Overview.
At its April 16 meeting Council opened a public hearing
concerning special assessments for street reconstruction on
7th /8th Avenues South and South Meadows Alley. Council heard
assessment appeals but took no final action concerning them or
the final adoption of the assessment roll. Council chose to
continue the hearing and instructed staff to reinform property
owners of the deferred assessment program and its procedures.
Revised public hearing notices were mailed as well as a deferred
assessment policy flier.
Eleven appeals concerning this assessment have been submitted to
date. Appeals must be submitted no later than the hearing date.

Analysis.
a Hearing procedures
Staff recommends the following procedure in carrying out the
assessment hearing:
1) Staff summary discussion of project costs,
assessment rates, and the assessment appeal
procedure.
2) Staff summarizes individual appeals and notes
recommended Council action.
3) Public hearing is opened and property owners can
make their case before Council.
4) Hearing is closed and Council acts on individual
appeals.
5) Council adopts assessment roll by resolution.
o Project costs and assessment rates
The total amount to be assessed in both projects was derived
from the low bidder tabulation and the revised Estimated
Project Costs worksheet. The bid tabulation is organized
according to schedules that reflect their funding sources.
The worksheet then organizes the various improvement
components to which contingency engineering, and admin. /legal
costs are applied. Refer to these two sheets for detail.
Once the residential 70% share of street reconstruction was
determined, that amount was divided by the established total
assessable footage in each project. In the case of the
Valley /Westbrooke East project residential lots were held to
a maximum of 75 feet of actual footage. Condos and rental
property as well as the alley project are being assessed for
actual footage.
0 Appeal procedure
Property owners are given the opportunity to approach Council
with their appeals during the public hearing. Standard
appeal forms have been available at City Hall and need to be
submitted no later than the hearing date. Staff will make
recommendations on all appeals.
Council had heard appeals at the opening of the hearing at
the April 16 meeting and had taken preliminary action on
them. When it became apparent that Council wished to
continue the hearing, it rescinded its action and kept open
final action on appeals submitted to that date as well as on
future appeals.
The following are appeals concerning Project 95 -17:
1. Address: 715 7th Ave. So.
Assessed Amount $3,262.50
Appeal for cancellation of assessment by reason of
cost.
Recommendation:
Deny appeal on basis of benefit afforded by project.
2. Address: 930 6th St. So.
Appeal for cancellation of assessment by reason that
property does not abut the improved 8th Avenue and
therefore does not receive benefit.
Recommendation:
Deny appeal on basis that owner has common interest
in the parcel that does abut 8th Ave. and is
therefore subject to his proportional share of any
levied special assessments.
3. Address: 631 8th Ave. So.
Assessed Amount $2,175.00
Appeal for cancellation of assessment by reason that
street is not in need of repair and the cost of the
assessment.
Recommendation:
Deny appeal on basis that pavement condition surveys
and observed problems with grade and drainage
indicate street reconstruction is necessary and that
benefit commensurate with assessments will be
afforded by the project.
4. Address: 637 8th Ave. So.
Assessed Amount $2,175.00
See No. 3 above.
5. Address: 625 8th Ave. So.
Assessed Amount $2,175.00
See No. 3 above.
6. Address: 645 8th Ave. So.
Assessed Amount $2,175.00
See No. 3 above.
7. Address: 633 8th Ave. So.
Assessed Amount $2,175.00
See No. 3 above.
8. Address: 621 8th Ave. So.
Assessed Amount $3,262.50
Appeal for cancellation of assessment but no reason
given for the request.
Recommendation:
Deny appeal for lack of support and that benefit is
derived from the project.
•
•
9. Address: 727 -729 6th Ave. So.
Assessed Amount $2,100.00
Appeal for revision of assessment by reason that the
estimated alley assessment cost was quoted at
$13.76 /front foot in the feasibility study when the
assessment statement has quoted a cost of $35 /front
foot.
Recommendation:
Deny appeal on the basis staff made effort to inform
owners of revisions in estimated assessments and that
actual costs need to prevail as the standard for
setting an assessment rate.
10. Address: 701 7th Ave. So.
Assessed Amount $2,175.00
Appeal for senior citizens deferment by reason of
limited income.
Recommendation:
Grant appeal on basis that petitioner meets all
qualifications for a senior citizen deferral.
11. Address: 716 7th Ave. So.
Assessed Amount $3,262.50
See No. 10 above.
o Adoption of assessment roll
Staff recommends passage of Resolution 96 -36 for adoption of
the assessment roll.

