Staff recommends the following motion: Move to approve Resolution 96 -42, approving a conditional use permit by Chapel View for signage at 605 and 615 Minnetonka Mvrlls Road. At the Zoning and Planning meeting, Mr. Brausen moved and Mr. Gleeson seconded a motion to approve Resolution RZ96 -6, recommending approval of new signs for Chapel View Apartments and Care Center. The motion carried unanimously. Overview. The applicant, Chapel View, is proposing new signage on their property. The Zoning Ordinance allows a maximum size of 12 square feet for uses in the residential district. However, the Zoning Ordinance allows signs up to 60 square feet with a conditional use permit for certain signs in the residential districts. Chapel View is proposing to construct two new signs, one for the care center and the other for the apartments. The existing signage will be removed. The signs will be visible from Minnetonka Mills Road. Primary Issues to Consider. o What is the zoning of the property? o What does the Zoning Ordinance require for signs in the residential district? o What are the specifics of the proposed signs? o What was the discussion at the Zoning and Planning meeting? CR96 -81 Page 2 Primary Issues to Consider. o What is the zoning of the property? The subject property is zoned R - 4, Medium High Density Multiple Family o What does the Zoning Ordinance require for signs in the residential district? Conditional use permit R District. Signs may be permitted by a conditional use permit for public parks and playgrounds, churches, synagogues, public libraries, public museums, public and parochial schools, municipal buildings, golf courses, country clubs, apartment buildings, nursing homes, community centers, colleges, universities and private schools, hospitals, and sanitariums, based on the following design criteria and other conditions the City Council may require: a) size: The size shall be proportional to the size of the facility, need for signing, frontage on street(s), location, visibility, and development in the area. The maximum size should not exceed 60 square feet per sign surface with a maximum area of 120 square feet per single sign. b) height: No free - standing sign shall exceed fifteen feet in height. c) lighting: 1) lighting shall be indirect or it shall be backlit 2) neon lighting, flashing lighting, and/or rotating lighted sign shall be prohibited. d) design: signs attached to the building shall be integrated with the building design and architecture in terms of materials, colors, lighting and placement; signs not attached to the buildings shall be architecturally treated and coordinated with the principal building by use of compatible materials and design. e) location: no free - standing signs shall be located less than 25 feet from any street right -of -way. f) sign purpose: the principal purpose of the sign permitted under this section shall be to identify the public or institutional use made of the property. o What are the specifics of the proposed signs? The proposed signs will be 38 square feet each. The signs will be illuminated and identify the care center and the apartments. There will be four lines of six -inch changeable copy on each sign. The signs will be made of metal and a plastic material. The proposed signs will be single faced. • CR96 -81 Page 3 The site plan, as submitted by the applicant, does not indicate the exact setback. The applicant has indicated that the proposed signs will have a 25 -foot or greater setback. The proposed signage by the applicant meets the requirements for a conditional use permit for signage in residential districts. o What was the discussion at the Zoning and Planning meeting? Ms. Anderson reviewed the proposed signage with the Commission. Steve Fritzke, representing Chapel View, appeared before the Commission. Mr. Fritzke stated that the existing signs are 25 years old and need replacing and that the new signs will improve the site. No one was in the audience to speak on this issue at the public hearing. Alternatives. 1. Approve the conditional use permit to erect signs for Chapel View Apartments and Care Center. By approving the conditional use permit to erect signs, Chapel View Apartments and Care Center will construct new signs. 2. Deny the conditional use permit. By denying the conditional use permit, Chapel View Apartments and Care Center will not be able to erect the signs as proposed. If the City Council considers this alternative, findings will have to be identified that support this alternative. 3. Continue for further information. That an application for a conditional use permit was made by Chapel View on March 18, 1996; James A. Genellie, City Clerk That the Hopkins Zoning and Planning Commission, pursuant to mailed and published notice, held a public hearing on the application and reviewed such application on April 30, 1996: all persons present were given an opportunity to be heard; That the written comments and analysis of City staff were considered; and 4. A legal description of the subject property is as follows: Commencing at the intersection of the northerly line of Minnetonka Mills Road and center line of Gethsemane Road thence northerly along said center line to the north line of southwest 1/4 of northeast 1/4 thence east to a point 164 feet west from the northeast corner thereof thence south 179.78 feet thence west 84 feet thence south to northerly line of Minnetonka Mills Road thence northwesterly to beginning except road. NOW, THEREFORE, BE IT RESOLVED that the application for Conditional Use Permit CUP96 -2 is hereby approved based on the following Findings of Fact: 1. The proposed signs meet the requirements of a conditional use permit. BE IT FURTHER RESOLVED that application for Conditional Use Permit CUP96 -2 is hereby approved based on the following conditions: 1. That the proposed signs have a 25 -foot minimum setback.
