Transit Improvements Study. a resolution in support of the major proposed improvements to the xistina transit network in Hopkins as identified in the transit imorovements study beinQ compl ted by Metro Transit and the Cities of Hopkins. Minnetonka and St. Louis Park. Overview The City is working with the Cities of Minnetonka and St. Louis Park, and with Metro Transit, to complete the transit improvements study. As part of the implementation of that study, Metro Transit plans to apply for federal transit funding through the Congestion Mitigation Air Quality (CMAQ) program. Metro Transit staff have requested that as part of their application the three cities each pass a resolution of support for the major transit improvements proposed in the study. Metro Transit staff provided the text of proposed Council resolution 99-84, Transit Improvements Study, which is attached. The Council has had two presentations about the study by Metro Transit staff and the consulting firm on the study, LSA Associates. The Council has not formally approved the study, but is aware of the major improvements identified in the study. The Council is in agreement with the general direction of the study. The Council may find that the requested resolution is broad enough to allow for Council endorsement at this time, while still allowing for further consideration of the study by the Council before final Council approval. . Does the City Council support the application by Metro Transit for federal funds to implement some of the proposed major improvements identified in the study? Metro Transit has asked for general support for its application for federal funds for transit improvements. At a recent Council work session, Metro Transit staff indicated that Metro Transit would seek support from the Hopkins City Council for Metro Transit's application for federal funds. Metro Transit staff should be able to provide specific information about the application should Hopkins request it. Staff recommends that the Council approve the proposed resolution. Alternatives The Council has the following alternatives regarding this matter: 1. Approve the item as recommended by staff. 2. Amend and approve the item. 3. Continue the item for additional information. 4. Deny the item. 2 CITY OF HOPKINS, MINNESOTA RESOLUTION NO. 99-84 TRANSIT IMPROVEMENTS STUDY WHEREAS, the City of Hopkins has been actively participating in a transit improvements study with Metro Transit and the adjacent communities of St. Louis Park and Minnetonka to enhance transit connections within their communities and provide reverse commute services for employees from outside their communities; and WHEREAS, the City of Hopkins has made substantial commitments in creating and enhancing its community-wide transit services; and WHEREAS, the City of Hopkins believes that improved transit service is a critical factor in reducing congestion, ensuring economic vitality, and meeting the demands of changing travel patterns; and WHEREAS, the City of Hopkins has worked with Metro Transit to develop major proposed improvements to the existing transit network in Hopkins, St. Louis Park and Minnetonka; and WHEREAS, the proposed improvements meet the service goals and criteria established by Transit Redesign; and WHEREAS, the proposed major improvements are designed to reduce congestion, improve air quality, enhance economic vitality and meet the demands of changing travel patterns; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HOPKINS, that the City of Hopkins supports and is actively participating with Metro Transit in their application for Congestion Mitigation Air Quality (CMAQ) program funds to implement major transit improvements for residents, employers and employees of Hopkins and the immediate subregion. Adoption of this ordinance amends Sections 720.05 and 720.13 of the City Code and removes certain ambiguities, uses terminology in keeping with the City's land use plan, and more nearly aligns the code with historical enforcement practices. No revisions have been made on the original as submitted to Council at its August 17 meeting. The action required is to adopt Ordinance 99-829 for second reading and ordered published. Attachment Hopkins City Code (Rev. ), 72 0 . 01 Section 720 - Storm Sewer Drainaqe Utility 720.01 Establishment. The municipal storm sewer system shall be conducted as a public utility pursuant to M. S. Section 444.075 from which revenues will be derived subject to the provisions of this Chapter and said Minnesota Statutes. The storm water drainage utility shall be part of the Public Works Department and subject to the administration of the Public Works Director. Just and reasonable charges for use and availability of storm sewer drainage facilities shall be calculated and determined pursuant to the terms hereinafter contained based on expected and typical storm water run off as may be calculated within reasonable and practical limits with due regard to just and equitable charges as provided for herein. 720.03 Definitions. Rates and charges for the use and availability of the utility system shall be determine through the use of a residential equivalent factor (REF) defined as the ratio of the average volume of run off generated by one acre of a given land use to the average volume of run off generated by one acre of typical single family residential land, during a standard one year rainfall event. 720.05 Storm Water Drainaqe Fees. Storm water drainage fees for parcels of land shall be determined by multiplying the REF for the parcel's land use classification by the parcel's acreage and then multiplying the resulting product. by the storm water drainage rate. Industrial 5 For the purpose of calculating storm sewer water drainage fees, all developed one family and duplex residential parcels shall be considered to have an acreage of one-third acre. The storm water drainage rate shall be as established by resolution. Section 720 1 Hopkins City Code (Rev., 1993), 720.07 720.07 Other land usaqe. Other land uses not listed in the foregoing table shall be classified by the Director of Public Works by assigning them to classes most nearly like the uses, from the standpoint of run off volume for the standard rainfall event. An appeal of such classification from the determination of the Director may be made to the City Council. . 720.09 Adiustments. The City Council may by resolution adopt policies providing for the adjustment of charges for parcels based upon land use data supplied by affected property owners which demonstrates a run off volume for a standard rainfall event substantially different from the REF being used for such parcels. Such adjustments for storm water drainage fees shall not be made retroactively. 720.13 Exemptions. Public street rights-of-way, that part of public transportation corridors in use for light rail or recreational trails, and vacant unimproved land with ground cover are exempt from storm water drainage charges. (Amended Ord. #93-723) 720.15 Pavment of fee. Statements for storm water drainage fees shall be made a part of present utility billing system invoiced through the Finance Department of the City on a monthly or quarterly basis at the option of said Finance Department. 720.17 paying person to the by the Recalculation of fee. Any past due storm water drainage fees will b~ certified to the County Auditor for collection with real estate taxes in the following year pursuant to M. S. Section 444.075, Subd. 3 and City of Hopkins Resolution 82-3039. In addition, the City may have the right to bring a civil action or take other legal remedies to collect unpaid charges. (Added Ord. The Hopkins City Code Section 720.05 is hereby amended to read as follows: 720.05 Storm Water Drainage Fees. .... The REF values for various land uses are as follows: Class 8. Land Uses Yaeant improved and unimpro':ed Open Space REF o Open space shall be defined as vacant unimproved land with ground cover and lying partially or totally in wetlands. For the purpose of calculating storm sewer water drainage fees, all developed one family and duplex residential parcels shall be considered to have an acreage of one-third acre. Commercial or industrial sites may be composed of multi-land use parcels. In those cases all parcels shall be assigned the highest applicable REF. The storm water drainage rate shall be as established by resolution. Section 2. 720.13 The Hopkins City Code Section 720.13 is hereby amended to read as follows: Exemptions.
