CR 99-200 On-Sale Wine & On-Sale 3.2% Beer Licenses for Cafe Michelangelo October 28, 1999 Council Report 99-200 On-sale Wine and On-sale 3.2% Beer licenses for Cafe Michelangelo Staff recommends approval of the following motion: Approve an on-sale wine and on-sale 3.2 beer license for Cafe Michelanqelo. located at 802 Mainstreet. This will allow Cafe Michelangelo to begin selling wine, 3.2 beer and strong beer with meals. Overview In August, Council approved a wine and strong beer license for Cafe Michelangelo. After that approval, the officer of the corporation that applied for the license asked that the application be put on hold because the corporate partners were having problems. Since that time, I have received a letter signed by both of the partners indicating that the corporate structure as well as the corporate ownership of the business has changed. According to the City Code, this requires a new application and approval. Because no additional investigation was required, no additional fees were assessed. Primary Issues to Consider State Statute and City Code state that the holder of an on-sale wine license who is also licensed to sell 3.2 percent malt liquors at on-sale and whose gross receipts are at least 60 percent attributable to the sale of food, may sell intoxicating malt liquors at on-sale without an additional license. The on-sale 3.2 beer license in conjunction with the wine license will allow the restaurant to also sell strong beer. The Hopkins Police Department approved the application.
