Proposed Action
METROPOLITAN COUNCIL TAX BASE
REVITALIZATION ACCOUNT - -10417 ASSOCIATES LLP
Staff recommends approval of the following motion: Adopt Resolution 98 -073, authorizing
submission of application for tax base revitalization account (10417 Associates LLP Project).
Overview
To facilitate the construction of the office building by 10417 Associates LLP (Benshoof, Watson,
Schoenbauer) located at the southeast corner of Excelsior Boulevard and 11th Avenue, a private
utility tunnel needed to be removed. This tunnel contained asbestos- wrapped heating pipes. The
cost of completing this work amounted to $21,129.22. In accordance with the development
agreement, the HRA paid $17,500 of this cost. (This would be the amount of the grant
application.)
The Metropolitan Council administers the Tax Base Revitalization Account Program, which is
available to all communities that participate in the Metropolitan Livable Communities Program.
This program has funds available to clean up contaminated land to facilitate development. As
there was asbestos abatement undertaken as part of the above detailed tunnel removal, the HRA
may be able to recover all or a portion of the costs incurred in completing this work through this
program.
In order to submit an application for the subject program, it is required that the local unit of
government in which the project is located pass a resolution authorizing this submission. The
application will need to be submitted by November 4, 1998, to be processed under the present
round of funding.

Alternatives
The City Council has the following alternatives regarding this matter:
1. Approve the action as recommended by staff. This will allow submission of the
application to the Metropolitan Council.
2. Do not approve the subject action. This action will not allow the HRA to recover any of
the co that were expended concerning this matter.

RESOLUTION 98-073
RESOLUTION AUTHORIZING APPLICATION FOR THE TAX BASE REVITALIZATION
ACCOUNT (10417 ASSOCIATES LLP PROJECT, HOPKINS, MINNESOTA)
WHEREAS, the City of Hopkins is a participant in the. Livable Communities Act's Housing
Incentives Program for 1998 as determined by the Metropolitan Council, and is therefore eligible to
make application for funds under the Tax Base Revitalization Account; and
WHEREAS, the City has identified a clean-up project within the City that meets the Tax Base
Revitalization Account's purpose /s and criteria; and
WHEREAS, the City has the institutional, managerial and financial capability to ensure
adequate project administration; and
WHEREAS, the City certifies that it will comply with all applicable laws and regulations as
stated in the contract agreements; and
WHEREAS, the City Council of Hopkins, Minnesota, agrees to act as legal sponsor of the
project contained in the Tax Base Revitalization grant application.
BE IT FUR '1'IiER RESOLVED that the Housing and Redevelopment Authority In and For
the City of Hopkins is hereby authorized to apply to the Metropolitan Council for this funding on
behalf of the City of Hopkins and to execute such agreements as are necessary to implement the
project on behalf of the applicant.
