APPROVE AGREEMENT FOR CUSTODIAL SERVICES FOR
HOPKINS CITY HALL, POLICE STATION AND PUBLIC WORKS
Proposed Action
Staff recommends adoption of the following motion: Move to approve an aareement
between "ROC Janitorial" and the Citv of Hopkins to provide ianitorial services for
Hopkins Citv Hall. Police Station and Public Works.
Overview
Currently the City of Hopkins contracts with an outside contractor for custodial services
in Hopkins City Hall and Police Station. Due to the reconstruction of the Police Station
and Public Works we decided to solicit new proposals due to the increased square
footage and change in scope of duties needed. Requests for proposals were solicited.
After reviewing the 8 submitted proposals, staff decided to award the agreement to
ROC Janitorial based on the lowest overall cost and meeting all the conditions of the
specifications.

DETAILED BACKGROUND
Prior to1996 the City employed 2 full time custodians for cleaning duties at Hopkins City
Hall, Police Station and Public Works. In 1997 one of the custodians transferred to a
position in the Public Works Street Department. Staff decided not to fill the position and
to contract out a portion of his duties to save money. This contract covered Hopkins
Activity Center, Public Works and weekend and Holidays at the Police Department. (Up
until this time no cleaning was done over the weekend or Holidays at the Police Dept).
In 2001 the custodian assigned to city hall retired and we expanded the contract to
cover all of City Hall and Police. In 2003 the contract with the Hopkins Activity Center
was cancelled due to budget constraints and Public Works were cancelled due to
Budget Constraints and reconstruction at Public Works. Currently the city has a
cleaning agreement with Coverall Cleaning Concepts that covers City Hall and the
Police Station. Public Works is cleaned by a part time employee that averages 6 to 9
hours a week. The Activity center utilizes part time and existing staff for its cleaning
duties. The amount that the city was paying at the City Hall and Police was based on a
square footage formula from the original contract in 1997. Due to the change in size
and scope of work at all thee buildings staff decided we needed to solicit new proposals
for this work.
ANALlSIS OF ISSUES:
FUNDING AND IMPACT ON BUDGET
At present the monthly charge for cleaning at City Hall 5 days a week is $2,532 monthly
or $30,384 yearly. The cost for the Police Department 7 days a week is $2,623 monthly
or $31,476 yearly. Total for both areas within City Hall $61,860.
At Public Works we currently pay a part time employee for 9 hours a week at 12 dollars
an hour or $108 per week or $5,616 per year. If we were to go to 5 day a week cleaning
(What we really need) the cost would be $180 per week or $9360 per year.
In 2006 we budgeted $56,000 for City Hall and Police. And $8,000 for Public Works.
We had anticipated a lower cost in 2006 with the new proposals; this is the reason for
the difference in the actual cost and budgeted amount.
The total Budgeted amount for all three buildings in 2006 is $64,000; the amount of the
proposal from ROC Janitorial is $37,200. The savings to the General budget is
($26,800) in 2006. The difference in current cost verses new costs is over $30,000 less
than 05 costs
The lower cost is due to a strong market in custodial services as the amounts bid were .
comparable to costs per square foot as in the 1997 proposals that were submitted.

the twin cities area and in the City Of Hopkins. Staff has contacted 5 current accounts
that they are servicing and the feedback was very positive.

II. CUSTODIAL SERVICES SPECIFICATIONS
A. General
The City reserves the right to award these contracts as one (1) contract or as (3) three
individual contracts. The final decision will be made based on lowest overall cost to the
city, adherence to the specifications and previous experience. It is the desire of the City
to award the bid for Hopkins City Hall and Police Station as one bid and the total cost
for these two sections of the bid will be a determining factor in the award.
The detailed specifications of this contract are intended to cover the cleaning services
required in a general manner, but they may not be complete in all details. If any items
have inadvertently been omitted that should be included according to common practice
in the services rendered they should be brought to the attention of the Buildings
Superintendent before submitting the proposal.
All cleaning materials used must be of a type that will not have an immediate or
extended detrimental effect on any of the surfaces being cleaned.
Any foreign matter, spills, marks or residue of any nature on any surface shall be
removed during regular cleaning operations.
Mechanical or other equipment used in cleaning operations must be of a type that is
approved in the industry and shall be operated in such a manner as not to cause danger
of any nature to employees or other persons or damage the building structure, fixtures
or furnishings, etc. Any injuries, damages or vandalism shall be immediately reported to
the Buildings Superintendent for corrective action.

