates that further information is needed, the item should be continued. CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO: 98 -45 RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A PRELIMINARY/FINAL PLAT WHEREAS, an application for Preliminary/Final Plat SUBD98 -1, has been made by Jim Benshoof; WHEREAS, the procedural history of the application is as follows: 1. That an application for a preliminary /final plat was made by Jim Benshoof on May 26, 1998; That the Hopkins Zoning and Planning Commission, pursuant to mailed and published notice, held a public hearing on the application and reviewed such application on May 26, 1998: all persons present were given an opportunity to be heard; That the written comments and analysis of City staff were considered; and A legal description of the subject property is as follows: That part of the abandoned Great Northern Railroad right -of -way in sections 24- 117 -22, 25 -117- 22 lying East of the following described line: Commencing at the Northwest corner of Northeast Quarter of the Northwest Quarter of Section 25, Township 117, Range 22; thence run Northwesterly at an angle of 90 degrees, 18' 22" with the North line of said Section for a distance 49.9 feet; thence deflect 90 degrees right for a distance of 668.08 feet; thence deflect right at an angle of 90 degrees, 26' 06" a distance of 239.0 feet along a line hereinafter referred to as Line "A "; thence deflect left an angle of 90 degrees for a distance of 45 feet to a point hereinafter referred to as point "A "; thence deflect right 92 degrees, 51' 45" to the South line of the above described tract being the actual point of beginning of the line being described; thence run Northerly to side Point "A "; thence continue Northerly parallel with said Line "A" for a distance of 109.02 feet; thence deflect right along a tangential curve having a radius of 90.0 feet (delta angle 90 degrees, 26' 06 ") and there terminating; and Westerly of the following described line: From the South Quarter corner of said Section 24 run easterly on the South line of said Section 24 for 330 feet; thence deflect to the left at an angle of 108 degrees 00 minutes 00 seconds for 150 feet to the point beginning of Line 1 to be described; thence run Southeasterly on the last described course for 200 feet and there terminating.
