CR 96-43 Comprehensive Plan Change - 530 11th Ave SFebruary 29, 1996 Council Report 96-43 COMPREHENSIVE PLAN CHANGE -- 530 11TH AVENUE SOUTH Proposed Action. Staff recommends the following motion: Move to approve Resolution 96 -20 approving amending the Comprehensive Plan land use designation for 530 11th Avenue South from a park to Industrial. At the Zoning and Planning meeting, Mr. Blair moved and Mr. Gullickson seconded a motion approve Resolution RZ96 -4, recommending approval to amend the Comprehensive Plan land use designation for 530 1 lth Avenue South from a park to Industrial. The motion carried unanimously. Overview. Diamond Laboratories was approved for a conditional use permit to construct an office/warehouse at 530 11th Avenue South. This property is the site of the former Hopkins Little League field. The Little League games have recently moved to a new complex at Maetzold field. The site is zoned industrial and designated in the Comprehensive Plan as a park. Although the site is designated as a park in the Comprehensive Plan, the site was a private park and not part of the City's park system. During the past year, the staff has been amending the Comprehensive Plan and zoning ordinance so both documents are the same. Primary Issues to Consider. o How is the area currently zoned and what has the Comprehensive Plan designated the subject area? o What types of uses are in the area surrounding the subject site? o What notification has the neighborhood received? o What is the staff recommendation? o What occurred at the Zoning and Planning meeting? The zoning of the site is I -1, Industrial. The Comprehensive Plan has designated the site as a park. o What types of uses are in the area surrounding the subject site? A majority of this area consists of industrial uses. o What notification has the neighborhood received? All property owners within 350 feet of the site were notified of the proposed amendment to the Comprehensive Plan. o What is the Staff recommendation? Staff would recommend that the Comprehensive Plan designation is changed for 530 1 lth Avenue South from a park to Industrial. The site is not a good location for a park. The site is surrounded by industrial land and not by residential property. In all other locations, a City park abuts some residential, which allows the homes surrounding a park to enjoy and use the park. The proposed project will also provide tax revenue for the City o What occurred at the Zoning and Planning meeting? Jim Kerrigan reviewed the action for the Commission. The Commission asked various questions of Mr. Kerrigan regarding the proposed project on the site Alternatives 1. Approve the Comprehensive Plan amendment. By approving the Comprehensive Plan amendment, the land use designation will be changed for 530 1 lth Avenue South from a park to industrial. 2. Deny the Comprehensive Plan amendment. By denying the Comprehensive Plan amendment, the land use designation will not be changed for 530 11th Avenue South. If the City Council considers this alternative, findings will have to be identified that support this alternative. 3. Continue for further information. Genellie, City Clerk CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO: 96 -20 RESOLUTION MAKING FINDINGS OF FACT AND APPROVING AN AMENDMENT TO THE COMPREHENSIVE PLAN WHEREAS, an application for an amendment to the Comprehensive Plan, ZN96 -3, has been made by the City of Hopkins; and WHEREAS, the procedural history of the application is as follows: 1. That an application for a Comprehensive Plan Amendment ZN96 -3 was made by the City of Hopkins on January 26, 1996. That the Hopkins Planning Commission, pursuant to published notice, held a public hearing on the application and reviewed such application on February 27, 1996: all persons present were given an opportunity to be heard. That the written comments and analysis of the City staff were considered. NOW, THEREFORE, BE IT RESOLVED that the application for Comprehensive Plan Amendment ZN96 -3 is hereby approved, based on the following Findings of Fact: 1. That the proposed amendment to the Comprehensive Plan is consistent with zoning and future land use of the subject property. BE IT FURTHER RESOLVED that application for Comprehensive Plan Amendment ZN96 -3 is hereby approved based on the following conditions: 1. That the Met Council approves the amendment. Charles D.
