CR 96-60 Prelim Plat - Justus LumberMarch 28, 1996 Proposed Action. Staff recommends the following motion: Move to approve Resolution 96 -30, approving a preliminary/final plat at the southwest corner of County Road 3 and 11th Avenue. At the Zoning and Planning meeting, Mr. Schumacher moved and Mr. Blair seconded a motion to approve Resolution RZ96 -5, recommending approval of a preliminary/final plat at the southwest corner of County Road 3 and 1 lth Avenue. The motion carried unanimously. Overview. The applicant, Jim Justus, is proposing to plat his property on the southwest comer of County Road 3 and 1 lth Avenue. The subject property currently consists of 11 parcels and, with this action, would be combined into two lots. Lot 2 will have the lumber company and former Country Kitchen property and Lot 1, the Holiday gas station. Hennepin County has been notified of the proposed plat. Hennepin County noted that in conjunction with the County Road 3 upgrade project, additional right -of -way along County Road 3 from the applicant's property will be required. Primary Issues to Consider o Does the proposed plat meet the zoning requirements? o Does the proposed plat meet the subdivision requirements? o Is a park dedication fee required? o What occurred at the Zoning and Planning meeting? Lot 1 is zoned B -3, General Business, and Lot 2 is zoned I -1, Industrial. The zoning of the properties will not change. Both lots will meet the minimum lot requirements. o Does the proposed plat meet the subdivision requirements? The plat as proposed meets the subdivision requirements. o Is a park dedication fee required? A park dedication fee is not required, because no additional lots are created. o What occurred at the Zoning and Planning meeting? The staff reviewed the proposed plat with the Commission. Staff noted that there are 11 parcels on the site currently. There are no plans to change the site at this time. Alternatives. 1. Approve the preliminary/final plat at the southwest corner of County Road 3 and 1lth Avenue. By approving of the preliminary/final plat, the subject area will be platted. 2. Deny the preliminary /final plat at the southwest corner of County Road 3. By denying the preliminary/final plat, the subject area will not be platted. If the City Council considers this alternative, findings will have to be identified that support this alternative. 3. Continue for further information. If the City Council indicates that further information is needed, the item should be continued. RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A PRELIMINARY/FINAL PLAT AT THE SOUTHWEST CORNER OF COUNTY ROAD 3 AND 11TH AVENUE SOUTH WHEREAS, an application for a preliminary/final plat approval, SUBD96 -1, has been made by Jim Justus; WHEREAS, the procedural history of the application is as follows: 1. That an application for a preliminary/final plat approval, SUBD96 -1, was made by Jim Justus on March 2, 1996; 2. That the Hopkins Zoning and Planning Commission, pursuant to mailed and published notice, held a public hearing on the application and reviewed such application on March 26, 1996: all persons present were given an opportunity to be heard; 3. That the written comments and analysis of City staff were considered; 4. A legal description of the subject property is as follows: Tracts A, B, C, D, E, F, G, H, I, J, and K REGISTERED LAND SURVEY NO. 1316, Files of the Registrar of Titles, Hennepin County, Minnesota. NOW, THEREFORE, BE IT RESOLVED that the application for preliminary/final plat approval, SUBD96 -1, is hereby approved based on the following Findings of Fact: That the proposed lots meet the minimum lot size for the I -1 and B -3 zoning districts.
