COMPLETION OF REQUIRED IMPROVEMENTS- -PINES MOBILE HOME PARK
Proaosed Action
Staff recommends approval of the following motion: Move to advise the City Attorney to
provide the owner of the Pines Mobile Home Park with a letter concernin cg o npletion of required
improvements required in Hennepin County District Court File 93050019.
Overview
The owner of the Pines Mobile Homes Park is, by court order, required to make certain
improvements to his property, detailed by local ordinance. In May, the City Council approved the
action extending the period for completion of these improvements to May 1, 1996. In November,
the Council denied a recommendation by staff to allow for any further extension.
With denial of any further extensions, the City has the ability to ask the courts to enforce penalties
for noncompliance in completing the necessary improvements any time within the six -month
period after December 1. The owner of the park has requested a letter from staff stating the City
will hold off taking any legal action until the latter part of the six -month enforcement period.
This request is based upon the following:
Allow the owner to continue to explore the option of redevelopment of this site
Allow completion of improvements during more favorable weather conditions
Approval of the recommended action would provide authorization for the City Attorney to
provide a letter agreeing to delay the enforcement of sanctions until May 1, 1996, based upon the
parameters as detailed within this report.

• Upgrade electrical service to the park, including undergrounding two individual units
• Prepare and submit to the City a plan detailing the size and location of the parks water
and sewer piping system

Alternatives
The only impact of approving the proposed action is to delay the period for the staff to
contact the City Attorney's Office, approach Hennepin County Court, and take criminal
sanctions against the owner of the Pines Mobile Home Park.
The City Building Inspection Department has stated that none of the improvements
required to be completed at the Pines by the subject court order pose any immediate
danger to the public.
With approval of the subject action, the City would direct the City Attorney's Office to
provide a letter to the park owner, detailing the following:
• As of December 1, 1995, he is in violation of a court order for the subject
improvements
• As of May 1, 1996, one of the following will need to have occurred:
o Completion of required improvements
o Execution of a development agreement acceptable to the City
The City Council has the following alternatives regarding this matter:
Approve the action as recommended by Staff. With this action, the City Attorney will not
take any action concerning the enforcement of completion of improvements until May 1,
1996.
Continue the matter for additional information.
Advise staff to work with the City Attorney's Office to have Hennepin County District
Court take action against the owner of the Pines Mobile Home Park at a specified date
prior to May 1, 1996.
