Proposed Action.
Staff recommends the following motion: Move that Council adopt
Resolution 96 -14. Resolution Aporovina Petition for Fire Protection
System. 17 -8th Avenue South.
Adoption of this resolution will provide funding for a private sprinkler
system.
Overview.
The owner of property at 17 Eight Avenue South has revamped and upgraded
a sprinkler system in his remodeled place of business. The new system
has also been supplied with new monitoring equipment. This project was
undertaken to meet current building codes. The owner wishes to finance
the cost of this project under the City's fire protection program in
which funds are available to commercial businesses for such protection.
The owner has submitted a petition and proposal that totals $25,416.64.
Minnesota Statute 429 permits installation of fire safety related
0 devices and equipment to be installed and assessed to benefited
properties. The amount to be assessed is the total project cost together
with an administrative fee outlined in the City's Legislative Policy
#8C. Present policy is to charge 8% interest over a ten -year term.
Primary Issues to Consider.

The petition and proposal meet all policy and code criteria, and staff
recommends approval.
o Funding
This is the first 1996 project of this nature. By policy the City sets
aside $200,000 for a given calendar year for fire protection petitions.

PETITION AND WAIVER BY PROPERTY OWNER(S)
Dale Locomen, hereinafter called the Owner, states that he has ownership interest in property at
17 8th Ave. So.,• Hopkins, Minnesota, more commonly known as Hopkins Home Center and
particularly described as:
The north 30 feet of Lot 43 and all of Lots 44 and 45, Block 3, West Minneapolis,
and north 20 feet of Lot 42 and the south 20 feet of Lot 43, all in Block 3, West
Mumeapolis.
Said Owner hereby petitions the City of Hopkins to make the arrangements necessary to:
Place the cost of a fire protection system at 17 8th Avenue South as a
special assessment against the property, said cost estimated at $25,416.64.
Assess the cost over ten years at 8% per annum.
Charge an administrative fee of 5% or $100.00, whichever is greater.
Owner hereby waives any right to notice or objection to said improvement as provided in Chapter
429 of the Minnesota Statutes and any other provisions of municipal or state law providing for
notice or objections. Owner understands that the aforesaid property will be assessed for the costs
for the aforesaid work.

Dear Dale:
We are pleased to quote on time and material for revamping ex-
isting sprinkler system for above project. Our proposal includes
new valve assembly with changing piping and heads for remodel
areas. Approximately 10,0000 sq. ft. of space on upper floor and
10,000 sq. ft. of space on lower floor. Ceiling area will be
protected with chrome semi recessed type heads.
Design is based on latest edition of NFPA #13 which will be ap-
proved by City of Hopkins.
Falcon will provide necessary hangers for support of our piping
in accordance with NFPA #13. Falcon shall not be required to
furnish or install any material or device to improve the struc-
tural strength of the building to enable it to bear the load of
the fire protection system. In buildings where sprayed on fire-
proofing is used on building steel. Falcon will not be required
to repair fireproofing disturbed by hanger installation, nor
will be required to install hangers at any time other than
pipe installation.
This proposal is based on the assumption that all installation
to be performed is accomplished during normal work week hours.
Should it become necessary to perform any or all of the instal-
lation during other than normal work week hours, the Buyer
shall pay to the Seller the cost of the premium hours involved.
It is the responsibility of the Buyer to furnish a Materials and
Test Certificate covering hydrostatic test and flushing of the
underground piping to which proposed connection will be made
where Seller's work is to start.

Our proposed price for job on time and material approimately
SEVENTEEN THOUSAND to TWENTY SEVEN THOUSAND DOLLARS ($17,000.00
to $27,000.00).
Terms of Payment: 10% of selling price upon approval of instal-
lation drawings. 90% of our cost per month incurred on labor
and material performed at the job, with 10% retention until job
has been approved, or 30 days after completion; whichever comes
first.
This price is valid for thirty (30) days and, at our option, may
be withdrawn or considered void after this period.

RESOLUTION 96 -14
RESOLUTION APPROVING PETITION FOR A FIRE PROTECTION SYSTEM
17 -8th AVENUE SOUTH
WHEREAS, the owner of property located at 17 -8th Avenue South,
Hopkins, Minnesota, has petitioned for an improvement
consisting of the installation of a fire protection system
pursuant to Minnesota Statute No. 429.031, Subd.3; and
WHEREAS, the petition and accompanying documents thereto comply
with the requirements of the aforementioned statute.
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
HOPKINS, MINNESOTA:
1. Such improvement is hereby ordered as proposed and requested
in the petition.
2. That the Engineering Superintendent and Fire Marshal be
directed to review and approve the plans and specifications
accompanying the petition for the construction and
installation of the fire protection system.
3. That said installation and construction be in conformance
with Minnesota Statute Chapter 429 and all state and
municipal codes, ordinances and regulations pertaining
thereto.
4. That periodic inspections be conducted by the City of
Hopkins to assure compliance with said codes and
requirements.
Adopted by the City Council of the City of Hopkins this 20th
day of February, 1996.
