Proposed Action.
Staff recommends the following motion: Move that Council adopt
Resolution 96 -29, Resolution Ordering Improvement After Public
Hearing - Alley Reconstruction, Proiect 96 -05,
This action continues an assessable improvement project in the
#10 -#100 block south of Mainstreet between 6th and 7th Avenues
South. Plans and specifications will be developed for Council
approval.
Overview.
Council at its March 6 meeting considered and accepted a
feasibility report concerning the reconstruction of the
above- referenced alley and ordered a public hearing for April 2.
Council opened that hearing and continued it to April 16 to learn
more of a proposed partial vacation of the valley. At the
continued hearing on April 16 Council authorized staff to
investigate vacation procedures as a means to reduce the scope of
the alley project and thus lower overall costs. Subsequently,
Council ordered a public hearing concerning a vacation before
taking any further action on a reconstruction project.

Analysis.
0 Vacation procedures
A vacation hearing notice has been published twice in the
local newspaper. Notices have been mailed to all affected
residents and owners within a 350 -foot radius of the site.
Council will have conducted a public hearing in advance of
action to order this alley project and will have in fact
taken action to approve or deny a vacation ordinance for
first reading.
In tandem with the vacation hearing notices, staff also
mailed a notice concerning the continued hearing on the alley
reconstruction project.
0 Hopkins Village Apartments proposal
A representative for the Hopkins Village apartments proposed
at the last hearing session that the length of concrete alley
reconstruction be shortened by as much as fifty feet near the
end adjacent to the Village parking lot. This was offered by
reason that the existing bituminous alley on the Village
property would more closely match the parking lot and
considerable assessments would be spared against the Village
owners if construction adjacent to their property was
curtailed.
Staff's opinion is that it would be a mistake not to place a
concrete surface in the last fifty feet of the alley leading
to the parking lot. The last fifty feet of alley is strictly
that and cannot be construed to be a part of the parking lot.
This last short segment of alley is in disrepair and should
be treated in the same manner as proposed for the other
segments of deteriorated roadway.

conditions:
1. Reconstruct the alley as proposed in the
feasibility study except for that portion adjacent
to Lot 18 which is to be vacated.
2. Address property owners concerns adjacent to
vacated valley over drainage issues as plans are
drawn up.

You are hereby notified of a continuation of a public hearing
concerning the reconstruction of the alley in the #10 -#100 block
between 6th /7th Avenues South. Council at its April 16 meeting
discussed an alternate proposal to the scope of reconstruction by
vacating a portion of the south segment of the alley. Council has
ordered a public hearing to consider the alley vacation and a
notice is enclosed in this mailing. That hearing is scheduled for
June 4, 7:30 p.m., at City Hall. Immediately thereafter the
hearing concerning alley reconstruction will be conducted.
If you wish to convey any concerns or bring up issues relative to
this alley vacation or reconstruction, you are urged to attend
the June 4 Council session.

CONCRETE ALLEY PAVING
CITY PROJECT NO.96 -05

The 1996 -2000 Capital Improvement Plan (C.I.P.) includes an alley - paving project for each
year of the five -year plan. The 1996 plan identified two alleys that staff determined were
necessary to upgrade with concrete paving due to the high maintenance and drainage
problems associated with them. The City Council reviewed these proposed alley- paving
projects during their review of the C.I.P., and subsequently authorized staff to begin the initial
analysis of these projects upon their adoption of the C.I.P.
Background
The "t" alley bounded by Mainstreet/2nd Street South and 6th/7th Avenues South is presently
considered an unimproved alley. Its surface consists of a 1 to 1.5 inch asphalt layer that has
poor drainage characteristics. The combination of the thin asphalt layer and the poor drainage
patterns have resulted in this alley developing may potholes over the years, thereby
substantially increasing maintenance and other associated problems.
Proposed Design
The proposed alley improvement project provides for the construction of a concrete pavement
surface 12 feet wide and 6 inches thick in accordance with the City of Hopkins' improvement
policy. The existing concrete alley aprons located on 7th Avenue South and 6th Avenue South
are in good condition and will not need to be replaced. Driveway aprons will be paved
between the new alley surface and the paved driveways with similar material at the top
surface of the driveway. Gravel will be placed in driveway openings in all situations other than
matching concrete or asphalt driveways. There will be no sod restoration on this project. Black
dirt and seed will be placed in all disturbed turf areas along the alley.
The pavement will include a "V" design, slightly depressed in the middle, to channel water
toward the middle of the alley instead of toward adjacent properties. It is also proposed that
the pavement grades be established to direct the drainage to the existing storm sewer
systems located in the current alley and in 7th Avenue South.
Currently, the City of Hopkins is encroaching on private property in this alley with its garbage
collection and snow - plowing operations (Addr: 53 7th Avenue South). It is intended to acquire
an easement over a portion of this lot to allow for city vehicles to maneuver the alley corner
safely. This same lot has drainage problems that can be resolved by making alley grade
changes. Nevertheless, items for an extra catch basin and 8" PVC storm sewer are included in
the preliminary cost estimate as an alternative.
• The concrete paving will stop short of the parking lot and its driveway lane adjacent to the
Hopkins Village Apartments. The fall in grade from the parking lot to the alley is more than
adequate to accommodate proper drainage. Transition from concrete to bituminous will be
provided.
Proposed Funding
• It is proposed that the concrete pavement portion of the project be assessed in accordance
with city policy, 80% against abutting benefited properties and 20% against the City of
Hopkins. It is further proposed that the City's share of the project be paid entirely from the
storm sewer utility fund in accordance with city policy.

It has been determined that the fairest method to assess this project is on a lineal footage
basis. It has been further determined that the maximum lineal footage assessment for two
residential corner lots and one over -sized 150 foot residential lot will be based on 75 lineal
feet. A summary of the estimated costs and assessments are provided below.

Recommendation
This concrete alley paving project is technically feasible from an engineering standpoint and it
is recommended that the City Council accept the project engineer's feasibility report as
outlined herein, and order the improvement made, subsequent to holding a public hearing.

RESOLUTION ORDERING IMPROVEMENT AFTER PUBLIC HEARING
ALLEY RECONSTRUCTION
PROJECT 96 -05
WHEREAS, a resolution of the City Council adopted the 6th day of
March, 1996, fixed a date for a Council hearing on the
proposed improvement of an alley in the #10 -#100 Block
between 6th /7th Avenues South, and
WHEREAS, the City Council deems it appropriate and expedient to
reconstruct the alley with concrete pavement, and
WHEREAS, ten days mailed notice and two weeks published notice of
the hearing was given, and the hearing was held thereon the
2nd day of April, 1996 and continued to June 4, 1996 at
which all persons desiring to be heard were given an
opportunity to be heard thereon,
NOW, THEREFORE BE IT RESOLVED by the City Council of Hopkins,
Minnesota:
1. Such improvement is hereby ordered as proposed in the
Council resolution adopted the 6th day of March, 1996.
2. Plans should be amended to omit any reconstruction of the
alley lying within the proposed alley vacation adjacent to
Lot 18, Block 2, West Minneapolis.
3. The City's engineer is hereby designated to prepare plans
and specifications for the making of such improvement.
Adopted by the City Council of the City of Hopkins this 4th
day of June, 1996.
