CR 96-42 CUP - Eisenhower ElementaryFebruary 29, 1996 - Council Report 96-42 CONDITIONAL USE PERMIT-- EISENHOWER ELEMENTARY Proposed Action. Staff recommends the following motion: Move to approve Resolution 96 -19 approving a conditional use permit to construct an addition at Eisenhower Elementary located at 1001 Highway 7. At the Zoning and Planning meeting Mr. Blair moved and Mr. Kinnich seconded a motion to approve Resolution RZ96 -3, recommending approval of a conditional use permit to construct an addition to Eisenhower Elementary. The motion carried unanimously. Overview. The Hopkins School District is proposing to construct a media center at the existing Eisenhower Elementary School located at 1001 Highway 7. This construction is part of the improvements to the schools throughout the district. In Hopkins, additions have been added to Katherine Curren and Alice Smith schools The proposed media center will be located on the northwest side of the existing building. The addition will be 5200 square feet and one story. Anderson, MCP Planner Primary Issues to Consider. o What is the zoning of the property, and how has the Comprehensive Plan designated the subject site? The property is zoned R -1 -D, Single Family Low Density. A school is permitted in residential districts with a conditional use permit. The Comprehensive Plan has designated the property school and public. o What are the specifics of the development? Landscaping 17 additional plantings will be added to the site. The ordinance requires five additional trees to be added. The proposed addition will be creating a courtyard for the school because the media addition will be closing up the northwest side of the building. City Engineer The Engineering department has reviewed the drainage plan and has found it acceptable. Fire Marshal The Fire Marshal has reviewed the preliminary plans and noted that a more detailed plan will have to be submitted that shows the access roads and hydrant locations. However, he sees no issues regarding the access roads and hydrants. Parking CR96 -42 Page 2 The media center is for the students attending the elementary school; the proposed media center will not generate a need for additional parking. Trash The trash pick - up will not be affected by the addition. Sidewalk The sidewalk will not be affected by the addition. Access The access to the existing building will remain the same. • Exterior The exterior will be a face brick to match the existing exterior. Setbacks The zoning ordinance requires a 50 -foot setback from any lot line. The addition is not near any lot line. Surrounding uses The addition will have open space to the west, Oak Ridge Golf course to the north, and the existing school building to the east and south. o What occurred at the Zoning and Planning meeting? Staff reviewed the proposal with the Commission. Tim Dufault, representing the School District, appeared before the Commission. Mr. Dufault answered various questions regarding the proposed addition. Mr. Dufault stated that they hope to start in April, and the entire building will be sprinkled after the remodeling. There was no one in the audience to speak on this issue at the public hearing. Alternatives. CR9b -42 Page 3 1. Approve the conditional use permit. By approving of the conditional use permit, the applicant will be able to construct the addition as proposed. 2. Deny the conditional use permit. By denying the conditional use permit, the applicant will not be able to construct the proposed addition as proposed. If the City Council considers this alternative, findings will have to be identified that support this alternative. 3. Continue for further information. If the City Council indicates that further information is needed, the item should be continued. Genellie, City Clerk CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO: 96 -19 RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A CONDITIONAL USE PERMIT TO CONSTRUCT AN ADDITION TO EISENHOWER ELEMENTARY WHEREAS, an application for Conditional Use Permit CUP96 -1 has been made by the Hopkins School District; WHEREAS, the procedural history of the application is as follows: 1. That an application for a conditional use permit, was made by the Hopkins School District on January 26, 1996; 2. That the Hopkins Zoning and Planning Commission, pursuant to mailed and published notice, held a public hearing on the application and reviewed such application on February 27, 1996: all persons present were given an opportunity to be heard; 3. That the written comments and analysis of City staff were considered; and 4. A legal description of the subject property is as follows: All of the following described tract which lies North of the centerline of Highway No. 7: That part of the West 247.5 feet of the West One Half of the Northeast One Quarter and that part of the Northeast One Quarter of the Northwest One Quarter, Section 24, Township 117, Range 22 lying North of the center line of Minnetonka Mills Avenue as shown on the plat of "WEST MINNEAPOLIS SECOND DIVISION ". NOW, THEREFORE, BE IT RESOLVED that the application for Conditional Use Permit CUP96 -1 is hereby approved based on the following Findings of Fact: 1. A school is permitted with a conditional use permit. BE IT FURTHER RESOLVED that application for Conditional Use Permit CUP95 -12 is hereby approved based on the following conditions: 1. That the Minnehaha Watershed District approves the proposed development. 2. That the site is developed and constructed as per the plans submitted. Charles D. Redepenning, Mayor
