CR 96-171 CUP - Arts Facility• • October 31, 1996 Supporting Documents. o Analysis of Issues. o Site Plans. o Resolution 96 -90. 1 Y 0 c e K Council Report 96 -171 CONDITIONAL USE PERMIT- -ARTS FACILITY Proposed Action. Staff recommends the following motion: Move to approve Resolution 96 -90. approving a conditional use permit to construct the arts facility between 1 lth and 12th Avenues, abutting Mainstreet. At the October 29, 1996, Zoning and Planning meeting, Mr. Blair moved and Mr. Engel seconded a motion to approve Resolution RZ96 -17. The motion carried unanimously. Overview. The Hopkins HRA is proposing to construct a 34,400 - square -foot arts facility on the north side of Mainstreet between 11th and 12th Avenues. The arts facility will be a multi - function building and contain the following features: o 742 seat theater with a balcony o 2,980 square foot proscenium stage o visual arts gallery o multi - purpose community performance and recital hall o multi - purpose space designed for rehearsals and community activities o dance studio o open -air plaza o kitchen facility The main entrance to the building will be from Mainstreet. The proposed building will also require the granting of a side yard, rear yard and height variances. Primary Issues to Consider. o What is the zoning of the property, and how has the Comprehensive Plan designated the subject site? o What are the specifics of the proposed development? o What was the discussion at the Zoning and Planning meeting? • Primary Issues to Consider o What is the zoning of the property, and how has the Comprehensive Plan designated the subject site? The site is zoned B -3, General Business, and the Comprehensive Plan has designated the site as commercial. The proposed use complies with both documents. o What are the specifics of the development? Landscaping The site will maintain the existing "mainstreet theme" along Mainstreet. Additional landscaping provided on the site will be on the east, west and north sides. The northeast side of the building will be extensively planted with shrubs. The site is required to have 34 trees. Because of the "downtown" appearance of the building, 34 trees is not practical for the site. The ordinance does allow the Council to waive the landscaping requirements, which the staff would support in this situation. Fire Marshal The Fire Marshal has reviewed the proposed development and found it acceptable for access and water supply. Public Works Page 2 CR96 -171 The public works department reviewed the proposed arts facility and had the following comments: o It appears the alley between the facility and U S West offices will become a one -way. Staff will need to inform U.S. West of this matter. The alley is proposed to be reconstructed with concrete in 1998. o One stall in the parking lot will need to be designated for handicap parking. o The plan indicates one -eight inch roof drain. Staff needs to determine that this is sufficient to accommodate the large roof area. The proposed PVC roof drain system needs a manhole connection to the existing storm sewer in 11th Avenue North. o The development will need Nine Mile Creek Watershed District approval. Parking and Traffic The site is not required to have any on -site parking because the site abuts a B -2 zoning district. The site does have five parking spaces on the north side. A traffic study was completed to review both the theater and arts facility developments' impact on the traffic and parking. The study indicated that there was sufficient parking to accommodate both CR96 -171 Page 3 developments. Changes have been made in the roadway system to hopefully accommodate both developments. If adjustments need to be made after the theater /restaurant opens, these can be done before the arts facility opens. The parking ramp is available for the arts facility patrons to use. The architect is proposing that Mainstreet is a "no- parking" bus/drop off zone. The staff would also recommend that Mainstreet is a drop off zone. The theater /restaurant on the south side of Mainstreet has a drop -off zone. Trash There are two trash areas located on the north side of the site. One area is located on the west and the second on the east. The trash areas will be enclosed. The Public Works Department has concerns regarding the location and size of the trash receptacles. Their concern is that if the City picks up the trash, the trash receptacles have to be moved closer to the alley because of the automated system. Sidewalk There will be sidewalks on 11th, 12th and Mainstreet. The area along Mainstreet will be a plaza type setting. This plaza will accommodate an area for individuals to gather before and after an event. Access The site is surrounded by three streets and an alley. However, there is limited vehicle access on site. The only parking area on site is five parking spaces abutting the alley. All other access to the building is pedestrian access. Exterior The exterior will be similar to the theater /restaurant to the south with the pre - colored rockface concrete block. The tall exterior walls of the stage shall be constructed of load bearing painted precast concrete panels. The Mainstreet side of the building will be the lobby. The lobby will be curved and have an exterior of large green tinted glass and architectural- precast concrete with a limestone color finish. Lighting The lighting on Mainstreet will remain. Strategic Plan Zoning Requirements Alternatives CR96 -171 Page 4 The- proposed development - is a "goal o "lie Strategic Plan. The following is the goal and action step: Goal - Provide an atmosphere which will foster the retention of existing businesses on or near Mainstreet and attract new businesses. Action Step: Encourage destination type businesses with an emphasis on the arts, entertainment, recreation, and family oriented uses, to locate' on or near Mainstreet. The proposed arts facility meets the goal and action step of the Strategic Plan. B -3 Proposed front yard* 1 foot 1 rear yard 15 feet 0 north side yard 26 feet 4 inches 1 south side yard 0 4 height 45 feet 52 feet 8 inches *The shortest frontage on a corner lot is considered the front yard. Variances will have to be granted for side yard and rear yard setbacks and height. Surrounding uses The site is surrounded by the theater /restaurant on the south, the Boston Garden on the east, Firestone on the west and the U.S. West building on the north. o What was the discussion at the Zoning and Planning meeting? Ms. Anderson reviewed the proposed arts facility with the Commission. Dan O'Brien, the architect, appeared before the Commission. Mr. O'Brien reviewed the site plan with the Commission. The Commission discussed the lighting, drainage, location of trash receptacles, fire protection, sidewalk, and the exterior. No one in the audience spoke on this issue 1. Approve the conditional use permit to construct an arts facility. By approving the conditional use permit, the arts facility will be able to be constructed. CR96 -171 Page 5 2. Deny the conditional use permit to construct an arts facility. By denying the conditional use permit, the arts facility will not be able to be constructed. If the City Council considers this alternative, findings will have to be identified that support this alternative. 3. Continue for further information. If the City Council indicates that further information is needed, the item should be continued. That an application for a conditional use permit was made by the Hopkins HRA on September 27, 1996; That the Hopkins Zoning and Planning Commission, pursuant to mailed and published notice, held a public hearing on the application and reviewed such application on October 29, 1996: all persons present were given an opportunity to be heard; 3. That the written comments and analysis of City staff were considered; and 4. A legal description of the subject property is as follows: Lot 10, Block 70, Lot 11, Block 70, West Minneapolis Second Division, according to the plat thereof on file or of record in the office of the Register of Deeds for said County. Lots 12, 12, 14 and 15, Block 70, West Minneapolis Second Division, according to the recorded plat thereof, and situated in Hennepin County, Minnesota. NOW, THEREFORE, BE IT RESOLVED that the application for Conditional Use Permit CUP96 -5 is hereby approved based on the following Findings of Fact: 1. That the proposed development meets the requirements for a conditional use permit. BE IT FURTHER RESOLVED that application for Conditional Use Permit, CUP96 -5, is hereby approved based on the following conditions: 1. That Nine Mile Watershed District approves the proposed development. 2. That the site is developed and constructed as per the plans submitted. 3. That the variances are granted.
