READINGS
VACATION OF UTILITY EASEMENT
HENNEPIN COUNTY PUBLIC WORKS SITE
Council Report No. 98 -147
Staff recommends the following motion: Move that Council adopt
Resolution 98 -58 making findings of fact and approving Ordinance
98 -817, which vacates a drainage easement at 320 Washington
Avenue South.
A storm sewer utility easement on the Hennepin County Public
Works site was dedicated to the City of Hopkins. That site faces
major grading and alteration of drainage patterns with the
proposed Super Valu development. The storm sewer pipe and the
easement will be rendered a mute issue. To clear title on the
property it is advantageous to vacate the easement.
O 1st and 2nd readings
The City faces time constraints and proposes to combine
first and second readings of Ordinance 98 -817 in a single
Council session. The City attorney concurs with this
action. The request comes at the behest of Super Valu.

Staff recommends adoption of Resolution 98 -58 making
findings of fact and approving the vacation request.

RESOLUTION NO. 98 -058
RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A VACATION OF A
DRAINAGE EASEMENT LOCATED AT 320 WASHINGTON AVENUE
Whereas, a certain drainage easement was created on the property owned and occupied by
the County of Hennepin, a body politic and corporate under the laws of the State of Minnesota, and
Whereas, said property is presently subject to sale and purchase, and
Whereas, said site shall be subject to substantial development including regrading which
development will alter the drainage characteristics presently existing on the property, and
Whereas, certain storm sewer facilities presently serving the site will no longer be needed
by the City and may be vacated.
NOW, THEREFORE, BE IT RESOLVED that the drainage easement at and upon the
County of Hennepin property as described in the attached Exhibit A is hereby vacated.

A permanent easement for storm sewer purposes over that part of the following
described tract:
Block 43, West Minneapolis, including that part of the adjoining vacated 5th Avenue
and alley in said Block 43, according to the duly recorded plat thereof and that part
of the Northeast 1/4 of the Northeast 1/4 of Section 25, Township 117 North, Range
22 West lying South of the South line of said Block 43 and the same extended and
North of the South 33.0 feet of said Northeast 1/4 of the Northeast 1/4,
which lies within 10.0 feet on each side of the following described centerline:
Beginning at a point on the North line of the South 33.0 feet of said Northeast 1/4 of
the Northeast 1/4 distant 348.0 feet East of the West line of said Quarter Quarter;
thence run North parallel with the West line of said Quarter Quarter for a distance of
17.0 feet to the actual point of beginning of the line being described; thence deflect
left and run Northwesterly through a point on the West line of said Block 43, a
distant 384.0 feet North of the South line of said Quarter Quarter for a distance of
480.0 feet and there terminating.

AN ORDINANCE VACATING DRAINAGE EASEMENT AT 320 WASHINGTON AVENUE.
THE COUNCIL OF THE CITY OF HOPKINS DOES HEREBY ORDAIN AS FOLLOWS:
That certain drainage easement as hereinafter described in favor of the City of Hopkins is
hereby vacated:
A permanent easement for storm sewer purposes over that part of the following
described tract:
Block 43, West Minneapolis, including that part of the adjoining vacated 5th Avenue
and alley in said Block 43, according to the duly recorded plat thereof and that part
of the Northeast 1/4 of the Northeast 1/4 of Section 25, Township 117 North, Range
22 West lying South of the South line of said Block 43 and the same extended and
North of the South 33.0 feet of said Northeast 1/4 of the Northeast 1/4,
That particular drainage easement originally granted by and recorded by Document No. 4140733 and
now to be vacated lies within the following described property:
The above - described tract which lies within 10.0 feet on each side of the following
described centerline:
Beginning at a point on the North line of the South 33.0 feet of said Northeast 1/4 of
the Northeast 1/4 distant 348.0 feet East of the West line of said Quarter Quarter;
thence run North parallel with the West line of said Quarter Quarter for a distance of