Any items or articles of apparent value found by cleaning service personnel in any of the
City buildings or sites shall immediately be turned over to the Police Department. Any
articles of a suspicious nature that may be found or persons loitering or conducting
themselves in a manner to arouse suspicion or possibly in need of help, shall
immediately be reported to the Police Department at - 911 - giving your name, firm
name and vour exact location within citv buildinas.
Precaution shall be taken at all times to protect persons, property and equipment from
injury or damages. All equipment used in cleaning operations shall be stored in a safe
and proper manner and in locations designated or approved by the City Buildings
Superintendent. Any flammable, volatile or hazardous materials required in the
cleaning service operations shall be stored in a safe manner and locations approved by
the Fire Underwriter's Association and the City Fire Marshall.
B. Contractor Responsibilities
The Contractor shall meet with the City Buildings Superintendent on a bi-weekly basis
reviewing the scheduled custodial activities and the previous week's custodial
performance. The bi-weekly meeting will be scheduled between the hours of 9:00 a.m.
and 11 :30 a.m. Thursdays.
It is the contractor's responsibility to understand the requirements of the contract and to
perform all specified tasks in an acceptable manner. It is not the Citv's responsibilitv to
remind the contractor of the contract reauirements. In the event all specified tasks are
not performed in an acceptable manner, the City reserves the right to secure the
services of a second vendor to perform the tasks of the contract. The second vendor
shall be paid from moneys due the contract vendor. The entire scope of the contract
and its specifications shall be reviewed monthly by the City Buildings Superintendent to
ensure contract compliance.
Contractor shall be required to provide service personnel that present a clean and neat
appearance at all times. Contractor must provide service personnel that will clear a
city's background check prior to being assigned to a city building. Contractor must have
all service personnel wear badaes while on duty which shall include as a minimum. a
photo. emplovee name and firm name.
Contractor shall not employ person or persons in or about the premises who shall use
improper language or act in a loud or boisterous or otherwise improper manner.
Cleaning personnel shall have a basic understanding of the English language.
Personnel deemed unacceptable by the City of Hopkins shall be replaced within twenty
four (24) hours.
In the event that a regularly assigned contract employee is absent, it is the contractor's
responsibility to supply an additional employee who meets the minimum requirements
and to furnish evidence that such has been done at no additional cost to the city.
All service personnel assigned to work in the City of Hopkins shall be thoroughly
trained, oriented to the building areas, equipment and supplies used and methods to be

applied. At no time will the facilities be used as a trainina facilitv for new emplovees that
the contractor intends to furnish to another customer.
Contractor will furnish a list of equipment to be used and a complete list of all cleaning
supplies and/or chemicals. The list shall contain all safety features and chemical
compositions along with material safety data sheets. It shall be the contractor's
responsibility to keep material safety data files current at all times.
Contractor shall supply all equipment and cleaning supplies required to perform all
services contained in this specification. All equipment shall be in good mechanical
condition at all times. Any equipment deemed unsafe by the City Buildings
Superintendent shall be replaced immediately at no additional cost to the City of
Hopkins. The City of Hopkins will furnish:
1. Paper towels
2. Roll towels
3. Floor mats
4. Toilet tissue
5. Hand soap
6. Trash liners
It will be the contractor's responsibility to inventory these items each week and give this
list to the City Buildings Superintendent on the following work day.
C. Basic Services
1, Minimum responsibilities for RESTROOMS, LOCKERROOMS
LUNCHROOMS AND SINKS.
a. Daily, pick up all trash and empty waste and sanitary napkin disposal
containers, thoroughly clean containers.
b. Apply bowl cleaner to bowls and urinals as needed, but not less than once
per week.
c. Daily, using a aermicidal deteraent; wash down lavatory, traps, partitions,
doors, push plates, dispensers, urinals, toilet seats and bowls, and all
adjacent walls. Rinse and wipe dry.
d. Damp wipe and polish mirrors without streaking, shelves, tile walls and
entrance doors as needed, but not less than once per week.
e. Daily replenish toilet paper, towels, sanitary napkins and hand soap.
Leave one full roll of extra toilet paper in each restroom.
f. Daily sweep/dust then mop with detergent, not iust damp mop, and rinse.
Remove dirt in corners, crevices and at base of all fixtures.
g. 4X1yr machine scrub floors and mopboards with bristle pad. Clean all tile

walls with disinfectant cleaner and wipe dry.
h. 2X1yr shampoo and hot water extract all carpeted areas in
Bath/Locker-rooms.
NOTE: CONTRACTOR SHALL ASSUME THE LIABILITY FOR DAMAGE
CAUSED BY USE OF ABRASIVE MATERIALS OR ACID TO PLUMBING
FIXTURES OR HARDWARE. (See General Requirements).

