Proposed Action
Staff recommends adoption of the following motion: Move to approve a tobacco license
for Tony's Tobacco Inc., dba Tobacco and Gifts, 12 Suburban Square.
Overview
At the April 2, 2002 City Council meeting, the applicant applied for a zoning amendment
to allow tobacco sales as a primary use in the B-2 Zoning district. The amendment was
denied. The applicant has since applied for a tobacco sales license to sell tobacco in a
gift shop at the same location.

. Primary Issues to Consider
What are the Zoning issues? The applicant is now applying for a license to sell tobacco
products as a secondary use. The primary use of the business will be a gift shop. This
use is allowed in the B-2 Zoning district. The applicant has spoken with Nancy
Anderson and was told that the use will be determined by the amount of floor space
that is designated to the different products. The application states that 60% of the floor
space will be designated to gift items and 40% will be designated to tobacco products.
I have spoken with Nancy Anderson. Nancy said that the business would be inspected
on a regular basis to determine that the tobacco use remains a secondary use.
This is a routIne license application.
Alternatives
1. Deny the application
2. Continue the item for further discussion
3. Approve the Application
Staff recommends alternative one.
