Council Report 96 -90
Staff recommends the following motion: Move that Council adopt
Resolution 96 -46 Resolution Orderina Improvement After Public Hearing,
Allen Reconstruction, Proiect 96 -06.
This action continues an assessable improvement project in the #100
block between 12th and 13th Avenues South. Plans and specifications will
be developed for Council approval.
Council at its April 16 meeting considered and accepted a feasibility
report concerning the reconstruction of the above - referenced alley and
ordered a public hearing for May 21. Notices of this hearing have been
sent to all affected property owners. A public information meeting was
conducted April 30 for discussion of all improvement issues, estimated
costs and assessment policies.

The subject alley is one identified in a 1989 condition survey and the
1996 C.I.P. as one targeted for reconstruction. The feasibility study
identifies the alley as unimproved because of its non - uniform and
substandard asphalt depth of 1 to 1 1/2 inches. It is characterized as
having poor drainage patterns and numerous pothole patches. The property
at 1210 1st Street North has a garage encroaching upon alley right
right -of -way to a considerable degree that could have an adverse impact
on alignment or width of a reconstructed roadway.
The proposed reconstruction design calls for a 6" concrete pavement
section, 12 feet wide, with a "V" depression in the middle to facilitate
storm drainage. Restoration to abutting driveways will be with materials
in kind and turf establishment shall be with topsoil and seed. No sod
will be used.
Project costs to be assessed (80% of the project cost) are estimated at
$28,373.00. With a proposed assessable lineal footage of 915 feet this
translates into an assessment rate of $31.00. Single family residential
lots are proposed to have their assessable footage capped at 75 feet.

• Neighborhood issues
Staff held a project information meeting for the neighborhood residents
on April 30. Resident issues centered around concrete versus bituminous
surfacing, the City giving this alley a high priority for
reconstruction, and the question of cost savings with a narrower
reconstructed surface.
Staff reviewed the advantages of concrete over bituminous with the
following points made:
• Concrete construction allows very controlled grade to ensure
drainage.
• The level of maintenance of a concrete surface is significantly less
than bituminous.
Staff discussed the issue of priority by reviewing this alley's high
standing in the 1989 alley condition survey and the fact that
reconstruction now would be timely in light of planned 2nd Street South
upgrades in conjunction with the County Road 3 project. Some property
owners had concerns that special assessments at this time would have
adverse impact on their own plan to make property improvements.
Staff conceded there could be cost savings with a narrower 10 foot
alley - as much as $2.00 per front foot of adjoining property. Staff
also pointed out the impact a narrower concrete surface would have on

onto bituminous parking lots and driveways would tend to tear up the
bituminous at a faster rate.
A significant issue in this project is the encroachment of a residential
garage onto alley right -of -way. The garage is judged to be in some
disrepair and the owner approached City officials in 1995 for a permit
to repair the structure. A permit was denied on the basis of
encroachment. As it is located now, the garage requires some major alley
alignment shifts.
• Staff recommendation
Staff recommends that Council order the improvement made as proposed and
that plans and specifications be drawn up.

WHEREAS, the City Council of the City of Hopkins, Hennepin
County, Minnesota, deems it necessary and expedient that the
improvements hereinafter described be made,

hold a public hearing on said improvement at the following
time and place within the said City.

THE TOTAL ESTIMATED COST OF SAID IMPROVEMENT IS $35,467.00.
It is proposed to assess every lot, piece or parcel of land
benefited by said improvement whether abutting thereon or not,
based upon benefits received without regard to cash valuation.
Persons desiring to be heard with reference to the proposed
improvement should be present at this hearing.
This Council proposes to proceed under the authority granted by
Chapter 429 MSA.

CONCRETE ALLEY PAVING
CITY PROJECT NO. 96-06
April 11, 1996
The City of Hopkins' 1996 -2000 Capital Improvement Plan (CIP) includes an alley paving
project for each year within the plan. In the 1996 five -year Plan, staff determined that the alley
between 12th and 13th Avenues from CSAH 3 to 1st Street required an upgrade with concrete
paving due to the poor drainage and deteriorated condition of that alley. The City Council
reviewed these proposed alley paving improvements during their review of the CIP, and
subsequently authorized staff to begin the initial analysis of the improvement upon their approval
of the 1996 -2000 CIP.
Background
The alley bounded to the south by CSAH 3 and the north by 1st Street (between 12th and 13th
Avenues) is presently considered an unimproved alley Its surface consists of one to one and one
half inches of bituminous surface with less than adequate drainage characteristics. The
combination of a poor pavement section and inherent drainage problems has led to the increased
rate of deterioration of this alley. The result is that the alley has developed severe cracking and
potholes in recent years, increasing maintenance and other associated problems.
Proposed Improvementt
The proposed alley improvement project is presented on Exhibit 1, attached. The project
provides for the construction of a concrete pavement surface 12 feet wide and 6 inches thick, in
accordance with the City of Hopkins' concrete alley construction standard. The improvements
proposed under the CSAH 3 project, south of 2nd Street South, will be designed to accommodate
the storm drainage requirements of the proposed alley and its entire drainage area. The existing
bituminous parking areas will be sawcut and restored with bituminous driveway pavement upon
completion of the concrete alley paving. The will be no sod restoration within the limits of this
project. Any turf restoration required by the project will be accomplished with black dirt and
seed.
The concrete alley paving will consist of an inverted crown section, which is slightly depressed
in the center to allow storm runoff within the alley section versus ponding in the adjacent
properties. The pavement grade will be established to direct the runoff to the proposed CSAH 3
storm sewer which will be located at the south end of the proposed alley.
It is anticipated that all new alley construction will be limited to the existing 14 foot right of way;
however, driveway and parking lot restoration will extend up to two feet beyond the limits of the
existing public right of way. The construction will also require the replacement of the concrete
apron at the north end of the alley. with its intersection with 1st Street.

It is proposed that the concrete pavement project be assessed in accordance with the City of
Hopkins' current assessment policy, wherein 80% of the cost is assessed to abutting properties
and 20% is funded as a City cost. It is further proposed that the City's portion of the costs be
paid entirely from the stone sewer utility fund, in accordance with City policy.
It has been determined that the fairest method to assess this project is on a linear footage basis.
A summary of the estimated costs and a preliminary assessment calculation are provided below:

Recommendations
It is recommended that the City consider completing this alley paving project in conjunction with
anticipated parking lot paving in any areas adjacent to the proposed alley. This would allow
construction to occur concurrently and reduce the possibility of damage to the new alley by
construction traffic in the near future.
The concrete alley paving project is technically feasible from an engineering standpoint and it is
recommended that the City Council accept the project engineer's feasibility report as outlined
herein, and order the improvement made, subsequent to holding a public hearing. Addended to
the end of this report is a summary of the estimated construction costs and a preliminary project
schedule for the City Council's consideration.

WHEREAS, a resolution of the City Council adopted the 16th day of
April, 1996, fixed a date for a Council hearing on the
proposed improvement of an alley in the #100 Block
between 12th /13th Avenues South, and
WHEREAS, the City Council deems it appropriate and expedient to
reconstruct the alley with concrete pavement, and
WHEREAS, ten days mailed notice and two weeks published notice of
the hearing was given, and the hearing was held thereon the
