CR 96-83 Street Improvements - 95-16
May 1, 1996 Assessment Hearing 1996 Residential Street Improvements Project 95 -16 Council Report 96 -83 Proposed Action. Staff recommends adoption of the following motion: Move that Council adopt Resolution 96 -35, Resolution for Adoption of the Assessment Roll, Proiect 95 -16, Burnes Drive and Sweet Briar Lane Reconstruction. Overview. At its April 16 meeting Council opened a public hearing concerning special assessments for street reconstruction on Burnes Drive and Sweet Briar Lane. Council heard assessment appeals but took no final action concerning them or the final adoption of the assessment roll. Council chose to continue the hearing and instructed staff to reinform property owners of the deferred assessment program and its procedures. Revised public hearing notices were mailed as well as a deferred assessment policy flier. Three appeals concerning this assessment have been submitted to date. Appeals must be submitted no later than the hearing date. Primary Issues to Consider. O Hearing procedures Staff recommends the following procedure in carrying out the assessment hearing: 1) Staff summary discussion of project costs, assessment rates, and the assessment appeal procedure. 2) Staff summarizes individual appeals and notes recommended Council action. 3) Public hearing is opened and property owners can make their case before Council. 4) Hearing is closed and Council acts on individual appeals. 5) Council adopts assessment roll by resolution. O Project costs and assessment rates The total amount to be assessed in both projects was derived from the low bidder tabulation and the revised Estimated Project Costs worksheet. The bid tabulation is organized according to schedules that reflect their funding sources. The worksheet then organizes the various improvement components to which contingency engineering, and admin. /legal costs are applied. Refer to these two sheets for detail. Once the residential 70% share of street reconstruction was determined, that amount was divided by the established total assessable footage in each project. In the case of the Burnes /Sweet Briar project an adjusted front footage was derived in which lot areas vs. total street length were used as determining factors. Maximum footages of 125 feet and minimum footages of 75 feet were applied. • Appeal procedures and action on appeals Property owners are given the opportunity to approach Council with their appeals during the public hearing. Standard appeal forms have been available at City Hall and need to be submitted no later than the hearing date. Staff will make recommendations on all appeals. Council had heard appeals at the opening of the hearing at the April 16 meeting and had taken preliminary action on them. When it became apparent that Council wished to continue the hearing, it rescinded its action and kept open final action on appeals submitted to that date as well as on future appeals. The following are appeals concerning Project 95 -16: 1. Address: 326 Sweet Briar Lane Assessed Amount $2,474.25 Appeal for senior citizen deferment by reason of limited income. • Recommendation: Grant appeal on basis that petitioner meets all qualifications for a senior citizen deferral. 2. Address: 331 Burnes Drive Assessed Amount $3,587.00 Appeal for cancellation of assessment by virtue that street's age precludes reconstruction. An overlay is recommended by the owner. Recommendation: Deny appeal on basis that pavement condition surveys and age of street indicate reconstruction is the most cost effective project to undertake. 3. Address: 323 Burnes Drive Assessed Amount $4,123.75 Appeal for cancellation /revision of assessment on basis that assessment at this time is unfair to new owners and that former owners should pay. Recommendation: Deny appeal on basis that City cannot know when real estate transactions will take place and that the City places assessments against land parcels and not individuals. 0 Adoption of the assessment roll Staff recommends passage of Resolution 96 -35 for adoption of the assessment roll. CITY OF HOPKINS Hennepin County, Minnesota NOTICE OF ASSESSMENT HEARING REVISED NOTICE IS HEREBY GIVEN that the City Council of Hopkins, Minnesota, will meet in the Council Chambers of the Hopkins City Hall, 1010 1st Street South, Hopkins, Minnesota at 7:30 p.m. on Tuesday, May 7, 1996, to reconvene a public hearing and to hear all persons concerning the adoption of the assessment roll for Public Improvement Projects 95 -16, 95 -17 and 95 -17A and to adopt the assessment roll as presented or amended. This hearing is scheduled pursuant to Minnesota Statutes Chapter 429 and continues a hearing opened on April 16, 1996. The assessment roll as herein described is on file in the office of the City Clerk. AREA TO BE ASSESSED: Sweet Briar Lane and Burnes Drive (Project 95 -16). Total Amount to be Assessed is $79,260.72 AREA TO BE ASSESSED: 7th Avenue South from 7th to 8th Street South; 8th Avenue South from 6th to 7th Street South (Project 95 -17). Total Amount to be Assessed is $95,327.21 AREA TO BE ASSESSED: Alley east of 6th Ave. South, between 7th /8th Streets South (Project 95 -17A). Total Amount to be Assessed is $31,113.95 All persons who wish to be heard, or to object with reference to this matter may present their cases at this hearing, either orally or in writing. No appeal may be taken as to the amount of any assessment adopted unless a written objection signed by the property owner is filed with the Assessment Clerk prior to the assessment hearing or presented to the presiding officer at the hearing. Even though appeals are due by the hearing date on May 7, 1996, the City Clerk strongly recommends that appeals be submitted to the Assessment Clerk's office by May 1, 1996. Appeal forms will be available at the assessment hearing or at the Assessment Clerk's office at the Hopkins City Hall, 1010 1st Street South, Hopkins, Minnesota. An owner may appeal an assessment to district court pursuant to MSA Section 429.081 by serving notice of the appeal upon the Mayor or City Clerk of the City of Hopkins within thirty (30) • days after the adoption of the assessment and by filing such notice with the district court within ten (10) days after service upon the Mayor and City Clerk. Under provisions of Minnesota Statutes Section 435.193 to 435.195 the City may, at its discretion, defer the payment of assessments for any homestead property owned by a person 65 years of age or older for whom it would be a hardship to make the payments. The procedures to apply for such deferment are available from the Assessment Clerk. Deferment applications should be submitted to the Assessment Clerk by May 1, 1996. The following information shall also apply: 1. The property owner shall have the right to prepay the entire assessment. Your assessment may be paid without interest from May 7, 1996 to June 6, 1996, to the Assessment Clerk at City Hall, 1010 1st Street South, Hopkins Minnesota. You may at any time thereafter, pay to the Assessment Clerk the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made by November 27, 1996 or interest will be charged through December 31 of the succeeding year. 2. Partial prepayment of the assessment in excess of 25 percent of the total assessment has been authorized by ordinance. A partial prepayment can only be made prior to November 27, 1996 with interest accrued to the payment date, except that no interest shall be charged if such partial payment is made by June 6, 1996. 