CR 96-53 Adopt Legistlative Policy 4-C1 January 31, 1996 Proposed Action Staff recommends that the Council approve the following motion: Move that the Hopkins City Council approve Resolution #96-9, adopting Legislative Policy #4 -C. Adoption of this motion will establish regulations for the issuance of temporary 3.2 beer licenses. Overview In 1995, the City Council requested that City staff work with the Chemical Health Commission to establish a policy for regulating the issuance of temporary 3.2 beer licenses. Staff drafted a policy based upon suggestions of the Commission. This draft was reviewed by the City Council at its February 6 meeting. City staff drafted the policy and the Chemical Health Commission made suggestions for changes. Copies of the revised policy have been sent to all organizations which have received temporary 3.2 licenses in the past. The only organization to respond was St. Joseph's Church which said the policy was acceptable. • What changes have been made to the proposed policy? 1. The time limit of six hours has been dropped. Certain events last longer than six hours. 2. The limit of one license at a time to any one applicant has been dropped. The Council felt comfortable allowing the same organization to get licenses for more than one event. 3. Temporary licenses will be good for up to three days. This is the current policy. Each different location, however, will require a license. This will allow the Council to act on each location separately. 4. A standard method for checking IQs has been added. • What are the proposed regulations? 1. A temporary 3.2 beer licence is only in effect for six hours. 2. A temporary 3.2 beer license will be issued on a per event basis, each event not lasting more than three days, 3. Beer sales may only be conducted between the hours of 12:00 p.m. and 12:00 a.m. 4. 5. A separate license is required for each day-that location where beer is sold. 6. Application for a temporary 3.2 beer license must be received at least five weeks prior to the event. 7. Applicants for a temporary 3.2 beer license must be an organization whose principal location or office is within the City of Hopkins, has been located in Hopkins for at least two years, and has at least 30 active members. 8. Sales and /or consumption of beer will only take place in enclosed building or a fenced area. 9. Individuals under the age of 21 will not be allowed in any designated area where beer is sold or consumed, except if accompanied by a parent or guardian. Council Report #96 -53 Page 3 10.AI1 organizations which have a temporary 3.2 beer license must use the following method for checking identification to ensure that underage individuals do not purchase beer: Anyone wishing to purchase beer must have a either a drivers license, or a Minnesota ID with their picture. Individuals with the proper ID will have their hand stamped so that the actual sellers of the beer will not have to check IDs. If the event exceeds one day. a different color of ink must be used on subsequent days. 11. No temporary 3.2 beer license shall be issued in conjunction with a youth activity.' 12. The number of temporary 3.2 beer licenses issued in conjunction with all public events during any calendar year will be limited to twelve (12). 13. The City Council reserves the right to deny any 3.2 beer license at its sole discretion Alternatives: 1. Adopt Policy #4 -C as written. This would establish regulations and guidelines for the issuance of temporary 3.2 beer licenses. 2. Request additional revisions to Policy #4 -C. If the Council wishes to change the language in this policy, the policy can either be approved at this meeting with changes or brought back at a future meeting. 3. Do not adopt Policy #4 -C. Staff recommends Alternative #1. ' A "youth activity" is an activity that is designed primarily for individuals under the age of 18 II I or the majority of the participants are under the age of 18. 2 A "Public event" means an event where the public is invited or permitted to attend. Genellie, City Clerk CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO. 96-9 WHEREAS, the City Council of the City of Hopkins has approved a document entitled the Legislative Policy Manual to provide uniform guidelines on City policies so that actions taken are consistent and fair; and WHEREAS, additions and revisions to this manual may be implemented by resolution of the City Council; and WHEREAS, the Hopkins City Council has determined that a Legislative Policy needs to be created which will state the requirements for the issuance of temporary 3.2 beer licenses; NOW THEREFORE BE IT RESOLVED, that the City Council of the City of Hopkins hereby adopts the attached Legislative Policy #4 -C.
