Subject: Second Reading Alley Vacation Ordinance,
#104100 Block 6th/7th Aves South
Attached you will find Ordinance 96 -784 for second reading. Adoption of this ordinance
vacates certain portions of the alley in the 10 -100 block between 6th/7th Avenues
South. During the first reading and subsequent to that hearing staff has received no
objections or comments concerning the vacation. Council should note that the City
Attorney has revised the ordinance as to form to facilitate its recording against the two
adjoining properties to the vacation. The revised ordinance precludes easement
documents being drawn up.
Staff recommends adoption of Ordinance 96 -784 for second reading and final adoption
and ordered published.

AN ORDINANCE VACATING A PART OF THE PUBLIC ALLEY IN
BLOCK 2, WEST MINNEAPOLIS, HOPKINS, MINNESOTA
THE COUNCIL OF THE CITY OF HOPKINS DOES HEREBY ORDAIN AS FOLLOWS:
That certain part of a public alley as hereinafter described
is hereby vacated:
The north one -half and the south one -half of the alley in
Block 2, West Minneapolis, lying between the southerly
extensions across it of the east and west lines of Lot 18
in said Block 2, said plat on file and of record in the
office of the County Recorder, Hennepin County,
Minnesota.
Subject to reservations in favor of the City of Hopkins
of easements for storm drainage and public utility
purposes including right of entry for repair, replacement
and maintenance purposes over, across and upon the north
one -half and the south one -half of said vacated alley
described as follows:
The South one -half of the alley in Block 2,
West Minneapolis, lying between the southerly
extensions across it of the east and west
lines of Lot 18 in said Block 2, said plat on
file and of record in the office of the County
Recorder, Hennepin County, Minnesota.

RESOLUTION 96 -51
RESOLUTION MAKING FINDINGS OF FACT AND APPROVING AN ALLEY
VACATION IN BLOCK 2, WEST MINNEAPOLIS
WHEREAS, the City Council of Hopkins, Minnesota, has
determined to vacate a part of the alley in Block 2, West
Minneapolis, bounded on the north and south by Mainstreet and 2nd
Street South, and bounded on the east and west by 6th Avenue and
7th Avenue South, and
WHEREAS, a public hearing was held on June 4, 1996 before the
City Council in the City Hall after due published and posted notice
had been given by the clerk on May 15 and 22, 1996, a reasonable
attempt was made to give personal notice to all affected property
owners, and all persons interested were given an opportunity to be
heard, and
WHEREAS,, it appears that it will be in the best interest of
the public and the City to vacate a part of said alley, and
WHEREAS, existing utility easements require a reservation in
favor of the City of Hopkins of easements for storm, drainage and
public utility purposes over, across and upon said alley, and
WHEREAS, four - fifths of all members of the City Council concur
in this resolution;
NOW, THEREFORE, BE IT RESOLVED, that the part of the alley
described as follows is hereby vacated:

alley in Biock 2, West Minneapolis, lying between the
southerly extensions across it of the east and west lines
of Lot 18 in said Biock 2, said plat on file and of
record in the office of the County Recorder, Hennepin
