Staff recommends the following motion Move that Council adopt Resolution 96 -54 Resolution Approvina Petitions fpr Private Improvements at 114 12th Avenue South 105 13th Avenue South, and 115 13th Avenue South. This action approves of private parking lot improvements at properties adjacent to an alley proposed to be reconstructed. Overview. Three property owners adjacent to the alley in the #100 block between 12th /13th Avenues South have stated their intent to make parking lot improvements in conjunction with the reconstruction of the alley. They have requested that alternate bid items concerning their projects be included in the alley project bidding process. If the bids are to their satisfaction, it is their understanding the private costs will be allowed as a special assessment against their property. Three individual petitions have been submitted. Primary Issues to Consider o Are the petitions valid? Staff has examined the three documents and finds them in proper form. Staff recommendation. Staff recommends approval of the three petitions for parking lot improvements. • CITY OF HOPKINS PETITION AND WAIVER BY PROPERTY OWNER(S) Cecil M. Kloss, hereinafter called the Owner, states that he has ownership interest in property at 115 -13th Ave So., Hopkins, Minnesota, particularly described as: Lots 15 and 16, Block 9, West Minneapolis, according to the plat on file and of record in the office of the County Recorder, Hennepin County, Minnesota. Said Owner hereby petitions the City of Hopkins to make the arrangements necessary to: 1. Remove existing deteriorated bituminous surface from a parking lot at 115 -13th Avenue South, regrade the lot, provide an aggregate base and resurface with a 3" thick bituminous surface. This work should be done in conjunction with planned alley improvements. 2. Arrange to place the cost of the parking lot improvements as a special assessment on the property at a rate of 8% over 10 years. The Owner hereby waives any right to notice or objection to said improvement as provided in Chapter 429 of the Minnesota Statutes and any other provisions of municipal or state law providing for notice or objections. The Owner understands that the aforesaid property will be assessed for the costs for the aforesaid work. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HOPKINS, MINNESOTA: 1. Such improvements are hereby ordered as proposed and requested in the petition. 2. That the Engineering Superintendent be directed to include the plans and specifications for construction and installation of the parking lots in the bid documents of the pending alley reconstruction project. 3. That said installation and construction be in conformance with Minnesota Statute Chapter 429 and all state and municipal codes, ordinances and regulations pertaining thereto.
