Proposed Action
Staff recommends that the Council approve the following motion: Move that the Hopkins City Council
authorize Take One Enterprises to serve alcohol at the Hopkins Center for the Arts.
Adoption of this motion will allow the Take One Enterprises (The Big Ten Restaurant) to serve alcohol at the
Center's Anniversary Concert.

AT THE HOPKINS CENTER FOR THE ARTS

The Hopkins Center for the Arts is sponsoring an Anniversary Concert on November 7, 1998. As part of the
festivities food, wine, and beer will be served. Due to the fact that the Center is the sponsoring organization
and that food is being provided by a local business, the only option for the provision of beer and wine is to
have one of the on -sale liquor licensees serve the alcohol. In order for an on -sale liquor licensee to distribute
alcohol at a City facility the City Council must authorize the licensee to do so.
Take One Enterprises meets the criteria of having a million dollars in aggregate insurance and a rider on their
policy that will allow them to serve off their premises.

What are the options for serving liquor at the Hopkins Center for the Arts?
1. An individual who rents space may bring alcohol and serve it if the following criteria are met:
The event is by invitation only, not open to the public
• There is no monetary exchange for alcohol, no cash bar
An organization or entity could function as the host for such an occasion as long as all criteria are met.
An example would be a wedding with the host providing liquor for the guests. A fundraising event
would generally not be able to meet the criteria. Liquor Control has stated that, if the invitation is a ticket
that was purchased by the guest, an in -kind monetary exchange has taken place.
2. Sale of Alcoholic Beverages by Local Agency or Organization
The Rotary, Jaycees, or other local organization or organizations can sell alcoholic beverages if the
following criteria are met:
Organization selling the liquor must be a sponsoring organization of the event
Application to the city for a temporary liquor license is submitted at least 45 days prior to the event.
A certificate of liquor liability insurance is provided that shows the sponsoring organization(s)
name(s), names the city as co- insured, and provides $1,000,000 of aggregate coverage.
3. Sale of Alcoholic Beverages by an Individual or Agency
A cash bar may be set up without further licensing if the individual or organization hires a caterer who
holds a state caterer's liquor license. The following criteria must be met:
Caterer must provide both the food and liquor
Caterer must provide a copy of their state license
Caterer must provide a copy of their certificate of insurance
4. The governing body of the City may authorize an on -sale liquor license holder from Hopkins or a
neighboring city to provide liquor for sale at events held at the Hopkins Center for the Arts.
Have the other on -sale liquor licensees been approached about providing this type of service?
Letters have been sent to the other on -sale liquor licensees asking whether they would also like to be
authorized to serve liquor at future events at the HCA.
Alternatives
1. Authorize Take One Enterprises to provide liquor at the Hopkins Center for the Arts.
2. Do not authorize Take One Enterprises to provide liquor at the Hopkins Center for the Arts. This would
likely result in no liquor being sold at the

Minn sota Statute 340A.404, Subd. 4. Special provisions; sports, conventions, or cultural
facilities. The governing body of a municipality may authorize a holder of a retail on -sale
intoxicating liquor license municipality issued by the munici ality or by an adjacent municipality to dispense
intoxicating liquor at any convention, banquet, conference, meeting, or social affair conducted on
the premises of a sports, convention, or cultural facility owned by the municipality or
instrumentality thereof having independent policy making and appropriating authority and located
within the municipality.
