April 16, 2002 HOPKINS Council Report 2002-62 Approval of Central Dumpster Project Proposed Action Staff recommends adoption of the following motion: Move to approve Resolution 2002-17 Authorizing the Use of Public Property and Public Funds for the Location and Construction of a Central Dumpster. Overview City staff has been approached by a group of business and property owners with a proposal to create a centralized garbage dumpster enclosure on Block #7. Currently the building owners and tenants (the Group) contract individually for trash service on an "as needed basis," The project includes replacing several unsightly dumpsters located between 8th and 9th Avenues South, north of the alleyway (see attached site diagram), with an enclosed dumpster pickup site located in Parking Lot #200 (as indicated on the attached site diagram). The Group is requesting the use of three public parking stalls in Parking Lot #200 (also indicated on the attached site diagram). They are also requesting $4,000 to pay for the construction of the enclosure. . How will the construction of the enclosure be handled and who is responsible for its maintenance? The building owners and tenants will select a construction contractor and will contract for the design and construction of the enclosure. The construction contractor, the design and the construction of the enclosure must all be approved by the City. The City will pay for construction costs of up to $4,000. The building owners and tenants will be responsible for the construction of the enclosure, all structural and aesthetic maintenance of the enclosure, and for the administration of the project including contracting for garbage collection. All responsibilities of the building owners and tenants, as well as those of the City of Hopkins, are spelled out in the attached Resolution 2002-17. . What is the duration of this project? This project will be a two-year pilot project that will be reviewed annually. At the end of the two years, the project will be evaluated and a decision will be made as to whether it should be continued on a more permanent basis. In determining the success of the project. staff will evaluate criteria including, but not limited to: 1, How well the enclosure has been maintained; 2. The extent to which the enclosure continues to be used by the building owners and tenants (i.e., are all or most owners and tenants using the enclosure); 3. How well the enclosure meets the needs/goals of the building owners and tenants; . 4. Garbage collection issues; 5. Parking issues; 6. The extent to which the aesthetics of the alleyway are improved 7. Adherence to the requirements of Resolution 2002-17; and 8. Any other unforeseen issues, both positive and negative, which may arise. If this project is successful, it is assumed that other building owners and tenants may wish to develop similar projects on other blocks. . What are the potential benefits of the project? Potential benefits of the project include the following: - Elimination or significant reduction of alley clutter due to the reduction of the number of garbage dumpsters and the consolidation and enclosure of the remaining dumpsters; Improved aesthetics of the rear business entryways and the alleyway area; - Additional parking spaces on private property may be attainable as the dumpsters are relocated and the number of dumpsters is reduced; - Heavy truck traffic caused by frequent garbage pickup would be reduced; - Enhanced recycling pick-up opportunity due to increased participation and potential cost reductions; and - Cost savings for building owners and tenants due to common trash collection. . -- Council Report 2002-62 Page 3 . . HENNEPIN COUNTY, MINNESOTA RESOLUTION 2002-17 RESOLUTION AUTHORIZING THE USE OF PUBLIC PROPERTY AND PUBLIC FUNDS FOR THE LOCATION AND CONSTRUCTION OF A CENTRAL DUMPSTER WHEREAS the City Council of the City of Hopkins has the power and authority to adopt from time to time programs for the promotion of public health, safety and welfare, such as programs related to the control and disposal of refuse; WHEREAS the City of Hopkins from time to time has undertaken various public improvements in the Central Business District; WHEREAS, the building owners and tenants located on Block 7, West Minneapolis, Second Division, have expressed a concern about the unsightly appearance of multiple dumpsters on their block and have expressed an interest in establishing a centralized dumpster location; NOW, THEREFORE, BE IT RESOLVED, that the City of Hopkins hereby agrees to provide an amount not to exceed $4000 for the construction of an enclosed dumpster site and to allow the use of three parking spaces in public parking Lot 200 as identified . by City of Hopkins staff, which can be utilized by building owners and tenants located on Block #7, West Minneapolis, Second Division; BE IT FURTHER RESOLVED, that in consideration of the funds and location provided by the City of Hopkins, the building owners and tenants shall be responsible for the following: 1. Selecting and notifying the City of Hopkins of a block leader or leaders who will assume responsibility for construction of the enclosure and who shall act as a liaison to City of Hopkins staff for all matters concerning this central dumpster project; 2. Obtaining the appropriate permits from the City of Hopkins Building Department for the construction of the enclosure; 3. Selecting a contractor and contracting for the construction of the enclosure; 4. Submitting to the City of Hopkins proof of payment or invoices for the construction of the enclosure; 5. Maintaining the structural and aesthetic maintenance of the enclosure and the site; 6. Coordinating the use of the enclosure; 7. Negotiating and executing necessary contracts with the garbage collection contractor; 8. Coordinating, collecting, and paying all monthly fees; and . 9. By June 30 of each year, the block leader shall provide to the City of Hopkins an annual update detailing who is using the enclosure, all maintenance issues and concerns over the previous year and all other issues and concerns that may be determined appropriate by the City; -- -- BE IT FURTHER RESOLVED, that: . 1. The construction contractor, the cost of construction and the design of the enclosure must be approved by the City of Hopkins before commencement of construction; 2. Upon completion of the enclosure and submission of proof of payment or invoices documenting the final cost of the enclosure, the City of Hopkins will pay for an amount not to exceed $4000 as submitted by the building owners and tenants for the construction of the enclosure; 3. Upon completion of and payment for the enclosure, the same shall become property of the City of Hopkins; 4. This central dumpster project shall be a two-year pilot project, ending in July 2004; 5. By July 30 of each year, beginning in 2003, the City of Hopkins shall complete an evaluation of the use and maintenance of the enclosure to determine whether to keep or remove the enclosure; 6. At the end of the pilot project in July 2004, the City of Hopkins shall complete the final evaluation and determine whether more permanent structures should be built in the described location and at other locations throughout the Central Business District or whether the enclosure should be removed at the end of the two year period; 7. At any time during the pilot project, the City may remove the structure from the public parking spaces if it is determined that continuation of the project is not in the best interests of the City of Hopkins or the Central Business . District; and 8. If the enclosure is to be removed and the use of the parking area for dumpsters terminated, a 60-day written notice will be provided to all building owners and tenants utilizing the enclosure.
