CONDITIONAL USE PERMIT - COMMUNICATIONS TOWER
Proposed Action.
Staff recommends the following motion: Move to adopt Resolution 06-01. approving a
conditional use permit to construct a communications tower.
At the Zoning and Planning meeting, Mr. Aamess moved and Ms. Aristy seconded a motion
to adopt Resolution RZ05-38, recommending approval of a conditional use permit to
construct a communications tower. The motion was approved unanimously.
Overview.
Sprint, the applicant, is proposing to construct a 75-foot communications tower on the south -
east side of the property at 11111 Excelsior Boulevard. The property currently has the
Hopkins Tech Center located on the site. Sprint did contact the City to attach equipment to
the water tower on Excelsior Boulevard, but for various reasons this did not work. Sprint
also looked at Dow Towers, but the coverage was insufficient.
The Zoning Ordinance allows communication towers in the industrial district with a
conditional use permit. The maximum height is 75 feet.

Primarv Issues to Consider.
. What is the zoning of the property, and how has the Comprehensive Plan
designated the subject site?
The property is zoned 1-1, Industrial. The Comprehensive Plan has designated the property
as industrial. The proposed use complies with both documents.
. What are the requirements for a communications tower?
Subd. I. A wireless communications facility is permitted on a lot in an industrial zoning
district together with an existing use, subject to the following conditions:
a) The existing use on the lot may be any permitted use in the district or any lawful
nonconforming use, and need not be affiliated with the wireless telecommunications
provider. The wireless communications facility will not be considered an addition to
the structure or value of a nonconforming use.
b) The wireless communications facility shall be fully automated and unattended on a
daily basis, and shall be visited only for periodic and necessary maintenance (except
during construction or an emergency).
c) The minimum lot area shall be the area needed to accommodate the tower (and guy
wires, if used), the equipment shelter, security fencing and buffer planting.
d) The minimum distance from any tower to any R-l district lot line shall be the height
of the tower plus 100 feet. Setbacks are measured from the base of the tower to the
property line of the parcel on which it is located. Towers shall have a minimum
setback from any other zoning district equal to the height of the tower plus 10 feet,
unless otherwise provided in the ordinance. Setbacks are measured from the base of
the tower to the property line ofthe parcel on which it is located.
e) Equipment shelters shall comply with the minimum setback requirements for district.
f) Access - the service access to the equipment shelter shall, whenever feasible, be
provided along the circulation driveways of the existing use.
g) Maximum height:
Tower: 75 feet measured from grade.
Equipment Shelter: 10 feet
h) Maximum size of equipment shelter - 200 square feet for a single shelter, or ifthere is
more than one, 400 square feet. Equipment shelters shall be placed underground if
physically feasible.
i) All ground equipment shall be housed within an existing structure whenever possible.
If an equipment shelter is necessary, it shall be situated as to be screened from view by

The tower is not 85 feet from the south and east lot line. The ordinance does allow a tower to
be closer to a lot line ifthere are uses next to the tower such as a railroad right-of-way. The
uses to the south are a railroad right-of-way and a holding pond.
There will be no equipment shelter. The ground equipment will be mounted on a platform.
The ordinance requires the ground equipment to be screened. The site will be fenced with a
chain link fence with wood slats. The applicant is also proposing to add six arborvitaes to
screen the fence. There will be two arborvitaes on the north side and three on the west.
. What are the specifics of the tower?
The proposed tower will be a monopole located on the southeast corner of the site. The
height will be 75 feet. Sprint will use the antennas at the top, and there will be additional
space for two other future carriers. There will be a 20- foot access easement for access to the
tower.
. What is the staff recommendation?
Staff is recommending approval because the proposed tower meets the requirements for a
conditional use permit.
. What was the discussion at the Zoning and Planning meeting?
Ms. Anderson reviewed the proposed tower. The Commission discussed the proposed
material for the tower, where the others carriers would be located, and the height of the
tower. Steve Edward of Sprint appeared before the Commission. No one appeared at the
public hearing.
Alternatives.
1. Approval the tower. By approving the tower, the applicant will be able to construct the
tower as proposed.
2. Deny the tower. By denying the tower, the applicant will not be able to construct the
tower as proposed. If the City Council considers this alternative, findings will have to be
identified that support this alternative.
3. Continue for further information. If the City Council indicates that further information is
needed, the item should be continued.

RESOLUTION MAKING FINDINGS OF FACT AND
APPROVING A CONDITIONAL USE PERMIT
TO CONSTRUCT A COMMUNICATIONS TOWER
WHEREAS, an application for Conditional Use Permit CUP05- 7 has been made by sprint - LCC
International, Inc.;
WHEREAS, the procedural history ofthe application is as follows:
1. That an application for a conditional use permit was made by LCC International,
Inc; on November 25,2005;
2. That the Hopkins Zoning and Planning Commission, pursuant to mailed and
published notice, held a public hearing on the application and reviewed such
application on December 27, 2005: all persons present were given an opportunity
to be heard;
3. That the written comments and analysis of City staff were considered; and
4. A legal description of the subject property is as follows:
Parcel 2: All that part of the Northeast Quarter of the Northeast Quarter of
Section 25, Township 117, Range 22 described as follows: Beginning at the
intersection ofthe section line between said sections 25 and 26 with the northerly
boundary line of the right of way of the Minneapolis & St. Louis Railway
Company; thence northeasterly along the northerly boundary line of said right of
way to a point 356 feet east of and at right angles to said section line between
Sections 25 and 26; thence north parallel with said section line to the north line of
said Section 25; thence west along the north line of Section 25 to the northwest
corner of Section 25; thence south along the section line between Sections 25 and
26 to the point of beginning. Having a Pill number of 25-1 17-22-22-0005 and a
Hennepin County Torrens Property Certificate #859639.
NOW, THEREFORE, BE IT RESOLVED that the application for Conditional Use Permit
CUP05- 7 is hereby approved based on the following Findings of Fact:
1. That the proposed communications tower meets the requirements for a conditional
use permit.