Under provisions of Minnesota Statutes Section 435.193 to

The following information shall also apply:
1. The property owner shall have the right to prepay the
entire assessment. Your assessment may be paid without interest

on the date of adoption by the City Council. Assessments shall
be payable in annual installments over a period of 10 years.
4. The amount to be specially assessed against your
property is shown on the statement of assessment sent to you by
mail.
This is an important hearing because this is your last
opportunity to be heard on the matter of this assessment which
affects your property. If you have any questions regarding this
assessment, please call the Engineering Department or the

April 22, 1996
Dear Hopkins Property Owner:
The City Council at its April 16 meeting took action to continue
the hearing concerning special assessments for an improvement
project affecting your property to May 7. Because the hearing is
being continued, your right to appeal your assessment is extended
to the May 7 Council meeting. Assuming the assessment roll is
adopted on May 7th, the period of time in which you can pay your
special assessment without interest is now revised to May 7 -June
6.
The Council wishes senior citizens to be aware that they may be
eligible to use the City's deferred payment of assessment
program. The program is available to owners 65 years of age or
older whose annual income does not exceed $21,000. It is also
available to citizens permanently or totally disabled regardless
of age. The person seeking a deferment must supply income
verification annually by submitting a federal income tax form, or
written verification from the Social Security Agency, or a copy
of the latest Social Security check. In the case of disability,
verification must be submitted in the form of a physicians
statement. Verification needs to be supplied before the closing
of the assessment hearing on May 7. The deferment period is
limited to 10 years and must be renewed annually. Deferred
assessments accrue simple interest during the deferment period at
a rate equal to the interest rate established for your special
assessment.
Please note the revisions to the attached hearing notice as shown
in bold type. Please call me or Robin Robertson, Assessing
Clerk, at 935 -8474 should you have any questions or would like to
appeal your assessment.
Sincerely,
awes Gessele

James A. Genellie
City of Hopkins City Clerk
1010 1st St. S.
Hopkins, M.J 55343
Mr. Genellie,
9 Apr, 1996
I am writing to you about the proposed assessment being levied on my home at
930 6th St. S. associated with street improvement project 95 -17. It is my understanding
that this is only a street improvement project due to the degradation of the road. I
believe the city has unfairly included the owners in the Westbrooke North community in
this assessment. I have included a map for your reference to help show you the area.
The Westbrooke North community does come up to 8th Ave S between 7th and
8th streets, but 8th avenue is not used for a direct or indirect access to the community.
Our community has ample parking areas which are only accessible from 6th and 7th
streets. The map clearly shows that all of the major artieries in the area (US Hwy. 169,
11th Ave. to downtown Hopkins, and 9th Ave towards OPUS) are easily accessible
without the use of 8th avenue. There is no need for anyone coming to or leaving from
Westbrooke North to access 8th avenue.
Since the people of Westbrooke North do not need or use 8th Ave S. between
6th and 7th Streets they should not be part of the assessment for this improvement. If
the city believes that there is a particuliar group in Westbrooke North that uses 8th
avenue then the city should assess those persons and not the whole community.

5. The clerk shall forthwith transmit a certified
duplicate of the assessment to the County Auditor to be
extended on the property tax lists of the County, and
such assessments shall be collected and paid over in
the same manner as other municipal taxes.
