O Resolution 98 -58 O Ordinance 98 -817 James Gessele Engineering Superintendent READINGS VACATION OF UTILITY EASEMENT HENNEPIN COUNTY PUBLIC WORKS SITE Council Report No. 98 -147 Staff recommends the following motion: Move that Council adopt Resolution 98 -58 making findings of fact and approving Ordinance 98 -817, which vacates a drainage easement at 320 Washington Avenue South. A storm sewer utility easement on the Hennepin County Public Works site was dedicated to the City of Hopkins. That site faces major grading and alteration of drainage patterns with the proposed Super Valu development. The storm sewer pipe and the easement will be rendered a mute issue. To clear title on the property it is advantageous to vacate the easement. O 1st and 2nd readings The City faces time constraints and proposes to combine first and second readings of Ordinance 98 -817 in a single Council session. The City attorney concurs with this action. The request comes at the behest of Super Valu. • Staff recommendation Staff recommends adoption of Resolution 98 -58 making findings of fact and approving the vacation request.
