CR 96-098 CUP - Oaks Of MainstreetMay 29, 1996 Proposed Action CONDITIONAL USE PERMIT-4M OAKS OF MAINSTREET Council Report 96 -98 Staff recommends the following motion: Move to approve Resolution 96 -50. approving a conditional use permit to construct 66 townhomes on the southeast corner of Shady Oak Road and Mainstreet. At the May 28 Zoning and Planning meeting, Mr. Blair moved and Mr. Schumacher seconded a motion to approve Resolution RZ96 -10, recommending approval of a conditional use permit to construct 66 townhomes on the southeast corner of Shady Oak Road and Mainstreet. Overview The applicant is proposing to construct 66 townhomes on what is currently the Pines Mobile Home Park, located on the southeast corner of Mainstreet and Shady Oak Road. The applicant is proposing ten, six -unit buildings. The buildings will be a variety of one and two story units. The subject site will have to be rezoned in order for the proposed development to occur. The site is currently zoned R -4, Medium High Density Multiple Family. The zoning that will allow townhomes is R-2, Low Density Multiple Family. The applicant will be requesting a rezoning at a future meeting. Primary Issues to Consider o What is the zoning of the property, and how has the Comprehensive Plan designated the subject site? o What are the specifics of the development? o What occurred at the Zoning and Planning meeting? o What is the staff recommendation regarding the sidewalk on Mainstreet west of the ingress/egress? Supporting Documents o Analysis of Issues o Resolution 96 -50 o Site Plans Nancy SLAnderson, AICP • Planner • • Primary Issues to Consider o What is the zoning of the property, and how has the Comprehensive Plan designated the subject site? The property is zoned R-4, Medium High Density Multiple Family. The applicant in the future will be requesting a rezoning to R -2, Low Density Multiple Family, for the construction of the townhomes. The Comprehensive Plan has designated the property as medium density residential. The R -2 designation will be consistent with the Comprehensive Plan designation. Any approval of the conditional use permit will be contingent that the site is rezoned. o What are the specifics of the development? Building types The following are the number and types of units: Two story units - two bedrooms 28 One story units - two bedrooms 12 Two story units - three bedrooms 20 One story units - three bedrooms 6 TOTAL UNITS 66 All the units will also have basements. Landscaping Stormwater, Grading and Drainage CR96 -98 Page 2 The landscape plan indicates 138 plantings at the required size. Additional plantings will be added to the site. The ordinance requires 97 trees on the site. The site plan also indicates a six -foot wrought iron fence surrounding the property The Engineering Department has reviewed the drainage, stormwater and grading plan and has found the plan submitted acceptable with the condition that the Engineering Department approve a final plan. At this time the site will not have an underground stormwater system because none is available for a connection. In the future, when Shady Oak Road is reconstructed, a stormwater system will be available for the site to connect. The applicant meets the requirements of the City's stormwater ordinance. The Nine Mile Watershed District will also have to approve the development. • Fire Marshal The Fire Marshal has reviewed the preliminary plans and has found them acceptable. The Fire Marshal did note that there will be no parking on the main road around the site. This is necessary because the road as proposed is only 20 feet wide. Parking Each unit will have a garage for parking two vehicles. In addition to the garages, there will be 22 spaces on the site and parking in front of the garages. The Zoning Ordinance requires two parking spaces for each unit. The proposed development has more than the required parking. Trash Each unit will collect its own trash. Sidewalk The site plan does not indicate a continuation of the sidewalk along Mainstreet Staff is recommending a sidewalk to the west of the ingress/egress along Mainstreet when the development is being constructed. When Shady Oak Road is reconstructed there may be a sidewalk and/or a bike path added on the west side of the site. Ingress /egress Ingress and egress point to the site will be from Mainstreet The ingress and egress points are slightly to the east of the centerline of 20th Avenue. The intent of moving the ingress and egress points slightly to the east of 20th Avenue is to prevent a vehicle exiting the site from using 20th Avenue as a shortcut to Shady Oak Road and avoiding the stop light. Exterior CR96 -98 Page 3 The proposed exterior will be four and eight inch vinyl clapboard siding. The windows will be vinyl. These surfaces are a no- maintenance exterior. Setbacks The following are the required and proposed setbacks for the proposed development: Front yard Side yard north Side yard south Rear yard Required Proposed 30 feet 30 feet 15 feet 15 feet 15 feet 15 feet 25 feet 25 feet • Signage CR96 -98 Page 4 The proposed site plan indicates five signs on the site. These signs are located on each comer and at the entrance of the site. The proposed signs are approximately 12 square feet. The Zoning Ordinance with an R -2 zoning allows one, two- square -foot sign; however, with a conditional use permit the applicant may be allowed one sign up to 60 square feet. If the applicant wants more than one sign for the site, a variance will have to be requested. Easements The survey supplied by the applicant indicates that no easements have been granted to the City or County for the surrounding streets. Staff is recommending that as part of the approval for the conditional use permit, the applicant is required to grant the City and County easements for road purposes for 19 Avenue, Mainstreet and Shady Oak Road. Surrounding uses The site is surrounded by commercial uses on the north and west sides and residential on the east and south. o What occurred at the Zoning and Planning meeting? Ms. Anderson reviewed the applicant's proposal. Chuck Liddy, the architect, appeared before the Commission. Mr. Liddy reviewed the site plan with the Commission. Mr. Liddy stated that all the units will have basements that can be a future bedroom or family room. Mr. Liddy also asked the Commission if the sidewalk on Mainstreet could be completed once Shady Oak Road is upgraded. There was considerable discussion regarding the sidewalk on Mainstreet. Mrs. Kinnich wanted a sidewalk for safety reasons. The Commission added a condition to the Resolution that the applicant would not have to construct the sidewalk on Mainstreet until Shady Oak Road is reconstructed. The Commission also discussed the proposed fence for the site. The Commission is reserving the right to review the final fence design once it has been determined. Mr. Liddy also discussed the signage for the site. Ms. Anderson noted that the applicant will have to request a variance and a conditional use permit for all the signage the applicant is proposing. No one spoke at the public hearing regarding this issue. o What is the staff recommendation regarding the sidewalk on Mainstreet west of the ingress/egress? Staff is recommending that the sidewalk on Mainstreet is completed at the time the project is developed. The reason for this reconunendation is the uncertainty of timing with the reconstruction of Shady Oak Road. It could be six or seven years before Shady Oak Road is reconstructed. • Alternatives CR96 -98 Page 5 1. Approve the conditional use permit. By approving the conditional use permit, the applicant will be able to construct townhomes after the site is rezoned. 2. Deny the conditional use permit. By denying the conditional use permit, the applicant will not be able to construct the townhomes as proposed. If the City Council considers this alternative, findings will have to be identified that support this alternative. 3. Continue for further information. If the City Council indicates that further information is needed, the item should be continued.