3. In the case where accrued interest applies, the rate of interest to be accrued, if the assessment is not prepaid within the required time period, is proposed to be 8 percent commencing on the date of adoption by the City Council. Assessments shall be payable in annual installments over a period of 10 years. 4. The amount to be specially assessed against your property is shown on the statement of assessment sent to you by mail. This is an important hearing because this is your last opportunity to be heard on the matter of this assessment which affects your property. Because the hearing is being continued, your right to appeal your assessment is extended to the May 7 Council meeting. Assuming the assessment roll is adopted on May 7th, the period of time in which you can pay your special assessment without interest is now revised to May 7 -June 6 The Council wishes senior citizens to be aware that they may be eligible to use the City's deferred payment of assessment program. The program is available to owners 65 years of age or older whose annual income does not exceed $21,000. It is also available to citizens permanently or totally disabled regardless of age. The person seeking a deferment must supply income verification annually by submitting a federal income tax form, or written verification from the Social Security Agency, or a copy of the latest Social Security check. In the case of disability, verification must be submitted in the form of a physicians statement. Verification needs to be supplied before the closing of the assessment hearing on May 7. The deferment period is limited to 10 years and must be renewed annually. Deferred assessments accrue simple interest during the deferment period at a rate equal to the interest rate established for your special assessment. Fundamentally ,it is my opinion that, using acreage as the determining factor for modification of actual front footage for calculation of assessment amount is not valid. My reasons are as follows: (1) Benefits accrue to a property owner with any street improvement solely because of front footage, not because of the size of their yard. Quite simply, it has to do with length of road bed and length of curb. I would presume that most , if not all, projects of this type use front footage or, secondarily, number of property owners as criterion for setting assessment amounts. Using acreage should be reserved for ascertainment of total property value and consequently total real estate taxes. To use it for street improvements would appear to be an anomaly and quite inequitable. (2) This method results in diminishment of (assessable) front footage for a number of property owners and thus a subsidizing of a portion of their assessment by owners having less front footage. The argument was presented to me that using a method other than acreage would not be "fair" to the owners having smaller lots. This carries with it an assumption that the size of an owners lot is somehow linked to his ability to pay his share. Obviously, this premise is totally without merit. (3) In the case of my property, there are ten owners on the Proposed Assessment Roll having anywhere between 15% to 44% more Front Footage than I do and their proposed assessments are 22% to 39% less than my proposed assessment. One owner has 159% more frontage than I do and we both have the same proposed assessment. One can only conclude that the using acreage as the criterion has serious inequities. (4) In view of the above, I am urging that the City Council authorize recalculating the Assessment Roll using actual Lot Front Footage as Assessable Footage. If this is done, 14 owners would remain the same; 5 would increase; and 8 would decrease. One of those increasing would be a "double lot" having a 220.54 Front Footage which will show a significant increase. Directly across the street, roughly the same size parcel is divided into two lots and consequently two assessments that would be roughly equal to the new calculation for the "double lot ". This lot is a special case and was obviously being subsidized under the acreage formula. If this owner is to subsidized, the city should do it; not the property owners. Pik) .24 -in-22 14 oo' 3/S Burwas 2>c.,or Edward Glynn CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO. 96 -35 ADOPTION OF THE ASSESSMENT ROLL PROJECT 95 -16 WHEREAS, pursuant to proper notice duly given as, required by law, the City Council has met and heard and passed upon all objections to the proposed assessment for the reconstruction of streets and installation of utilities on Burnes Drive and Sweet Briar Lane as described in the files of the City Clerk as Project 95 -16, NOW, THEREFORE BE IT RESOLVED, BY THE CITY COUNCIL OF HOPKINS, MINNESOTA: 1. Such proposed assessment, as may be amended and a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of ten years, the first of the installments to be payable on or after the first Monday in January, 1997, and shall bear interest at the rate of 8 percent per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from May 7, 1996 until December 31, 1997. To each subsequent installment when due shall be added interest from one year on all unpaid installments. 3. It is hereby declared to be the intention of the Council to reimburse itself in the future for the portion of the cost of this improvement paid for from municipal funds by levying additional assessments, on notice and hearing as provided for the assessments herein made, upon any properties abutting on the improvement but not made, upon any properties abutting the improvement but not herein assessed for the improvement, when changed conditions relating to such properties make such assessment feasible. 4. To the extent that this improvement benefits non - abutting properties which may be served by the improvement when one or more later extensions or ATTEST: improvements are made, but which are not herein assessed, therefore, it is hereby declared to be the intention of the Council, as authorized by Minnesota Statutes Section 420.051, to reimburse the city by adding any portion of the cost so paid to the assessments levied for any of such later extension or improvements. 5. The clerk shall forthwith transmit a certified duplicate of the assessment to the County Auditor to be extended on the property tax lists of the County, and such assessments shall be collected and paid over in the same manner as other municipal taxes.
