Proposed Action
Staff recommends the following motion: Move to approve Resolution 98 -66, approving a
conditional use permit to construct an addition to the existing building at 101 Jefferson.
At the Zoning and Planning meeting, Mr. Brausen moved and Mr. Gleeson seconded a
motion to approve Resolution 98 -20, recommending approval of a conditional use permit to
construct an addition to the existing building at 101 Jefferson. The motion was approved
unanimously.
Overview.
The applicant, SuperValu, is proposing to raze 27,138 square feet of the building at 101
Jefferson Avenue and construct a 35,974 square -foot freezer addition. The addition will have
an additional 18 truck dock doors that will face west.
SuperValu will also be doing interior remodeling of 43,200 square feet to the existing
building. The new addition will be located on the northwest side of the building.

Primary Issues to Consider.
What is the zoning and of the property, and how has the Comprehensive Plan
designated the subject site?
The zoning of the property is I -2, General Industrial. The Comprehensive Plan has
designated the site as industrial. The proposed addition complies with both documents.
• What are the specifics of the site plan?
Landscaping
The new addition is required to have four additional trees planted. The site plan does not
show any additional plantings. The additional plantings have been added as a condition on
the resolution.
Public Works
The following are the comments from the Public Works department:
We strongly urge SuperValu to discontinue use of empty space beneath the T.H. 169
bridge for storage purposes. In principal the City discourages the installation of one, long
depress curb section for driveway purposes. This would be necessary to accommodate
truck parking under the bridge on the west side of Washington Avenue. Also, the City is
concerned about snow storage on the west side during plowing procedures.
Fire Marshal
The Fire Marshal has reviewed the preliminary plans and found them acceptable.
Loading Docks
The new addition will have an additional 18 loading dock doors.
Trash
The trash area will remain the same. There is a compactor on the north side of the building.
Access
Access to the site will remain the same.

Exterior
The exterior of the new addition will be insulated metal panel. This is the same exterior as
the existing building.
Zoning
The only setback that is affected is the westerly setback. The required minimum setback is
20 feet. The setback is approximately 35 feet. The maximum height is 45 feet. The
proposed building is 42 feet 4 inches.
Surrounding uses
The site is surrounded by residential on the east and south, Highway 169 to the east and
County Road 3 to the north.
What was the discussion at the Zoning and Planning meeting?
Ms. Anderson reviewed the proposed addition with the Commission. No one appeared at the
public hearing regarding this issue. Mr. Gross asked Lloyd Johnson of SuperValu if they still
needed the parking space under Highway 169. Mr. Johnson stated that until the new
development on the Hennepin County site was complete, SuperValu would still need the
parking area. No one appeared at the public hearing regarding this item.
Alternatives.
1. Approve the conditional use permit. By approving the conditional use permit, the
applicant will be able to construct the addition as proposed.
2. Deny the conditional use permit. By denying the conditional use permit, the applicant
will not be able to construct the addition as proposed. If the City Council considers this
alternative, findings will have to be identified that support this alternative.
Continue for further information. If the City Council indicates that further information is
needed, the item should be continued.

WHEREAS, an application for Conditional Use Permit CUP98 -8 has been made by
SuperValu;
WHEREAS, the procedural history of the application is as follows:
1. That an application for a conditional use permit was made by SuperValu
on August 31, 1998;
2. That the Hopkins Zoning and Planning Commission, pursuant to mailed
and published notice, held a public hearing on the application and
reviewed such application on September 29, 1998: all persons present
were given an opportunity to be heard;

AND APPROVING OF A CONDITIONAL
USE PERMIT TO CONSTRUCT AN ADDITION
That the written comments and analysis of City staff were considered; and
A legal description of the subject property is as follows:
Tracts A, B, C, and D Registered Land Survey No. 1143 also Lots 8
through 18 Block 23 West Minneapolis Center also Lot 1 though 10 and
the north 26 feet of Lot 11 Block 33 West Minneapolis Center also all of
Blocks 25, 26, 30 and 31 West Minneapolis Center also that part of the
southwest 1 /4 of the southwest 1 /4 of Section 19 Township 117 Range 21
lying south of west Minneapolis Center and west of Registered Land
Survey No. 1143 also that part of the northwest 1 /4 of the northwest 1 /4 of
Section 30 Township 117 Range 21 lying west of Registered Land Survey
No. 1143 and north of Third Street South including the vacated streets and
alleys adjacent to the above described tracts of land excluding roads
Registered Land Survey No. 1143.
NOW, THEREFORE, BE IT RESOLVED that the application for Conditional Use
Permit CUP98 -8 is hereby approved based on the following Findings of Fact:
1. That the proposed building meets the requirements for a conditional use
permit.
2. That the proposed use is permitted in the I -2 zoning district.

BE IT FURTHER RESOLVED that application for Conditional Use Permit CUP98 -8 is
hereby approved based on the following conditions:
1. That Nine Mile Creek Watershed District approves the grading and
drainage plan.
2. That four trees are planted on the site.
3. That a new site plan is submitted without the relocation of Washington
Avenue.