2. Minimum responsibilities for OFFICES. CORRIDORS. OPEN AREAS.

a. Spot cleaning carpeting to remove spots and soiled areas, as needed.
b. Daily, all carpet areas shall be thoroughly vacuumed.
c. Daily, all floor tile shall be thoroughly dust mopped, and damp mopped.
d. Daily, all exposed work and counter areas shall be washed and dried
thoroughly.
e. All walls shall be spotted to remove all spots, stains and marks as needed.
f. Daily, remove all miscellaneous rugs, floor mats and shake out, vacuum
and replace.
g. Daily, empty all waste baskets, other trash and recycle receptacles. (The
City of Hopkins in all its buildings will be practicing a paper, can, glass and
plastic recycling program. It shall be the contractor's responsibility to
collect the recyclables and place in a proper collection bin.)
h. Clean partition glass, door glass including inside and outside entrance
glass, and viewing glass protectors, dust and clean all directories,
plaques, signs, pictures and fire extinguisher cabinets, as needed.
i. Daily, all drinking fountains shall be dusted, washed, disinfected and
dried.
j. Return all furniture to original positions upon completion of work.
k. Daily, all janitor closets must be cleaned of debris at the end of each day.
All supplies must be neatly stored.

NOTE: Item "D" Minimum Expectations
D. MINIMUM EXPECTATIONS.
For the purpose of these specifications, the following standards of performance
shall be considered Unacceptable.
. Dust and Dirt - The presence of dust, dirt or related material on vertical
and/or horizontal hard and soft surfaces to the degree that it is noticeable
and will mark either clothing or skin.
. Stains and/or Marks - The presence of stains and marks to the degree that
it is noticeable and alters the appearance of vertical and/or horizontal hard
and soft surfaces of items or furnishings.
. Litter and/or Refuse - The presence of litter and refuse on top of,
underneath or behind vertical and/or horizontal surfaces, furnishings or
fixtures.
. Sanitation - The condition of sanitation that will cause odor or create a
public hazard.
E. Exceptions to Specified Schedule.
. Public Works - Citv Hall - Not required on the following Holidays: New Years
Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day, the
day after Thanksgiving Day, Presidents Day, Martin Luther King Day,
Veterans Day, Christmas Eve Day and Christmas Day.
. Police Facilities - Cleaning is required 365 days a year, no exceptions.
III. TERMS AND CONDITIONS
A. Contractor's Service Reauirements
The Contractor agrees to provide comprehensive custodial services as described in
these specifications and proposals.
B. Contractor's Qualification
In order to qualify for this contract, a vendor must be able to demonstrate that he/she
has successfully performed services similar to those called for in this specification.
Such work must have been performed for a period of at least two (2) years prior to
submitting a proposal. A list of at least two (2) references must be submitted with the
proposal sheet.

C. Chanae in Scope of Contract
The City reserves the right to alter this contract because of building, area, task, or
budget changes. Changes shall be subject to thirty (30) calendar day's written notice to
the contractor for any changes.
Pricing submitted by the contractor shall remain firm for the initial contract period.
Pricing may be adjusted for each renewal period only.
D. Term of Aareement
The term of this agreement shall be for 1 year from the date of the signature by the
parties notwithstanding. The initial contract period will be for 1 year with 2 consecutive
12 month renewal periods. Three years total. The City of Hopkins, at its option reserves
the right to renew this contract for the successive twelve (12) month periods.
E. Penalty for Complete Non-Performance
Non-performance of anyone contractor on anyone section of this contract in terms of
the specifications shall be a basis for the termination of the contract by the City of
Hopkins upon seven (7) days written notice to the contractor.
F. Penalty for Partial Non.Performance
Partial non-performance of the contractor in terms of the specifications as determined
by the inspection(s) of the Building Superintendent shall entitle the City to assess
liquidated damages against the contractor as per the pro rated prices indicated in the
proposal(s).
The Contractor shall be liable for liquidated damages, upon a determination by the City
that performance has not occurred consistent with the provisions of the contract. The
City may deduct the full amount of any liquidated damages from any payment due to the
Contractor. The remedy available to the City under this paragraph shall be in addition
to all other remedies which the City may have under law or at equity.
G. Termination
This agreement may be terminated immediately by either party upon the other party's
failure to timely perform its responsibilities under the agreement. Otherwise, this
agreement may be terminated by either party in writing sixty (60) days prior to the end
of each twelve (12) month period. Upon termination by either party the Contractor shall
be paid for services rendered and reimbursable expenses until the effective date of
termination.
H. Method of Payment
The Contractor shall submit itemized bills for custodial services provided to the City on a
monthly basis. Bills submitted shall be paid in the same manner as other claims made
to the City. The Contractor shall provide documentation and reports as required.

