December 28, 1998 CONTRACT: PRESERVATION OF SINGLE FAMILY HOUSING STUDY ProDosed Action Staff recommends approval of the following motion: Execute a contract with Hoisington Koegler & Associates. dated December 28. 1998, to undertake a study concerning the preservation of single family housing stock in the City of Hopkins. Overview The City Council recently approved the implementation of a moratorium prohibiting the issuance of permits for the demolition of single family homes within single family-zoned areas. During the period of this moratorium, it is proposed that a study be undertaken to review this issue in more detail. It is anticipated that the final work product of this study would be to present alternatives for revising existing policies and ordinances in order to provide the City Council more review authority and control on projects which involve the removal of single family dwellings. The study, as prepared by staff, would involve two aspects. First, there would need to be a review of case law concerning the City's ability to regulate this matter. Staff is proposing that this . activity would be undertaken by Jerry Steiner in the City Attorneis office. The second part of the study will involve researching how other cities and governmental entities may have addressed this matter, reviewing the legal constraints as identified by the City Attorney, and then developing alternative actions to best address the Council's concerns. Staff has spoken with a number oflocalland use/planning consultants concerning this matter, and none has really ever undertaken a study of the type being proposed. Staff is recommending the use of Hoisington Koegler, based on the fact that they are both familiar with the City of Hopkins and are presently under contract to revise the City's Comprehensive Plan. The specific study goal and work schedule is identified in the he proposal from Hoisington Koegler. Staff's understanding, based on discussion with the City Council, is that this study is meant to look at strengthening local ordinances and policies to ensure that the City Council is provided sufficient review authority on any activities that would involve the demolition of single family homes in single family residential districts. It is important that if the Council wishes to have a different direction that it be detailed at the January 5 meeting. A representative of Hoisington Koegler will be present at this meeting. Based upon previous discussions, staffwill return to the Council, in March, an update on the status of this activity and possible action, if appropriate. Alternatives The Council has the following alternatives regarding this issue: . 1. Approve the action as recommended by staff This will allow the execution of the contract with Hoisington Koegler, who will then proceed immediately to complete this task. 2. Continue for additional information. With this alternative the Council needs to indicate what additional information they need prior to undertaking action. It also needs to be understood that with this action the process will be slowed down, which will in turn make it more difficult to try and resolve this matter within a 90-day period, as previously discussed by the Council. . It is our understanding that we are to look at the existing ordinances, plans and policies of the City to determine how they currently deal with situations that may involve the loss of single-family homes. We understand that we are to consider revisions to the City's current policies and regulations which would give the Council more control when it comes to situations which could result in the loss of single-family homes. We also understand that we will define the goal of this effort at an initial goal formulation workshop with the City Council. . The HKGi approach will be to work with City Staff and an attorney, to be selected by the City, to develop a recommendation to the City Council regarding the above. Our work plan includes the following: 1 ) Goal formulation with City Council. This will include a workshop with the City Council and Staff to define the direction the City is interested in pursuing to address this critical issue. 2) Review of existing plans and ordinances. This task will include the evaluation of existing ordinances, plans and policies of the City regarding how they deal with potential single-family home losses. 3) Research. This will include research with other metro area cities, and the internet, to determine if and how other cities have addressed this concern. We will request copies of ordinances and policies that relate to this issue to serve as a guide for the ultimate recommendations. 4) Development of a recommendation. HKGi will work with City Staff and the attorney to explore a range of options and make a recommendation to the City Council regarding how ordinances, plans and policies should be amended or rewritten to satisfy the City's intent. . 123 North Third Street. HKGi will prepare a two-page letter report outlining our recommendations. 6) Meetings with City Staff. Two meetings estimated. 7) Meetings with City Council. Two meetings estimated. 8) Meetings with attorney. Two meetings estimated. The fee for the above services will be hourly plus incidental expenses in an amount not to exceed $5,500.00. For meetings in addition to those described in the work plan, HKGi will bill the City on an hourly basis in accordance with the attached rate schedule. If HKGi is asked to assist with Phase II, ordinance preparation, a fee will be negotiated. We very much look forward to working with the City on this important study.
