CERTIFICATE OF COMPLETION
NINE MILE COVE IMPROVEMENTS
Proposed Action
Staff recommends adoption of the following motion: Move that Council adopt Resolution
99-039 Resolution Accepting Work and Ordering Certificate of Completion, Improvement
Proiect 97-03.
Overview
Constmction of public utilities and streets associated with the Nine Mile Cove development has
been complete as of October 3, 1998. The City needs to formally acknowledge this date should
warranty period issues arise. There is a pending final invoice to the City for its share of
constmction costs but staff wishes not to act on payment authorization at this time. There
appear to be some roadway failures in 2nd A venue South that may be categorized as either design
or construction and no payment should be made until resolution is reached.

The City's view is that contract obligations have been met and that a warranty phase
has been in effect since October 3, 1998.

Adoption of this resolution formally acknowledges completion of the work and
initiates a 3-year warranty on the contract work.

RESOLUTION ACCEPTING WORK AND ORDERING CERTIFICATE OF COMPLETION
NINE MILE COVE IMPROVEMENTS, PROJECT 97-03
WHEREAS, pursuant to a development agreement signed with the City on April 7, 1997,
Taurus Properties has agreed to require its contractor to secure and furnish a maintenance bond
in favor of the City of Hopkins upon final completion and acceptance of public improvements
associated with the Nine Mile Cove development.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF HOPKINS,
MINNESOTA:
1. The work completed under said contract is hereby declared accepted and
approved.
. 2. A three-year warranty on contract work shall have commenced as of October 3,
1998.
3. A certificate of completion shall be issued to Taurus Properties.
Adopted by the City Council of Hopkins, Minnesota this18th day of May, 1999.