I. Audit Disclosure
. The Contractor shall allow the City or its duly authorized agents reasonable access to
the Contractor's records as are pertinent to all services provided under this agreement.
Any reports, information, data, etc. given to, or prepared or assembled by the
Contractor under this agreement which the City requests to be kept confidential shall
not be made, by the Contractor to any other person or party without the City's prior
written approval. All finished or unfinished documents, data, studies, surveys, drawings,
maps, models, photographs, and reports prepared by the Contractor shall become the
property of the City upon termination of this Agreement.
J. Independent Contractor
At all times and for all purposes hereunder, the Contractor is an independent contractor
and not an employee of the City. No statement herein shall be construed so as to find
the Contractor to be an employee of the City.
K. Subcontractor
The Contractor shall not enter into subcontracts for any of the services provided for in
this Contract without the express written consent of the City. If consented to copies of
subcontract must be submitted to the City. At no time should more than 30% of the
contract be subcontracted.
L. Assignment
Neither party shall assign this contract, nor any interest arising herein, without the
written consent of the other party.
M. Services Not Provided For
No claim for services furnished by the Contractor not specifically provided for herein
shall be honored by the City.
N. Severability
The provisions of this Contract are severable. If any portion hereof is, for any reason,
held by a court of competent jurisdiction, to be contrary to law, such decision shall not
affect the remaining provisions of the Agreement.
O. Compliance with Laws and Regulations
In providing services hereunder, the Contractor shall abide by all statutes, ordinances,
rules, and regulations pertaining to the provisions of services to be provided hereunder.
Any violation shall constitute a material breach of this Agreement.

P. Governina Law
This contract shall be controlled by the laws of the State of Minnesota.
Q. Eaual Opportunity
During the performance of this contract, the Contractor, in compliance with Executive
Order 11246, as amended by Executive Order 11375 and Department of Labor
regulations 41 CFR Part 601 shall not discriminate against any employee or applicant
because of race, color, religion, sex, or national origin. The Contractor shall take
affirmative action to insure that applicants for employment are qualified, and that
employees are treated during employment, without regard to their race, color, religion,
sex, or national origin.
R. Waiver
Any waiver by either party of a breach of any provisions of this contract shall not affect,
in any respect, the validity of the remainder of this Agreement.
S. Indemnification
The Contractor shall indemnify and hold harmless the City, its employees and agents,
for all claims, damages, losses, and expenses including but not limited to, attorney's
fees, which they may suffer or for which they may be held liable, as a result of the fault
of the Contractor, his employees or subcontractors in the performance of this contract.
T. Insurance
Certificates of Insurance must be provided by the Contractor at the time of the contract
execution. The Contractor shall take out and maintain during the term of the contract
such public liability and property damage and automobile insurance as required, by the
City that shall protect him and the City from claims for such damages.
U. Conflict of Interest
Contractor agrees that no member, officer, or employee of the City shall have any
interest, direct or indirect, in this Contract of the proceeds thereof. Violation of this
provision shall cause this agreement to be null and void and the Contractor will forfeit
any payments to be made under this Contract.
V. Entire Contract
This Contract supersedes all oral agreements and negotiations between the parties
relating to the subject matter hereof as well as any previous agreements presently in
effect between the parties relating to the subject matter hereof. Any alterations,
amendments, deletions, or waivers of the provisions of this Contract shall be valid only
when expressed in writing and duly signed by the parties, unless otherwise provided
herein.

W. Contract Conditions
The City reserves the right to waive minor irregularities in the proposal documents and
to reject any or all proposals. The City reserves the right to enter into a Contract with a
Contractor who does not submit the lowest proposal.
The Contractor shall be required to execute the City's Contract form and to fulfill the
requirements contained within it. The certificate of insurance shall be provided when
the Contract is executed.
No proposal can be withdrawn before forty-five (45) days after the date for submission
of proposals.
The City reserves the right to execute contracts with different Contractors for each
specific proposal.

terms, conditions or obligation referring to the subject matter other than contained herein. This
Agreement may only be amended, supplemented, modified or cancelled by a duly executed
written instrument signed by both parties.
