Staff recommends adoption of the following motion: Move that Council adopt Resolution 96 -35. Resolution for Adoption of the Assessment Roll Project 95 -16, Burnes Drive and Sweet Briar Lane Reconstruction. Staff also recommends adoption of the following motion: Move that Council adopt Resolution 96 -36, Resolution for Adoption of the Assessment Roll Project 95 -17 7th and 8th Avenues South Reconstruction and South Meadows Alley Reconstruction. Overview. Council at its March 19 meeting considered the proposed assessment roll for the 1996 residential street improvement projects and set an April 16 hearing date. This hearing sets in motion the special assessments to be levied against the properties adjacent to Burnes Drive, Sweet Briar Lane, 7th and 8th Avenues South and an alley in the South Meadows development. A public hearing notice has been published and mailed, along with an assessment statement, to every affected property owner. As of Thursday, April 11, ten appeals were submitted contesting the proposed assessments. Appeals must be submitted no later than the hearing date. Analysis. • Previous Sweet Briar petition At the initial public hearing concerning this project a Sweet Briar Lane resident raised an issue of earlier construction on Sweet Briar Lane, referring to the 1988 -89 Hobby Acres improvements. He posed the question why Sweet Briar Lane was not improved in its entirety, who had petitioned for the Hobby Acres project, and why residents on the remainder of Sweet Briar could not have the benefit of a 60 -40 split in their assessments today. Staff researched the Hobby Acres project and was able to discern that initially Hobby Acres and Campbell neighborhood residents were interested only in a street overlay project. When learning that the City would adhere to its roadway improvement policy and only participate in costs with its 60 -40 split with a reconstruction program, interest in the Campbell neighborhood waned. Hobby Acres residents petitioned for an engineering study to weigh advantages of reconstruction vs. overlay and eventually Council acted by super majority to order a public hearing and eventually a reconstruction project. Two regular lots and two corner lots adjacent to Sweet Briar are found in the Hobby Acres area. Three of these four lots were petitioners on the Hobby Acres petition. O Project costs The total amount to be assessed in both projects was derived from the low bidder tabulation and the revised Estimated Project Costs worksheet. The bid tabulation is organized according to schedules that reflect their funding sources. The worksheet then organizes the various improvement components to which contingency engineering, and admin. /legal costs are applied. Refer to these two sheets for detail. Council should be aware that at least one property owner has appealed the alley assessment. He claims the estimated alley assessment was misleading and that he was not properly informed of the real figure. The cost quoted in the feasibility study was arrived at erroneously. This error was rectified in documents used during the public hearing and at a subsequent neighborhood meeting. The owner did not get the revised information because he did not attend either of the above meetings. • Basis for assessment rates Once the residential 70% share of street reconstruction was determined, that amount was divided by the established total assessable footage in each project. In the case of the Burnes /Sweet Briar project an adjusted front footage was derived in which lot areas vs. total street length were used as determining factors. Maximum footages of 125 feet and minimum footages of 75 feet were applied. In the case of the Valley /Westbrooke East project residential lots were held to a maximum of 75 feet of actual footage. Condos and rental property as well as the alley project are being assessed for actual footage. 0 Appeal procedure Property owners are given the opportunity to approach Council with their appeals during the public hearing. Standard appeal forms have been available at City Hall and need to be submitted no later than the hearing date. Staff will make recommendations on all appeals. 0 Action on appeals Staff has received the following appeals as of this April 11 writing. Staff's recommendation is attached in each case: 1. Address: 326 Sweet Briar Lane Appeal for senior citizen deferment by reason of limited income. Recommendation: Grant appeal on basis that petitioner meets all qualifications for a senior citizen deferral. 2. Address: 715 7th Ave. So. Appeal for cancellation of assessment by reason of cost. Recommendation: Deny appeal on basis of benefit afforded by project. 3. Address: 930 6th St. So. Appeal for cancellation of assessment by reason that property does not abut the improved 8th Avenue and therefore does not receive benefit. Recommendation: Deny appeal on basis that owner has common interest in the parcel that does abut 8th Ave. and is therefore subject to his proportional share of any levied special assessments. 