Services fees - 2nd Street N Storm Sewer Project
Proposed Action.
Staff recommends adoption of the following motion: Move that Council authorize
the Mavor and City Manaqer to enter into an aqreement with SEH-RCM for
construction enqineerinq services and approve additional desiQn services fees
not to exceed $10.741 pertaininq to City Proiect 98-16. 2nd Street North storm
sewer improvements (Area 5).
Overview.
In February, 1999 City Council approved a design engineering services
agreement with SEH-RCM, excluding construction engineering services, at a
cost not to exceed $18,600. During design, staff authorized the consultant to
increase the scope of the design to include storm sewer pipe replacement and
significant street redesign. These changes were necessary to maximize flood
reduction potential in the alley low area and to improve upon existing inadequate
0 longitudinal street grade. In May, 1999 Council approved awarding the
construction contract. At that time, City staff reported the total project cost as
$378,000, this amount included the increased design fees and construction
engineering fees. Staff is now requesting formal approval of the construction
engineering services agreement in the amount of $31,628.00 and the final design
services fee of $29,340.99.

The budget remains at $378,000 as reported in May, 99 at time of contract
award. The total engineering fees are $60,968.99 or 18.7% of the construction
cost.

Based on the bids taken on Thursday, May 6 at 10:00 a.m., we recommend the award of a
construction contract to OptiCon, Inc., Bloomington, :MN based on the low bid of $302,815.16
0 they submitted. Their bid was approximately 7.4% over the engineer's estimate, which was
$281,992.50. A copy of the bid tabulation is attached for your information and use.
We called Rich Crandall at Barton -Aschman and Randy Lindblom with the City of Maple wood
both of whom worked with OptiCon, Inc. on projects similar in size to your project. They both
indicated their work was good and that they were receptive to the engineer's concerns.
Based on these bids the budget for the project is:
Construction $302,815.16
Design Engineering 29,340.99
Construction Engineering 30,280.00
Contingency 15,563.85
TOTAL $378,000.00

Dear Mr. Stadler:
This letter supplements the Agreement for Professional Services between the City of Hopkins,
Owner, and SEH dated July 6, 1999 and addresses providing services in connection with
Construction Administration for the Area 5 Storm Sewer (hereinafter called the "Project"). The
scope of said services is detailed in the attached proposal letter and cost matrix dated May 21, 1999
and May 20, 1999.
Our services will consist of providing construction services including resident project representative
0 services during construction, and assistance during the start-up, all as set forth in this letter and the
Agreement for Professional Services between SEH and the City of Hopkins dated July 6, 1999.
Included in this proposal are the following services listed under paragraph F of exhibit A:
1. Providing "As-built" drawings
2. Providing RPR services~
We will also furnish such other Additional Services as you may request or as required.
You will pay us a fee for our services, currently estimated to be $31,628, in accordance with Exhibit
C-1, (Actual Billable Rate) method. We will not exceed this estimated fee without your approval.
Payment for additional services shall be based on the time required to perform the services and the
billable rates for the principals and employees engaged directly on the project, plus charges for
expenses and equipment, all in accordance with Exhibit C-1.
We will start our services promptly after receipt of your authorization. We estimate our services will
be completed after four months. If there are delays in the Project that are beyond our control, you
agree to grant additional time to complete the services.

AGREEnnENT FOR PROFESSIONAL SERVICES
THIS AGREEMENT is effective as of July 6, 1999 (Effective Date) between City of Hopkins
(Owner) and Short Elliott Hendrickson Inc. (SEH). This Agreement consists of the Agreement for
Professional Services, Exhibit A, Exhibit B the Owner's Responsibilities, Exhibit C-l for Hourly Payments,
and Exhibit D for Resident Project Representative Duties/Responsibilities. Individual Projects will be
described in the Supplemental Letter Agreements with the appropriate exhibits cited.
By entering into this Agreement, Owner agrees to utilize the professional services of SEH and SEH agrees
to provide the professional services described in this Agreement.
This Signature Page, the Agreement and Exhibits along with any Supplemental Letter Agreements represent
the entire understanding between Owner and SEH with respect to the services to be provided by SEH and
, may only be modified in writing signed by both parties. In the event of any conflict between the documents
listed above as part of this Agreement, the Agreement for Professional Services shall govern over all other
documents with Exhibit B, Exhibit D, Supplemental Letter Agreements and Exhibit A following in order of
precedence.
