CR 96-192 Request For State Variance - 17th Ave NNovember 21, 1996 Proposed Action. Staff recommends adoption of the following motion: Move to approve Resolution 96 -97, requesting a variance from State Aid standards to allow narking on both sides of 17 Avenue North from Main Street to 320 feet north of 3r Street North. Overview. APPROVE REQUEST FOR STATE AID VARIANCE 17 AVENUE NORTH PARKING Currently, parking is allowed only on the west side of 17 Avenue North. It has been this way since 1966 when the road was originally constructed to the current width of 36 feet. The residents living on the east side of 17 Avenue requested they be given the opportunity to have parking in front of their homes. A petition (signed by 24 homeowners) requesting parking was received. At the July 2n Council Meeting, Council requested staff seek approval to allow parking on both sides of 17 Avenue except during peak traffic periods of 7 - 9 a.m. and 4 - 6 p m The MNDOT State Aid Office cannot administratively approve staff's request for parking on both sides of 17 Avenue. MNDOT did not hold a 3rd quarter Variance Committee Meeting. Therefore, the request for variance will be considered for approval at a December 12 Variance Committee Meeting. The Committee requires an approved Council resolution. Staff recommendation. Staff recommends approval of Resolution 96 -67 requesting parking variance. Supporting Information. Stadler, Public Works Director Council Report 96 -192 • RESOLUTION NO. 96 -97 RESOLUTION REQUESTING VARIANCE FROM STATE AID STREET DESIGN STANDARDS WHEREAS, the City of Hopkins re- constructed 1st Street North from Mainstreet to T.H. 7, and WHEREAS, Municipal State Aid funds were expended on this 1991 project, and WHEREAS, the street was reconstructed to a width of 36 feet with parking on one side of the street, and WHEREAS, current State Aid Standards require a minimum design street width of 38 feet for collector streets with parking on both sides (Geometric Design Standard 8820.9935); NOW THEREFORE BE IT RESOLVED, that the City of Hopkins requests the Commissioner of the Department of Transportation to grant a variance to allow parking on both sides of 1st Street North (from Mainstreet to 320 feet north of 3rd Street North) BE IT FURTHER RESOLVED, that the City indemnifies, saves and holds harmless the State of Minnesota and all its agents and employees of and from any and all claims, demands, actions of any nature or character arising out of or by reason of, in any manner, the parking on 1st Street North in any other manner than parking on one side of the street. The City further agrees to defend at its sole cost and expense any action or proceeding commenced for the purpose of asserting any claim of whatsoever character arising as a result of the granting of this variance.