4. Address: 631 8th Ave. So. Appeal for cancellation of assessment by reason that street is not in need of repair and the cost of the assessment. Recommendation: Deny appeal on basis that pavement condition surveys and observed problems with grade and drainage indicate street reconstruction is necessary and that benefit commensurate with assessments will be afforded by the project. 5. Address: 621 8th Ave. So. Appeal for cancellation of assessment but no reason given for the request. Recommendation: Deny appeal for lack of support and that benefit is derived from the project. 10. Address: 727 -729 6th Ave. So. Appeal for revision of assessment by reason that the estimated alley assessment cost was quoted at $13.76 /front foot in the feasibility study when the assessment statement has quoted a cost of $35 /front foot. Recommendation: Deny appeal on the basis staff made effort to inform owners of revisions in estimated assessments and that actual costs need to prevail as the standard for setting an assessment rate. This hearing is scheduled pursuant to Minnesota Statutes Chapter 429. The assessment roll as herein described is on file in the office of the City Clerk. Sweet Briar Lane and Burnes Drive (Project 95 -16). Total Amount to be Assessed is $79,260.72 7th Avenue South from 7th to 8th Street South; 8th Avenue South from 6th to 7th Street South (Project 95 -17). Total Amount to be Assessed is $95,327.21 Alley east of 6th Ave. South, between 7th /8th Streets South (Project 95 -17A). Total Amount to be Assessed is $31,113.95 All persons who wish to be heard, or to object with reference to this matter may present their cases at this hearing, either orally or in writing. No appeal may be taken as to the amount of any assessment adopted unless a written objection signed by the property owner is filed with the Assessment Clerk prior to the assessment hearing or presented to the presiding officer at the hearing. Even though appeals are due by the hearing date on April 16, 1996, the City Clerk strongly recommends that appeals be submitted to the Assessment Clerk's office by April 10, 1996. Appeal forms will be available at the assessment hearing or at the Assessment Clerk's office at the Hopkins City Hall, 1010 1st Street South, Hopkins, Minnesota. An owner may appeal an assessment to district court pursuant to MSA Section 429.081 by serving notice of the appeal upon the Mayor or City Clerk of the City of Hopkins within thirty (30) days after the adoption of the assessment and by filing such notice with the district court within ten (10) days after service upon the Mayor and City Clerk. Under provisions of Minnesota Statutes Section 435.193 to 435.195 the City may, at its discretion, defer the payment of assessments for any homestead property owned by a person 65 years of age or older for whom it would be a hardship to make the payments. The procedures to apply for such deferment are available from the Assessment Clerk. Deferment applications should be submitted to the Assessment Clerk by April 10, 1996. The following information shall also apply: 1. The property owner shall have the right to prepay the entire assessment. Your assessment may be paid without interest from April 16, 1996 to May 16, 1996, to the Assessment Clerk at City Hall, 1010 1st Street South, Hopkins, Minnesota. You may at any time thereafter, pay to the Assessment Clerk the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made by November 27, 1996 or interest will be charged through December 31 of the succeeding year. 2. Partial prepayment of the assessment in excess of 25 percent of the total assessment has been authorized by ordinance. A partial prepayment can only be made prior to November 27, 1996 with interest accrued to the payment date, except that no interest shall be charged if such partial payment is made by May 16, 1996. 3. In the case where accrued interest applies, the rate of interest to be accrued, if the assessment is not prepaid within the required time period, is proposed to be 8 percent commencing on the date of adoption by the City Council. Assessments shall be payable in annual installments over a period of 10 years. 4. It is my understanding that this is only a street improvement project due to the degradation of the road. I believe the city has unfairly included the owners in the Westbrooke North community in this assessment. I have included a map for your reference to help show you the area. The Westbrooke North community does come up to 8th Ave S between 7th and 8th streets, but 8th avenue is not used for a direct or indirect access to the community. Our community has ample parking areas which are only accessible from 6th and 7th streets. The map clearly shows that all of the major artieries in the area (US Hwy. 169, 11th Ave. to downtown Hopkins, and 9th Ave towards OPUS) are easily accessible without the use of 8th avenue. There is no need for anyone coming to or leaving from Westbrooke North to access 8th avenue. Since the people of Westbrooke North do not need or use 8th Ave S. between 6th and 7th Streets they should not be part of the assessment for this improvement.
